US Senate Adopts 2024 NDAA with support of NATO\u2019s Article 5<\/b><\/h2>"},"content":{"rendered":"<p><!--more--><\/p>\n<h2 class=\"p1\"><span class=\"s1\"><span class=\"Apple-converted-space\">\u00a0 <\/span>US Senate Adopts 2024 NDAA with support of NATO\u2019s Article 5<\/span><\/h2>\n<p>Submitted by Renee Parsons<\/p>\n<p>Department of Energy nuclear programs was adopted on July 20th and now needs to be reconciled with the House version.<\/p>\n<p class=\"p4\"><span class=\"s1\">Some of the more significant amendments included:<\/span><\/p>\n<p class=\"p5\"><span class=\"s5\">*<span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>Senator Rand Paul (SC) introduced an amendment to the 2024 NDAA (S 2226) that was a \u201csense of the Senate\u201d in clarifying that \u201c<\/span><span class=\"s1\"><i>Article 5 of the North Atlantic Treaty does not supersede the constitutional requirement that Congress declare war before the United States engages in war<\/i>.\u201d <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p6\"><span class=\"s1\">Article 5 is a key pillar of the 1949 North Atlantic Treaty is based on the principle of collective defense. It means that an attack on one member of NATO is deemed to be an attack on all.<\/span><span class=\"s6\"> <span class=\"Apple-converted-space\">\u00a0 <\/span>The Senate vote was <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1181\/vote_118_1_00191.htm\"><span class=\"s3\">83 \u2013 16 against<\/span><\/a> the amendment with <b>all Democrats<\/b> voting No and <b>twenty eight Republicans<\/b> joining the Democrats to vote in favor of NATO and against the Constitution.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">Those twenty eight Republican Senators are Sens. Blackburn *(Tenn.), Britt (Ala), Boozman (La.)<span class=\"Apple-converted-space\">\u00a0 <\/span>Budd (NC), Graham (SC), Grassley (Iowa), Hoeven (ND), Hyde Smith (Miss.), Ricketts (Neb.), Risch (Idaho), Romney (Utah,)* Round (SD), Scott (SC), Scott (Fl.),* Capito (W.Va.), Collins (Me.), Cornyn (Texas), Cassidy (La.)<span class=\"Apple-converted-space\">\u00a0 <\/span>Crapo (Idaho), Ernst (Iowa), McConnell (Ky,) Fischer (Neb.),* Moran (Kansas), Young (Ind.)*, Wicker (Miss.)*, Tillis (NC), Thune (SD), and Sullivan (Alaska) <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">The * Senators are seeking re election in 2024.<span class=\"Apple-converted-space\">\u00a0 <\/span>Two days after Sen. Paul offered the amendment, his Kentucky office was <a href=\"https:\/\/ijr.com\/fire-destroys-sen-rand-pauls-office-middle-night\/\"><span class=\"s3\">firebombed<\/span><\/a>.<\/span><span class=\"s7\"><b><span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">* <span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>Sen. Tim Kaine (Va.) introduced an amendment to require an act of the Senate to suspend, terminate or withdraw from NATO which was adopted <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1181\/vote_118_1_00190.htm#position\"><span class=\"s3\">65 \u2013 28<\/span><\/a> with seven Not Voting.<span class=\"Apple-converted-space\">\u00a0 <\/span>The 65 Aye votes included eighteen Republicans while the 28 Nay votes were all Republican with seven Not Voting. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">It is important to note that NATO has had a foothold at the <a href=\"https:\/\/www.nato.int\/cps\/en\/natohq\/news_185870.htm\"><span class=\"s3\">Norfolk Naval Station<\/span><\/a> since July 2019 which is more recently renamed the <a href=\"https:\/\/www.act.nato.int\/article\/joint-all-domain-c2-and-mdo\/\"><span class=\"s3\">NATO Allied Command Transformation<\/span><\/a>.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">* <span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>Sen. Mike Lee (Utah) offered an amendment limiting the availability of financial assistance to Ukraine which failed <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1181\/vote_118_1_00195.htm#position\"><span class=\"s3\">71 \u2013 13<\/span><\/a> with sixteen Not Voting. <span class=\"Apple-converted-space\">\u00a0 <\/span>The Aye vote included forty two Democrats, twenty six Republicans and three Independents.<span class=\"Apple-converted-space\">\u00a0 <\/span>All the Nay votes were Republicans and the Not Voting were six Democrats and ten Republicans.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">* <span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>Final passage vote on the NDAA was 72 \u2013 25 with twenty six Republicans voting Aye.<span class=\"Apple-converted-space\">\u00a0 <\/span>Three Democrats voted Nay along with seventeen Republicans and one Independent.<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">The Senate\u2019s version of the NDAA must now go to the House in an attempt to resolve differences between the two bills.<\/span><\/p>\n<hr \/>\n<p class=\"p8\"><em><span class=\"s1\">Renee Parsons\u00a0served on the ACLU\u2019s Florida State Board of Directors and as president of the ACLU Treasure Coast Chapter.
