Supreme Court Allows COVID Vaccine Mandate for Healthcare Workers to Go into Effect<\/strong><\/h1>\n

The Supreme Court upheld a regulation issued by the Centers for Medicare and Medicaid Services (CMS) that mandates vaccines for almost all employees at hospitals, nursing homes and other health care providers that receive federal funds. The ruling means that facilities across the country must ensure that their workforce is fully vaccinated. The Court ruled that the vaccine mandate falls within the authority that Congress gave to HHS and HHS can impose conditions on Medicare and Medicaid funds. Although some states, such as Florida, have laws limiting vaccine mandates, providers that wish to receive Medicare and Medicaid funding must adhere to CMS rules.<\/h3>\n

The mandate covers virtually all health care workers in the country, applying to providers that receive federal Medicare or Medicaid funding. It affects 10.4 million workers at 76,000 health care facilities as well as home health care providers. The rule has medical and religious exemptions. In many facilities without a vaccine mandate, 35% or more of staff remain unvaccinated. Chief Justice John Roberts and Justice Brett Kavanaugh joined the liberals to form the 5-4 majority. \u201cThe new CDC guidelines are not protecting frontline health care workers that come to work every day. They\u2019re forcing us to come back after five days regardless of if we\u2019re asymptomatic, regardless of how we\u2019re feeling. We believe this is the reason why staffing has become more critical,\u201d said Aviles.<\/p>\n
