{"id":179562,"date":"2023-08-09T07:50:59","date_gmt":"2023-08-09T11:50:59","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=179562"},"modified":"2023-08-09T07:51:35","modified_gmt":"2023-08-09T11:51:35","slug":"struggling-through-a-constitutional-crisis","status":"publish","type":"post","link":"http:\/\/stateofthenation.co\/?p=179562","title":{"rendered":"<h1>Struggling through a Constitutional Crisis<\/h1>"},"content":{"rendered":"<p><!--more-->By Renee Parsons<\/p>\n<p class=\"p1\"><span class=\"s1\">As part of the Marxist agenda to transform an existential threat into a full blown Constitutional Crisis, the DOJ\u2019s <a href=\"https:\/\/www.justice.gov\/sco-smith\"><span class=\"s2\">Special Counsel Jack Smith<\/span><\/a><\/span> <span class=\"s1\">latest aspiration was to indict former President Donald Trump a <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/read-the-full-trump-indictment-on-mishandling-of-classified-documents\"><span class=\"s3\">second time<\/span><\/a>, criminalizing his election objections as if he could <a href=\"https:\/\/jonathanturley.org\/2023\/08\/07\/the-mind-of-donald-trump-why-proving-a-lie-will-not-necessarily-secure-a-conviction-for-jack-smith\/#more-208183\"><span class=\"s3\">verbally overturn<\/span><\/a> the 2020 results.<span class=\"Apple-converted-space\">\u00a0 <\/span>That indictment has proven to be an <a href=\"https:\/\/redstate.com\/nick-arama\/2023\/06\/15\/former-asst-u-s-attorney-takes-apart-trump-case-and-raises-some-important-questions-n762109\"><span class=\"s3\">overreach<\/span><\/a> of statutory authority within the framework of a <a href=\"https:\/\/jonathanturley.org\/2023\/08\/05\/yielding-to-temptation-jack-smiths-indictment-seeks-to-bag-donald-trump-at-any-cost\/\"><span class=\"s3\">flawed<\/span><\/a> legal document that would forever cripple the First Amendment.<span class=\"Apple-converted-space\">\u00a0 <\/span>Smith is intent on proving that Trump was fully aware that he had lost the election and yet stubbornly persisted to oppose election results despite evidence to the contrary.<span class=\"Apple-converted-space\">\u00a0 <\/span>Contrary to Smith\u2019s deepest desire, Trump was clearly convinced that he had won the 2020 election; therefore, relegating Smith\u2019s case to pure hogwash.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In Smith\u2019s favor is the \u2018random\u2019 appointment of a partisan <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/aug\/03\/tanya-chutkan-trump-jan-6-case-judge\"><span class=\"s3\">District Judge Tanya Chutkan<\/span><\/a> who was appointed by President Barack Obama and to whose campaign she made frequent <a href=\"https:\/\/www.thegatewaypundit.com\/2023\/08\/trump-calls-immediate-recusal-anti-trump-far-left\/\"><span class=\"s3\">financial contributions<\/span><\/a><\/span><span class=\"s4\">.<\/span><span class=\"s1\"> <span class=\"Apple-converted-space\">\u00a0 <\/span>The US Senate approved her nomination<span class=\"Apple-converted-space\">\u00a0 <\/span>in 2014 on a <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1132\/vote_113_2_00173.htm#position\"><span class=\"s2\">95-0 vote<\/span><\/a><\/span><span class=\"s5\"> with five Not Voting <\/span><span class=\"s1\">including Senators Mike Lee (Utah) and John Boozman (Ark).<span class=\"Apple-converted-space\">\u00a0 <\/span>That level of support would not occur today but came before awareness of a concerted Democratic campaign to fill the Federal Courts with unqualified partisan hacks.<span class=\"Apple-converted-space\">\u00a0 <\/span>If there was a time when<\/span><span class=\"s5\"> a lifetime appointed Federal Judge was above and beyond reproach, today\u2019s newly appointed judicial branch are predominately bobbing heads with little independent or analytical thinking skills.