{"id":223379,"date":"2024-04-15T12:39:51","date_gmt":"2024-04-15T16:39:51","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=223379"},"modified":"2024-04-15T12:39:51","modified_gmt":"2024-04-15T16:39:51","slug":"house-denies-fisa-court-warrant-on-american-surveillance","status":"publish","type":"post","link":"http:\/\/stateofthenation.co\/?p=223379","title":{"rendered":"<h2><b>House Denies FISA Court Warrant on American Surveillance<\/b><\/h2>"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Renee Parsons<\/span><!--more--><\/p>\n<p><span style=\"font-weight: 400;\">As the Congress had just returned from a two week paid vacation over the Easter holiday, the House was confronted with a dynamic duo of legislative behemoths.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a former Brit General warned Ukraine is at \u2018<\/span><a href=\"https:\/\/www.rt.com\/news\/595865-ukraine-collapse-british-general\/\"><span style=\"font-weight: 400;\">serious risk of collapse<\/span><\/a><span style=\"font-weight: 400;\">, it is preposterous that there will be a vote on another $60 billion budget supplemental to continue funding for the consistently failed war in Ukraine.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There is also the potential of a vote <\/span><a href=\"https:\/\/foreignpolicy.com\/2023\/11\/27\/russia-ukraine-war-central-bank-reserves-assets-seize-reparations-sanctions\/\"><span style=\"font-weight: 400;\">cashing in $300 billion worth of Russian securities<\/span><\/a><span style=\"font-weight: 400;\"> obtained by US sanctions in 2022 which is sure to stir a BRICS response.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The other hot topic of contention has been the reauthorization of <\/span><a href=\"https:\/\/www.nsa.gov\/Signals-Intelligence\/FISA\/\"><span style=\"font-weight: 400;\">FISA<\/span><\/a><span style=\"font-weight: 400;\"> to require a judicially approved warrant prior to any surveillance or spying on Americans.\u00a0 During the two days of House debate reached a level of intense resistance, seething with forceful pushback and determination that should have occurred twenty years ago before <\/span><a href=\"https:\/\/www.theguardian.com\/world\/2021\/sep\/04\/surveillance-state-september-11-panic-made-us-vulnerable\"><span style=\"font-weight: 400;\">911 opened the door<\/span><\/a><span style=\"font-weight: 400;\"> to mass surveillance of Americans.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Originally adopted by the <\/span><a href=\"https:\/\/www.brookings.edu\/articles\/40-years-ago-church-committee-investigated-americans-spying-on-americans\/\"><span style=\"font-weight: 400;\">Church Committee<\/span><\/a><span style=\"font-weight: 400;\"> in 1978, FISA was the result of revelations of widespread <\/span><a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-4\/\"><span style=\"font-weight: 400;\">Fourth Amendment<\/span><\/a><span style=\"font-weight: 400;\"> violations by the Federal government including unconstitutional, unlawful surveillance and spying on citizen activists and political groups.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although FISA included established procedures to conduct surveillance, one gaping omission was that of a FISA court-appointed search warrant applied to Americans as it conducted foreign intelligence activities within the domestic USA.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No problem. \u00a0 What could go wrong?\u00a0 Who could not have predicted that institutional abuse by intelligence agencies would occur?\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So it should be expected that Federal government abuse was cited in the <\/span><a href=\"https:\/\/www.washingtonexaminer.com\/news\/1434391\/read-doj-inspector-general-report-on-alleged-fisa-abuses\/\"><span style=\"font-weight: 400;\">DOJ\u2019s Inspector General Report<\/span><\/a><span style=\"font-weight: 400;\"> as the fraudulent Steele dossier was used by the DOJ and FBI to obtain four surveillance warrants against <\/span><a href=\"https:\/\/www.ocregister.com\/2024\/04\/11\/trump-and-fisa-a-fact-check\/\"><span style=\"font-weight: 400;\">Trump campaign<\/span><\/a><span style=\"font-weight: 400;\"> totally unimpeachable staffer Carter Page in 2016 and 2017.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Today, the FBI has been cited for rampant violations including 278,000 annual FISA searches in one year and another 3 million American \u2018queries\u2019 during 2021-2022 &#8211; all conducted without following DOJ rules and conducted on Americans without a Fisa-court approved search warrant. <\/span><span style=\"font-weight: 400;\"><\/p>\n<p><\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the House considered the rule to bring <\/span><a href=\"https:\/\/democrats-rules.house.gov\/bill\/118\/hr-7888\"><span style=\"font-weight: 400;\">HR 7888 <\/span><\/a><span style=\"font-weight: 400;\">to the House Floor, it\u00a0 failed on a <\/span><a href=\"https:\/\/clerk.house.gov\/evs\/2024\/roll108.xml\"><span style=\"font-weight: 400;\">193- 228<\/span><\/a><span style=\"font-weight: 400;\"> vote with <\/span><a href=\"https:\/\/news.yahoo.com\/19-republicans-voted-block-spy-190412076.html?fr=sycsrp_catchall\"><span style=\"font-weight: 400;\">19 Republicans<\/span><\/a><span style=\"font-weight: 400;\"> voting with the Democrats.\u00a0 Those nineteen Republicans understood the implications of exposing the lie of national security and that reauthorization without requiring a Court mandated warrant would continue unconstitutional government spying and conducting surveillance on the American public without their knowledge.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the two days of debate unfolded, there was never any doubt that the Intel agencies especially treasure their ability to conduct spying and surveillance of Americans with no oversight or accountability since the <\/span><a href=\"https:\/\/www.history.com\/topics\/21st-century\/patriot-act\"><span style=\"font-weight: 400;\">Patriot Act <\/span><\/a><span style=\"font-weight: 400;\">was adopted in 2001 and that Congressional Intel Committees are in sync with their surveillance agenda.