{"id":12990,"date":"2020-05-01T17:13:04","date_gmt":"2020-05-01T21:13:04","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=12990"},"modified":"2020-05-01T17:13:04","modified_gmt":"2020-05-01T21:13:04","slug":"why-is-trump-ordering-the-selected-reserve-of-the-armed-forces-to-active-duty","status":"publish","type":"post","link":"http:\/\/stateofthenation.co\/?p=12990","title":{"rendered":"Why is Trump ordering the selected reserve of the Armed Forces to active duty?"},"content":{"rendered":"<p><!--more--><\/p>\n<h1 class=\"page-header__title\" style=\"text-align: center;\">Executive Order on Ordering the<br \/>\nSelected Reserve of the Armed<br \/>\nForces to Active Duty<\/h1>\n<div class=\"meta meta--mobile-wrap\">\n<div class=\"meta__issue\">\n<p class=\"issue-flag\" style=\"text-align: center;\">\u00a0<a href=\"https:\/\/www.whitehouse.gov\/issues\/national-security-defense\/\">NATIONAL SECURITY &amp; DEFENSE<\/a>\u00a0 \u00a0|\u00a0 <span class=\"meta__label\">Issued on:<\/span>\u00a0<time>April 30, 2020<\/time><\/p>\n<\/div>\n<\/div>\n<p>By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 12304 of title 10, United States Code, and having determined that it is necessary to augment the regular Armed Forces of the United States for a named operational mission, specifically the \u201cEnhanced Department of Defense Counternarcotic Operation in the Western Hemisphere,\u201d I hereby order as follows:<\/p>\n<p><u>Section<\/u>\u00a0<u>1<\/u>.\u00a0\u00a0<u>Activation Authority<\/u>.\u00a0 The Secretary of Defense\u00a0is directed to order to active duty for not more than 365\u00a0consecutive days, any units, and any individual members not assigned to a unit organized to serve as a unit, of the Selected Reserve under the jurisdiction of the Secretary of Defense, not to exceed 200 Selected Reservists at any one time, as he considers necessary.<\/p>\n<p><u>Sec<\/u>.\u00a0<u>2<\/u>.\u00a0\u00a0<u>General Provisions<\/u>. \u00a0(a) \u00a0Nothing in this order shall be construed to impair or otherwise affect:<\/p>\n<p>(i) \u00a0\u00a0the authority granted by law to an executive department or agency, or head thereof; or<\/p>\n<p>(ii)\u00a0 the functions of the Director of the Office of\u00a0Management and Budget relating to budgetary, administrative, or legislative proposals.<\/p>\n<p>(b)\u00a0 This order shall be implemented consistent with applicable law and subject to the availability of appropriations.<\/p>\n<p>(c)\u00a0 This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.<\/p>\n<p>DONALD J.