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">A native born Jamaican who grew up in Jamaica before moving to the US as a college student, raises the question of whether Chutkan is imbued with a heart-felt devotion to American principles like the Constitution or understands foreign concepts of freedom and liberty. <span class=\"Apple-converted-space\">\u00a0 <\/span>Associated with the politically tainted <a href=\"https:\/\/www.thegatewaypundit.com\/2023\/08\/trump-calls-immediate-recusal-anti-trump-far-left\/\"><span class=\"s3\">Boies, Schiller and Flexner law firm<\/span><\/a> for a dozen years which also represented <a href=\"https:\/\/www.bizpacreview.com\/2017\/12\/13\/federal-judge-mysteriously-recuses-fusion-gps-case-second-time-575393\/\"><span class=\"s3\">Fusion GPS<\/span><\/a> of Trump dossier fame, Chutkan was employed by BSF when <a href=\"https:\/\/dailycaller.com\/2023\/08\/01\/trump-judge-firm-boies-schiller-flexner-hunter-biden-burisma-tanya-chutkan\"><span class=\"s3\">Hunter Biden<\/span><\/a> was on the payroll<span class=\"Apple-converted-space\">\u00a0 <\/span>and who reportedly brought Burisma into the firm.<span class=\"Apple-converted-space\">\u00a0 <\/span>As a District Court Judge, Chutkan is known to have voluntarily recused herself twice from Hilary Clinton-<a href=\"https:\/\/www.bizpacreview.com\/2017\/12\/13\/federal-judge-mysteriously-recuses-fusion-gps-case-second-time-575393\/\"><span class=\"s3\">GPS related<\/span><\/a> cases without explanation; one case involved the lawsuit to <a href=\"https:\/\/www.breitbart.com\/politics\/2023\/08\/04\/exclusive-kash-patel-no-coincidence-donald-trump-drew-most-partisan-j6-judge\/\"><span class=\"s3\">release of bank records<\/span><\/a> connecting Fusion GPS to the dossier. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">On arraignment day, newly designated DC Chief <a href=\"https:\/\/www.latimes.com\/politics\/story\/2023-03-17\/new-judge-will-oversee-trump-grand-jury-investigations\"><span class=\"s3\">Judge James Boasberg<\/span><\/a> and <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2020\/02\/20\/roger-stone-case-judge-amy-berman-jackson-criticized-trump-allies\/4788196002\/\"><span class=\"s3\">Judge Amy Berman Jackson<\/span><\/a> made an unprecedented appearance (ie attorney-client privilege) during Trump\u2019s arrival for no legal purpose in what should be an impeachable act.<span class=\"Apple-converted-space\">\u00a0 <\/span>Their presence abolished any semblance of impartiality, fairness or objective judicial philosophy as their world view confirmed a disrespect for the legal process and contempt for the Defendant as well as setting the tone for Chutkan with a not-so-subtle green light to pull out all the stops.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">With expected governmental <a href=\"https:\/\/www.thegatewaypundit.com\/2023\/08\/just-judge-aileen-cannon-comes-swinging-delivers-blow\/\"><span class=\"s3\">chicanery<\/span><\/a> and judicial <a href=\"https:\/\/www.thegatewaypundit.com\/2023\/08\/just-president-trump-responds-jack-smiths-request-protective\/\"><span class=\"s3\">hanky pank<\/span><\/a>, the Defense in any of Trump\u2019s cases should <a href=\"https:\/\/www.thegatewaypundit.com\/2023\/08\/just-judge-aileen-cannon-comes-swinging-delivers-blow\/\"><span class=\"s3\">be primed<\/span><\/a> to file a series of motions to create a credible appealable record laying the necessary foundation for the Supreme Court to step in.<span class=\"Apple-converted-space\">\u00a0 <\/span>Tightening its grip on lawfare, Judge Chutkan will conduct a hearing in DC this week regarding arguments on the government\u2019s motion for a \u2018<i>protective order\u2019<\/i> to limit Trump\u2019s speech.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">As J6 Defendants have experienced, the process of adjudication through the Federal judiciary confirms that a black robe does not confer judicial excellence but does disguise <a href=\"https:\/\/www.justice.gov\/usao-edny\/pr\/social-media-influencer-douglass-mackey-convicted-election-interference-2016\"><span class=\"s3\">abuse of power<\/span><\/a> issues or malignant judicial hubris against American citizens conducted by political stooges.<span class=\"Apple-converted-space\">\u00a0 <\/span>Those same lackeys who believe themselves to hold all the cards; untouchable heavy hitters all of which brings the bloated DC Federal Court system to Congressional attention. <span class=\"Apple-converted-space\">\u00a0 \u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">With the site selected by George Washington as a compromise to north and south delegates in 1790, the Congress apportioned land from Virginia and Maryland to create a new Federal District mention of which was included in the <a href=\"https:\/\/www.heritage.org\/the-constitution\/report\/the-constitution-and-the-district-columbia\"><span class=\"s3\">US Constitution<\/span><\/a>. <span class=\"Apple-converted-space\">\u00a0 <\/span>Article I, Section 8, Clause 17 established<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201cexclusive Legislation\u201d to become the \u2018<i>Seat of the Government of the United States<\/i>.