Moreover, York included Shapley\u2019s legal team\u2019s claim that during an October 7, 2022, meeting at Weiss\u2019s office, six witnesses observed him state that he \u201cdid not have authority to charge in other districts and had thus requested special counsel status.\u201d<\/p>\n<p>The claim, which came on Friday, added:<\/p>\n<blockquote><p>Those six witnesses include Baltimore FBI Special Agent in Charge\u00a0Tom Sobocinski and Assistant Special Agent in Charge Ryeshia Holley, IRS Assistant Special Agent in Charge Gary Shapley and Special Agent in Charge Darrell Waldon, who also independently and contemporaneously corroborated\u00a0Mr. Shapley\u2019s account in an email, now public as Exhibit 10, following p. 148 of his testimony transcript. Mr. Shapley would have no insight into why Mr. Weiss\u2019s would make these statements at the October 7, 2022 meeting if they were false.\u00a0 That Mr. Weiss made these statements is easily corroborated, and it is up to him and the Justice Department to reconcile the evidence of his October 7, 2022 statements with contrary statements by Mr. Weiss and the Attorney General to Congress.<\/p><\/blockquote>\n<p>However, on the same day, Garland denied that Weiss ever asked him for a special counsel to be appointed in the matter, as Breitbart News\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2023\/06\/23\/watch-merrick-garland-denies-david-weiss-asked-for-special-counsel-powers-to-investigate-hunter-biden\/\">reported<\/a>:<\/p>\n<blockquote><p>\u201cI don\u2019t know how it would be possible for anybody to block him from bringing a prosecution given that he has this authority. He was never told no. I\u2019m saying he was given complete authority to make all decisions on his own,\u201d he continued.<\/p>\n<p>\u201cThe only person with authority to make somebody a special counsel or refuse to make somebody a special counsel is the Attorney General. Mr. Weiss never made that request to me.\u201d<\/p><\/blockquote>\n<p>Garland added, \u201cI would support Mr. Weiss explaining or testifying on these matters when he deems appropriate.\u201d<\/p>\n<p>McCarthy said Sunday that the facts need to come to light, \u201cand that includes reconciling these clear disparities.\u201d<\/p>\n<p>\u201cU.S. Attorney David Weiss must provide answers to the House Judiciary Committee,\u201d he added.<\/p>\n<p>The allegations come on the heels of the Department of Justice striking a plea deal with Hunter Biden, who will\u00a0<a href=\"https:\/\/www.breitbart.com\/crime\/2023\/06\/20\/conservatives-slam-dojs-sweetheart-deal-for-hunter-biden-two-tiered-justice-system\/\">plead<\/a>\u00a0guilty to two counts of \u201cwillful failure to pay federal income tax\u201d and\u00a0enter a \u201cpretrial diversion program\u201d for a firearm offense.