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">By the second day,\u00a0 three amendments were brought to the Floor for consideration by sitting Members of the Permanent Select Committee on Intelligence, all of which were easily adopted by 268-152, 239-193 and 236-186 votes.\u00a0 Those votes are indicative of the power the intel agencies still wield with their secret classified <\/span><a href=\"https:\/\/www.washingtonpost.com\/national-security\/interactive\/2023\/scif-room-meaning-classified\/\"><span style=\"font-weight: 400;\">SCIF<\/span><\/a><span style=\"font-weight: 400;\"> strategy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the Reauthorization continued, support for mandating a search warrant on Americans increased as the single most crucial item of importance upon which adoption of the reauthorization depended as\u00a0 Rep. Andy Biggs (Az) introduced an up-or-down amendment to \u201c<\/span><i><span style=\"font-weight: 400;\">prohibit warrantless searches of US person communications.<\/span><\/i><span style=\"font-weight: 400;\">\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Biggs amendment failed in the heartbreak of a <\/span><a href=\"https:\/\/clerk.house.gov\/evs\/2024\/roll114.xml\"><span style=\"font-weight: 400;\">212-212<\/span><\/a><span style=\"font-weight: 400;\"> tie vote which according to House Chamber rules, is not adopted. \u00a0 In a review of the No voter names, some might consider it a blemish on Speaker Johnson that not one anti-warrant voter understood the essential Constitutional nature, albeit a clear Fourth Amendment issue within the Biggs amendment.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Obviously, not one anti-Biggs voter, even at the last minute, swing their vote to assure adoption of a Court-ordered search warrant on all Americans can only be considered a stunning rebuke of what remains of a less credible, duplicitous politcal class.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Joining Biggs in sponsoring the amendment were long time civil libertarians still within the Democratic party:\u00a0 Rep. Jerry Nadler (NY), Zoe Lofgren (Cal), Rep. Sheila Jackson-Lee (Texas) and Rep. Pramila Jayapal (Wash.) as well as Republicans Rep. Jim Jordan (Ohio) and Rep. Warren Davidson (Ohio), author of the \u201c<\/span><a href=\"https:\/\/davidson.house.gov\/2023\/7\/fourth-amendment-is-not-for-sale-act-passes-judiciary-committee\"><i><span style=\"font-weight: 400;\">Fourth Amendment<\/span><\/i><\/a><i><span style=\"font-weight: 400;\"> is Not For Sale Act<\/span><\/i><span style=\"font-weight: 400;\">\u201d.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a sort of consolation prize, Rep. Chip Roy\u2019s (Texas) amendment to \u201c<\/span><i><span style=\"font-weight: 400;\">require the FBI to report to Congress on a quarterly basis the number of US person queries conducted\u201d<\/span><\/i><span style=\"font-weight: 400;\"> was adopted 269- 153.\u00a0 Does any one seriously expect the FBI to follow that amendment?\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Allegations that the GOP House is in <\/span><a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/nobody-can-lead-this-place-house-gop-erupts-over-dysfunction-after-hardliners-kill-vote\/ar-BB1lprxw\"><span style=\"font-weight: 400;\">disarray<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2024\/01\/17\/house-gop-conservative-max-miller-bob-good-freedom-caucus\/72261822007\/\"><span style=\"font-weight: 400;\">unable to accomplish<\/span><\/a><span style=\"font-weight: 400;\"> or make any forward progress is a total misread of the split within Republican ranks.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the American experiment in a Constitutional Republic struggles to retain its most fundamental rights, what is most disturbing is the coordinated threat by certain establishment GOP Americans who are in the forefront of the opposition along with Democrats who support a downward slide into totalitarianism.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Come Hell or High water, all 435 House of Representatives Members are up for re-election every two years and therein lies a Golden Opportunity to roust those who repeatedly fail in their duty to protect the country\u2019s interest before the interests of their campaign donors.\u00a0\u00a0<\/span><span style=\"font-weight: 400;\">Final passage on \u201c<\/span><i><span style=\"font-weight: 400;\">Reforming Intelligence and Securing America Act<\/span><\/i><span style=\"font-weight: 400;\">\u201d was 273 -147 with 126 Republicans voting with Dems to exclude a FISA Search warrant requirement for all Americans.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Renee Parsons<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-223379","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"_links":{"self":[{"href":"http:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts\/223379","targetHints":{"allow":["GET"]}}],"collection":[{"href":"http:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"http:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"http:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"http:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=223379"}],"version-history":[{"count":0,"href":"http:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts\/223379\/revisions"}],"wp:attachment":[{"href":"http:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=223379"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"http:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=223379"},{"taxonomy":"post_tag","embeddable":true,"href":"http:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=223379"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
