District Blocks Charter School in Colorado"},"content":{"rendered":"<p><!--more-->By Renee Parsons<\/p>\n<p class=\"p2\"><span class=\"s1\">As the school board versus Critical Race Theory controversy has faded from the headlines, some districts are still wrestling with the fall out where the public school system has been shown to be less devoted to educational excellence than previously thought. <span class=\"Apple-converted-space\">\u00a0 <\/span>In Colorado, after nine school districts were flipped from being pro CRT to restoring parental rights and renewing a commitment to academics,<span class=\"Apple-converted-space\">\u00a0 <\/span>in southwest Colorado the Democratic machine overwhelmingly defeated its<span class=\"Apple-converted-space\">\u00a0 <\/span>opposition cited as \u2018right wing extremists\u2019<span class=\"Apple-converted-space\">\u00a0 <\/span>despite the non-partisan nature of school board elections.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">One issue that continues to struggle for recognition has been adding a highly anticipated charter school to the 9R public school district in Durango as the<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/www.ascentclassical.org\/\"><span class=\"s2\">Ascent Classical Academy<\/span><\/a><span class=\"Apple-converted-space\">\u00a0 <\/span>(ACA) attempted to file a Notice of Intent to Apply.<span class=\"Apple-converted-space\">\u00a0 <\/span>ACA, which expects to eventually serve K \u2013 12, is part of the Ascent Classical Academy Charter Schools, a Colorado charter school network which has a sterling reputation and has successfully opened three other Charter schools around the state over the last nine years. <span class=\"Apple-converted-space\">\u00a0 <\/span>No charter school like the ACA exists in southwest Colorado which would offer a classical, content-rich education using Core Knowledge and a liberal arts and science curriculum. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">In April of 2021,<span class=\"Apple-converted-space\">\u00a0 <\/span>Ascent informed then-9R District Superintendent of its intent to file who, unbeknownst to Ascent, was in the process of leaving his position at 9R.<span class=\"Apple-converted-space\">\u00a0 <\/span>With no response from 9R, Ascent filed a Notice of Intent in July, 2021 and again in August, 2021, both with the proposed first-day-of-school to be the fall of 2023. <\/span><span class=\"s3\"><span class=\"Apple-converted-space\">\u00a0 <\/span><\/span><span class=\"s1\">According to the <a href=\"https:\/\/www.csi.state.co.us\/applicants\/new\/\"><span class=\"s2\">Colorado Charter School Institute<\/span><\/a> (CRS 22-30.5-504(8), the law contains a statutory timeline during which a school district must accept all Notices of Intent during the year prior to opening day which would have locked Ascent into a first-day-of-school in 2022.<span class=\"Apple-converted-space\">\u00a0 <\/span>The statutory language also gives the School District the authority to waive the timeline and the flexibility to consider the benefits of approving a new Charter school as was done on behalf of The Juniper School <\/span><span class=\"s4\">(k-5)<\/span><span class=\"s1\"> which required more than one timeline waiver and other cooperative advantages in order to open its doors in 2017.<span class=\"Apple-converted-space\">\u00a0 <\/span>In other words, if locked in to a 2022 open-door date, Ascent could not adequately meet the bare requirements for any new school:<span class=\"Apple-converted-space\">\u00a0 <\/span>hiring a first class faculty and staff, developing necessary infrastructure and a physical facility and implementing its curriculum and class culture.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">However, with a new 9R Superintendent and new School Board in place, ACA\u2019s application was met with reluctance, delay and finally a brick wall as the Board refused to waive the timeline in order to facilitate a new educational institution in 2023 in Durango despite the fact that over 462 <i>\u2018expressions of interest\u2019<\/i><span class=\"Apple-converted-space\">\u00a0 <\/span>have been received as indicative of interest in the<span class=\"Apple-converted-space\">\u00a0 <\/span>Ascent project. <span class=\"Apple-converted-space\">\u00a0 <\/span>The current Board alleges that a cooperative stance toward Ascent would somehow inexplicably be \u2018<i>unfair<\/i>\u2019 to any other applicant \u2013 of which none exists as this time. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s3\">One noteworthy example of how the Board responded to Ascent\u2019s 2023 date was its refusal to acknowledge either ACA\u2019s original July 2021 Notice of Intent or its follow up filed on August 28<\/span><span class=\"s5\"><sup>th<\/sup><\/span><span class=\"s3\">. <span class=\"Apple-converted-space\">\u00a0 <\/span>The ACA later learned that the Board, acting without a publicly announced public meeting and without convening a formal executive session, privately conferred with its Denver attorney and obtained legal advice <\/span><span class=\"s1\">regarding ACA\u2019s<span class=\"Apple-converted-space\">\u00a0 <\/span>Notice of Intent.