\u201d In Federalist 43, James Madison defined a \u201c<i>Federal District\u2019<\/i> subject to Congress\u2019s \u2018<i>exclusive jurisdiction<\/i>\u2026<i>separate from any state\u2019<\/i>.<span class=\"Apple-converted-space\">\u00a0 <\/span>In 1863, President Abraham Lincoln established the Supreme Court in the District of Columbia replacing four judges with perceived bias in favor of the south with four judges based on political loyalties to the US.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">With 68 sq. mi. and a population of 675,000 (2023), the <a href=\"https:\/\/www.dcd.uscourts.gov\/general-information\"><span class=\"s3\">US Direct Court<\/span><\/a>, District of Columbia Court system boasts <a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_District_Court_for_the_District_of_Columbia\"><span class=\"s3\">twenty six Federal judges<\/span><\/a> including<span class=\"Apple-converted-space\">\u00a0 <\/span>twelve District Judges, nine Senior Judges, four Magistrates and one Chief Judge. <span class=\"Apple-converted-space\">\u00a0 <\/span>That sounds like an excess of judges for a civilian population but Court jurisdiction also encompasses a Federal agency <a href=\"https:\/\/www.uscourts.gov\/judicial-caseload-indicators-federal-judicial-caseload-statistics-2022\"><span class=\"s3\">caseload<\/span><\/a> with an <a href=\"https:\/\/www.uscourts.gov\/statistics-reports\/federal-judicial-caseload-statistics-2022\"><span class=\"s3\">annual report<\/span><\/a> which articulates how many cases each judge works for a period of time within a one year period.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">While the Court operates totally under the Constitutional jurisdiction of the US Congress, the total 2022 cost to the Federal government for <a href=\"https:\/\/www.dccourts.gov\/sites\/default\/files\/matters-docs\/FY-2022-Budget-Justification.pdf\"><span class=\"s3\">District of Columbia courts<\/span><\/a> for operations and maintenance was $358 Million not including another $46 Million for public defender services.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span> <span class=\"s8\">Since November 2021,\u00a0US Attorney for the US District Court,<span class=\"Apple-converted-space\">\u00a0 <\/span>District of Columbia has been <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/Results%2520of%2520Executive%2520Business%2520Meeting%2520September%252023%25202021.pdf\"><span class=\"s3\">Matthew M. Graves<\/span><\/a> who was approved by the <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/Results%2520of%2520Executive%2520Business%2520Meeting%2520September%252023%25202021.pdf\"><span class=\"s3\">Senate Judiciary Committee<\/span><\/a> on a voice vote on September 23, 2021 and<\/span><span class=\"s6\"> a voice vote by the US Senate on October 28, 2021.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\"> * *<\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">According to the government, Trump\u2019s attempt to overturn the 2020 election included a concerted organized agenda in <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/4138124-trumps-fake-electors-7-states-he-lost\/\"><span class=\"s3\">seven states<\/span><\/a> which has led to <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/jul\/18\/michigan-false-electors-charged\"><span class=\"s3\">criminal prosecution<\/span><\/a> of<span class=\"Apple-converted-space\">\u00a0 <\/span>American citizens who have done nothing wrong, dishonest, unethical or even improper except for having a personal or political association with former President Donald Trump. <span class=\"Apple-converted-space\">\u00a0 <\/span>Well-meaning patriotic Americans who signed up in 2020 to serve as Trump Presidential Electors to the Electoral College (<a href=\"https:\/\/www.usconstitution.net\/xconst_A2Sec1.html\"><span class=\"s3\">Art. II, Section<\/span><\/a> 1) are now threatened with prosecution. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">For context, I served as an election judge at the county fairgrounds in Colorado all day on November 3<\/span><span class=\"s9\"><sup>rd<span class=\"Apple-converted-space\">\u00a0<\/span><\/sup><\/span><span class=\"s6\"> and, upon returning home late that evening,<span class=\"Apple-converted-space\">\u00a0 <\/span>it was immediately apparent that no states had yet \u2018<i>called<\/i>\u2019 the election for Trump; despite his state-wide results being far superior to Biden.<span class=\"Apple-converted-space\">\u00a0 <\/span>By that time, it was midnight on the East Coast.<\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">In the early morning hours of Wednesday November 4, as I continued to follow election results, I <a href=\"https:\/\/gettr.com\/streaming\/p2nrdj11ed1\"><span class=\"s3\">personally witnessed<\/span><\/a> the Trump-Biden numbers in Wisconsin \u2018flip \u2018 at around 1 am.<span class=\"Apple-converted-space\">\u00a0 <\/span>Trump had been in the lead by about 250,000 votes and suddenly, as I stared at the numbers on the screen, inexplicably, those numbers flipped with Biden receiving Trump\u2019s votes and Trump assuming Biden\u2019s votes. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">For the record, I have an exceedingly healthy lifestyle as the strongest drink or food I ever ingest is black coffee; I know what I saw and it could not have been more unequivocal despite a disbelief that votes had actually flipped before my eyes. <span class=\"Apple-converted-space\">\u00a0 <\/span>Shall I expect to be served with a Complaint and charged with conspiracy to commit election fraud for publicly sharing my experience?<\/span><\/p>\n<p class=\"p3\"><span class=\"s6\"> ***<\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">On December 14, 2020, Wisconsin Democrats met in the state Capitol to cast the state\u2019s ten electoral votes for Biden.<span class=\"Apple-converted-space\">\u00a0 <\/span>At the same time, ten Republicans gathered in the Capitol to fill out paperwork claiming Trump had won Wisconsin.<span class=\"Apple-converted-space\">\u00a0 <\/span><\/span><span class=\"s10\">They submitted their filings\u00a0to Congress, the National Archives, a federal judge and then-Wisconsin Secretary of State Doug La Follette.<\/span><\/p>\n<p class=\"p4\"><span class=\"s11\">Today, Wisconsin Governor Tony Evers has called for <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/4138009-wisconsin-governor-pushes-for-prosecution-2020-fake-electors\/\"><span class=\"s3\">prosecution<\/span><\/a> of those ten designated Trump electors for<\/span><span class=\"s6\"> \u201c<i>committing crimes<\/i> <i>with<\/i> <i>intent to overturn the election<\/i>.\u201d <span class=\"Apple-converted-space\">\u00a0 <\/span>In addition, Wisconsin Sen. Tammy Baldwin, up for re election in 2024 announced<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201c<i>There has to be accountability for perpetrating the big lie<\/i>,\u201d Baldwin said. \u201c<i>We know who won the election in Wisconsin. The folks who oversee the election said it was the most secure election we ever had<\/i>.\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span><\/span><span class=\"s11\"><span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p5\"><span class=\"s10\">In addition, Trump <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/4138124-trumps-fake-electors-7-states-he-lost\/\"><span class=\"s3\">electors<\/span><\/a> in <\/span><span class=\"s6\">Arizona, Georgia, Michigan, Nevada, New Mexico and Pennsylvania\u00a0are now implicated in what has been defined as an \u201c<i>illegal elector scheme<\/i>\u201c by signing the necessary paperwork believing Trump to be their true statewide winner.<span class=\"Apple-converted-space\">\u00a0 <\/span>These are voters who knew the final results were not yet final; that election glitches were still unfolding and that it was too early to verify election fraud before all outstanding questions were resolved.<span class=\"Apple-converted-space\">\u00a0 <\/span>In other words, the vote was certified before all questions were adequately addressed with the response \u201c<i>let\u2019s get it certified and call it a valid election<\/i>.