which was referred to the Committee on Energy and Commerce<\/p>\n<\/div>\n<hr \/>\n<div><b>A BILL<\/b><\/div>\n<p>To authorize the Secretary of Health and Human Services to award grants to eligible entities to conduct diagnostic testing for COVID\u201319, and related activities such as contact tracing, through mobile health units and, as necessary, at individuals\u2019 residences, and for other purposes.<\/p>\n<p><em>Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,\u00a0<\/em><\/p>\n<p><span style=\"color: #000000;\">SECTION 1.\u00a0SHORT TITLE.<\/span><\/p>\n<div>\n<p>This Act may be cited as the \u201cCOVID\u201319 Testing, Reaching, And Contacting Everyone (TRACE) Act\u201d.<\/p>\n<\/div>\n<p><span style=\"color: #000000;\">SEC. 2.\u00a0COVID\u201319 TESTING AND CONTACT TRACING USING MOBILE HEALTH UNITS.<\/span><\/p>\n<p>(a)\u00a0In General.\u2014The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, may award grants to eligible entities to conduct diagnostic testing for COVID\u201319, to trace and monitor the contacts of infected individuals, and to support the quarantine of such contacts, through\u2014<\/p>\n<p>(1) mobile health units; and<\/p>\n<p>(2) as necessary, testing individuals and providing individuals with services related to testing and quarantine at their residences.<\/p>\n<p>(b)\u00a0Permissible Uses Of Funds.\u2014A grant recipient under this section may use the grant funds, in support of the activities described in subsection (a)\u2014<\/p>\n<p>(1) to hire, train, compensate, and pay the expenses of individuals; and<\/p>\n<p>(2) to purchase personal protective equipment and other supplies.<\/p>\n<p>(c)\u00a0Priority.\u2014In selecting grant recipients under this section, the Secretary shall give priority to\u2014<\/p>\n<p>(1) applicants proposing to conduct activities funded under this section in hot spots and medically underserved communities; and<\/p>\n<p>(2) applicants that agree, in hiring individuals to carry out activities funded under this section, to hire residents of the area or community where the activities will primarily occur, with higher priority among applicants described in this paragraph given based on the percentage of individuals to be hired from such area or community.<\/p>\n<p>(d)\u00a0Distribution.\u2014In selecting grant recipients under this section, the Secretary shall ensure that grants are distributed across urban and rural areas.<\/p>\n<p>(e)\u00a0Federal Privacy Requirements.\u2014Nothing in this section shall be construed to supersede any Federal privacy or confidentiality requirement, including the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/PLAW-104publ191\/pdf\/PLAW-104publ191.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.gpo.gov\/fdsys\/pkg\/PLAW-104publ191\/pdf\/PLAW-104publ191.pdf&amp;source=gmail&amp;ust=1589132918890000&amp;usg=AFQjCNFQL8DABS4WxJebnElZZBCwQpnxbA\">Public Law 104\u2013191<\/a>; 110 Stat. 2033) and section 543 of the Public Health Service Act (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=42&amp;section=290dd-2\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D42%26section%3D290dd-2&amp;source=gmail&amp;ust=1589132918890000&amp;usg=AFQjCNGCaVroTGRwdQjc5FgzLhzZnNpSOA\">42 U.S.C. 290dd\u20132<\/a>).<\/p>\n<p>(f)\u00a0Definitions.\u2014In this section:<\/p>\n<p>(1) The term \u201celigible entity\u201d means\u2014<\/p>\n<p>(A) a Federally qualified health center (as defined in section 1861(aa) of the Social Security Act (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=42&amp;section=1395x\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D42%26section%3D1395x&amp;source=gmail&amp;ust=1589132918890000&amp;usg=AFQjCNFxZniNucxG2UF1AmTc54QQIVFxfQ\">42 U.S.C. 1395x(aa)<\/a>));<\/p>\n<p>(B) a school-based health clinic;<\/p>\n<p>(C) a disproportionate share hospital (as defined under the applicable State plan under title XIX of the Social Security Act (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=42&amp;section=1396\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D42%26section%3D1396&amp;source=gmail&amp;ust=1589132918891000&amp;usg=AFQjCNEn5D--PS4HMk27L6f3hVHI7RMRKg\">42 U.S.C. 1396<\/a>\u00a0et seq.) pursuant to section 1923(a)(1)(A) of such Act (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=42&amp;section=1396r-4\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D42%26section%3D1396r-4&amp;source=gmail&amp;ust=1589132918891000&amp;usg=AFQjCNF1-duU_vP_GNP-gw_f2muRpLdvFA\">42 U.S.C. 1396r\u20134<\/a>));<\/p>\n<p>(D) an academic medical center;<\/p>\n<p>(E) a nonprofit organization (including any such faith-based organization);<\/p>\n<p>(F) an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=20&amp;section=1001\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D20%26section%3D1001&amp;source=gmail&amp;ust=1589132918891000&amp;usg=AFQjCNFSy7kWSEG9jaCUmiBHBA5dxShRng\">20 U.S.C. 1001<\/a>));<\/p>\n<p>(G) a high school (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=20&amp;section=7801\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D20%26section%3D7801&amp;source=gmail&amp;ust=1589132918891000&amp;usg=AFQjCNFvewJE0MaYaUQKX4s6SRZnM6p2rw\">20 U.S.C. 7801<\/a>)); or<\/p>\n<p>(H) any other type of entity that is determined by the Secretary to be an eligible entity for purposes of this section.<\/p>\n<p>(2) The term \u201cemergency period\u201d has the meaning given to that term in section 1135(g)(1)(B) of the Social Security Act (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=42&amp;section=1320b-5\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D42%26section%3D1320b-5&amp;source=gmail&amp;ust=1589132918891000&amp;usg=AFQjCNHZhJJbw6RxiX5Ho_Grm2r6IzDUTw\">42 U.S.C. 1320b\u20135(g)(1)(B)<\/a>).<\/p>\n<p>(3) The term \u201chot spot\u201d means a geographic area where the rate of infection with the virus that causes COVID\u201319 exceeds the national average.<\/p>\n<p>(4) The term \u201cmedically underserved community\u201d has the meaning given to that term in section 799B of the Public Health Service Act (<a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=42&amp;section=295p\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/uscode.house.gov\/quicksearch\/get.plx?title%3D42%26section%3D295p&amp;source=gmail&amp;ust=1589132918891000&amp;usg=AFQjCNFWpDyTHVDPPJOtUbr5BkqSArKjOg\">42 U.S.C. 295p<\/a>).<\/p>\n<p>(5) The term \u201cSecretary\u201d means the Secretary of Health and Human Services.<\/p>\n<p>(g)\u00a0Authorization Of Appropriations.\u2014To carry out this section, there are authorized to be appropriated\u2014<\/p>\n<p>(1) $100,000,000,000 for fiscal year 2020;