<span class=\"Apple-converted-space\">\u00a0 <\/span>Soon thereafter, at the close of the Board\u2019s next public<span class=\"Apple-converted-space\">\u00a0 <\/span>meeting on <a href=\"https:\/\/www.youtube.com\/watch?v=2MhY51s1j90&amp;t=12507s\"><span class=\"s2\">September 7, 2021<\/span><\/a>, again with no public agenda item as required by Colorado\u2019s Sunshine Open Meetings Law, the Board discussed the ACA request and made an official decision to reject consideration of the ACA request. <span class=\"Apple-converted-space\">\u00a0 <\/span>Therefore, the Board took official action as it made a legal decision on the basis of legal advice without conducting a public hearing or allowing any member of the public or any of the 462 interested parties to make public comment.<span class=\"Apple-converted-space\">\u00a0 <\/span>In a <a href=\"https:\/\/durango.ascentclassical.org\/wp-content\/uploads\/sites\/6\/2021\/12\/9-R-Board-to-Derec-Shuler-re-Request-for-Early-Application.pdf\"><span class=\"s2\">September 14<\/span><span class=\"s6\"><sup>th<\/sup><\/span><span class=\"s2\"> email<\/span><\/a>, the Board informed the ACA that it was \u2018<i>decided<\/i>\u2019 that \u2018<i>in the best interests of the district\u2019<\/i> it would not consider ACA\u2019s request for a waiver to allow its earlier Notice of Intent.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">It is worth noting that the great majority of respondents, 70% of potential Ascent attendees were from homeschoolers, private or online schools or out of District, while 30% were from 9R\u2019s current 5,000 member student body. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The process stalled further when the District\u2019s newly appointed Superintendent <a href=\"https:\/\/durango.ascentclassical.org\/wp-content\/uploads\/sites\/6\/2021\/11\/KC-email-DCS-re-Comments-on-October-5-Meeting.pdf\"><span class=\"s2\">shocked<\/span><\/a> Ascent with an October 5<\/span><span class=\"s7\"><sup>th<\/sup><\/span><span class=\"s1\"><span class=\"Apple-converted-space\">\u00a0 <\/span>letter that stated<span class=\"Apple-converted-space\">\u00a0 <\/span><i>\u201cI will decline your offer of a further meeting<\/i>\u201d which was then followed by a <a href=\"https:\/\/durango.ascentclassical.org\/wp-content\/uploads\/sites\/6\/2021\/12\/Email-response-to-public-comment.pdf\"><span class=\"s2\">misleading<\/span><\/a> email to potential Ascent parents by failing to indicate that the Board had the authority to grant a<span class=\"Apple-converted-space\">\u00a0 <\/span>timeline waiver and to act in a more collaborative manner than it had heretofore in order to facilitate Ascent\u2019s Notice of Intent.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><span class=\"Apple-converted-space\">\u00a0<\/span>After months of unnecessary delay and obfuscation, ACA does have an alternative which is to pursue a <a href=\"https:\/\/durango.ascentclassical.org\/wp-content\/uploads\/sites\/6\/2021\/12\/ACA-Durango-Request-to-9-R-RE-CSI-Release.pdf\"><span class=\"s2\">Request for Relinquishment<\/span><\/a> which would allow Ascent to seek authorization directly from the CSI in order to initiate approval of its application in the hopes of opening by 2023.<span class=\"Apple-converted-space\">\u00a0 <\/span>On December 13<\/span><span class=\"s7\"><sup>th<\/sup><\/span><span class=\"s1\">, Ascent filed such a request as the Board must give its approval.<span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>On January 11<\/span><span class=\"s7\"><sup>th<\/sup><\/span><span class=\"s1\">, the Board denied Ascent\u2019s Request as they remained adamant and unyielding. <span class=\"Apple-converted-space\">\u00a0 <\/span>In unanimous agreement, the Board persisted in maintaining control of the application as they appear to have no real commitment to the concept of a charter school.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">It remains inexplicable why a duly elected School Board would seem to deliberately thwart an opportunity to add another school to its District that would significantly increase the value of its educational contributions to its community and improve the educational experience for its children.<span class=\"Apple-converted-space\">\u00a0 <\/span>This Board would appear to benefit from a \u2018training\u2019 session to provide a better understanding of its legal<span class=\"Apple-converted-space\">\u00a0 <\/span>responsibilities and its obligation to better fulfill its civic role most especially to all its children<br