\u201d Today, some of those Trump electors are being accused of election fraud while their expectation was they were participating in a Constitutionally legitimate election.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p6\"><span class=\"s6\"> ***<\/span><\/p>\n<p class=\"p5\"><span class=\"s6\"><span class=\"Apple-converted-space\">\u00a0<\/span>At the center of the chaos on January 6<\/span><span class=\"s9\"><sup>th<\/sup><\/span><span class=\"s6\"> was President of the Senate (aka Vice President Mike Pence).<span class=\"Apple-converted-space\">\u00a0 <\/span>As a problematic appointment, he was designated in Article II, Section 1 to \u201c<i>open all the certificates\u201d <\/i>and count the votes.<span class=\"Apple-converted-space\">\u00a0 <\/span>If a challenge occurred, if there were electoral discrepancies or anomalies as there were in 2020, the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Electoral_Count_Act\"><span class=\"s3\">Electoral Count Act of 1887<\/span><\/a> (ECA) would provide \u201c<\/span><span class=\"s8\"><i>procedures and deadlines for the states to follow in resolving disputes, certifying results, and sending the results to Congress<\/i><\/span><span class=\"s7\">.\u201d\u00a0\u00a0<\/span><span class=\"s6\"> During the contentious 2000 US Presidential election, the law\u2019s timing provisions did play a role in Bush v. Gore court decisions.<span class=\"Apple-converted-space\">\u00a0 <\/span>The Act, however, was <a href=\"https:\/\/www.floridalawreview.com\/wp-content\/uploads\/2010\/01\/Siegel-BOOK.pdf\"><span class=\"s3\">never<\/span><\/a> seriously tested in a disputed election, nor was it consulted on January 6, 2021. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p5\"><span class=\"s6\">In the heat of the chaos underway at the Capitol that day, there is little doubt that Pence was not up to the job. <span class=\"Apple-converted-space\">\u00a0 <\/span>To delay the final count and assert that legal advice and consultation was necessary would have required more courage and initiative than Pence had to offer.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p5\"><span class=\"s6\">At the December 20, 2020 <a href=\"https:\/\/www.youtube.com\/watch?v=g5txQoN9LbU\"><span class=\"s3\">Turning Point USA rally<\/span><\/a>, Pence made it clear \u2018<i>we will keep fighting until every legal vote is counted, we will keep fighting until every illegal vote is thrown out and we will win Georgia.\u201d<\/i><\/span><\/p>\n<p class=\"p7\"><span class=\"s12\">After the 2020 chaos, the Democrat-controlled Uniparty recognized that there was urgent need to \u2018amend\u2019 the ECA before the 2024 election. By 2022, the Senate <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/4573\/cosponsors\"><span class=\"s3\"><b>uniparty<\/b><\/span><\/a> sponsored the <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/4573\/text\"><span class=\"s3\"><b>Electoral Count Reform and Presidential Transition Improvement Act of 2022<\/b><\/span><\/a><\/span><span class=\"s6\">, led by Sens. Susan Collins (Maine) and Joe Manchin (WVa).<span class=\"Apple-converted-space\">\u00a0 <\/span>Predictably, the \u2018improvement act\u201d eliminated<span class=\"Apple-converted-space\">\u00a0 <\/span>the Vice President&#8217;s role to &#8220;<i>solely ministerial<\/i>,&#8221; with no power to &#8220;<i>determine, accept, reject, or otherwise adjudicate or resolve disputes over the proper list of electors, the validity of electors, or the votes of electors.&#8221;<span class=\"Apple-converted-space\">\u00a0 <\/span><\/i>The Act was<i> <\/i>attached to the year-end Omnibus and approved in the Senate in a <\/span><span class=\"s3\"><b>68-29 vote<\/b><\/span><span class=\"s6\"> with fourteen Republican Aye votes and House approval the following day in a <a href=\"https:\/\/clerk.house.gov\/Votes\/2022549\"><span class=\"s3\"><b>225-201<\/b><\/span><\/a> with nine <a href=\"https:\/\/clerk.house.gov\/Votes\/2022549\"><span class=\"s3\"><b>Aye<\/b><\/span><\/a> Republican votes.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<hr \/>\n<p class=\"p7\"><em><span class=\"s6\">Renee Parsons\u00a0served on the ACLU\u2019s Florida State Board of Directors and as president of the ACLU Treasure Coast Chapter.
