Devin Nunes (R-CA) is ringing alarm bells about the Foreign Intelligence Surveillance Court [FISC], saying that it is culpable, along with the FBI, for the improper wiretapping of former Trump campaign adviser Carter Page, and needs to be dismantled.<\/p>\n<p>Nunes, the ranking Republican member on the House Intelligence Committee, joined\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/fisa-court-slams-fbi-over-surveillance-applications-in-rare-public-order\">Fox News\u2019<\/a> Martha MacCallum Tuesday evening to discuss the FISA court\u2019s tardy rebuke of the FBI\u2019s handling of its surveillance-application process, and for the second time this week, he called for the secret court to be shut down.<\/p>\n<p>In a\u00a0<a href=\"https:\/\/www.fisc.uscourts.gov\/sites\/default\/files\/MIsc%2019%2002%20191217.pdf\">four page order<\/a>\u00a0Tuesday, the court\u2019s presiding judge Rosemary M. Collyer gave the bureau until Jan. 10 to come up with solutions, a week after Justice Department Inspector General Michael E. Horowitz issued his\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/read-doj-inspector-generals-fisa-report\">scathing report<\/a> detailing the FBI and DOJ\u2019s misconduct during the Trump\u2013Russia investigation.<\/p>\n<p>\u201cThe FBI\u2019s handling of the Carter Page applications, as portrayed in the [Office of Inspector General] report, was antithetical to the heightened duty of candor described above,\u201d\u00a0Collyer wrote. \u201cThe frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable.\u201d<\/p>\n<p>Tuesday night, Nunes argued that it is somewhat disingenuous for Collyer to claim today that she has concerns about fraud upon the court when the House Intelligence Committee notified the court of the substantial errors almost two years ago.<\/p>\n<p>\u201cI\u2019m glad to see the FISC court come out and make a statement but your viewers need to know that the FISC court is also culpable in this madness, and I say that because we sent them two letters\u2014very specific letters,\u201d Nunes told MacCallum.<\/p>\n<p>The California congressman explained that Republicans on the House Intelligence Committee sent Collyer the first letter in February of 2018, informing the court \u201cof very serious matters\u201d that they had found in their investigation. He said the court did absolutely nothing about it. The second letter, he said, was sent in the summer of 2018 after the House GOP found out about the exculpatory evidence the FBI had left off of their FISA applications.<\/p>\n<p>\u201cThe point here Martha is the court knew about all of this,\u201d Nunes said. \u201cI\u2019m glad they\u2019ve acted, I\u2019m glad they said something, but the court needs to be ended,\u201d he argued.<\/p>\n<p>The California Republican voiced concern that neither the FBI and FISA judges can be trusted with powerful surveillance powers on Sunday as well, telling\u00a0<a href=\"https:\/\/video.foxnews.com\/v\/6115994739001#sp=show-clips\">Fox News\u00a0<\/a>host Maria Bartiromo that the FISA court is in \u201ctremendous jeopardy.\u201d<\/p>\n<p>\u201cWe cannot support the FISA court right now,\u201d he said flatly. \u201cThe judges are refusing to take action against these dirty cops and dirty lawyers who did this.\u201d<\/p>\n<p>Nunes pointed out that the FISA court is a secret court that can target innocent people like Carter Page who have no recourse.\u00a0 \u201cLook, the American people at the end of the day \u2026 we\u2019re not going to give up our liberty in order to have some secret court operate to spy on political campaigns,\u201d he said.<\/p>\n<p>Unfortunately, Nunes noted, the American media helped the government cover up its gross misconduct. \u201cIn order to get back to normalcy in this country, we have to have a free and fair press, but we don\u2019t have that today,\u201d he lamented.<\/p>\n<p>When asked by MacCallum whether he believes that the FISA court really needs to be eliminated, Nunes replied, \u201cI\u2019m not going to speak in absolutes, but I will say that the way that the court\u2019s conducted themselves is totally inappropriate.
