This executive action is said to provide economic relief during the current\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/coronavirus-recession-how-bad-it-could-get-and-what-it-means-for-you\/\">recession caused by the coronavirus<\/a><\/span>. Americans still want to know\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/stimulus-package-talks-could-resume-this-week-heres-whats-happening-today\/\">what it all means<\/a><\/span>\u00a0&#8212; how can these unilateral actions could help (read on), if there could still be a\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/second-stimulus-check-in-2020-whats-the-most-money-you-could-get-its-complicated\/\">second stimulus check<\/a><\/span>\u00a0or larger\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/stimulus-package-could-still-happen-every-benefit-you-might-get-if-it-does\/\">rescue package coming<\/a><\/span>\u00a0(yes) and if Trump&#8217;s actions are even legal (unclear).<\/p>\n<p class=\"speakableTextP2\">&#8220;These Executive Orders build upon our ongoing implementation of the\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/heals-vs-cares-vs-heroes-the-proposals-biggest-sticking-points-and-how-they-all-compare\/\">CARES Act<\/a><\/span>, which is delivering meaningful results for the American people,&#8221;\u00a0<a href=\"https:\/\/home.treasury.gov\/news\/press-releases\/sm1089\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">Treasury Secretary Steven Mnuchin<\/a>\u00a0said in a statement, Sunday. The executive actions, however, have been\u00a0<a href=\"https:\/\/thehill.com\/homenews\/senate\/511196-pelosi-schumer-slam-trump-executive-orders-call-for-gop-to-come-back-to\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">sharply criticized<\/a>\u00a0by Democratic negotiators.<\/p>\n<p>&#8220;Unfortunately, the President&#8217;s executive orders described in one word could be paltry. In three words: unworkable, weak and far too narrow,&#8221; Senate Minority Leader Chuck Schumer said on\u00a0<a href=\"https:\/\/twitter.com\/ThisWeekABC\/status\/1292447327454666753?s=20\" target=\"_blank\" rel=\"noopener noreferrer\" data-component=\"externalLink\">ABC&#8217;s This Week, Sunday<\/a>.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/category\/shows\/fox-news-sunday\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">On Fox News Sunday<\/a>, House Speaker Nancy Pelosi said that if Trump seeks to make a payroll tax cut, it would undermine Social Security and Medicare.<\/p>\n<p>Here&#8217;s everything we know about Trump&#8217;s executive actions.<\/p>\n<h2>Enhanced unemployment benefits, with a catch<\/h2>\n<p><strong>What it is<\/strong>: Following Trump&#8217;s\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/memorandum-authorizing-needs-assistance-program-major-disaster-declarations-related-coronavirus-disease-2019\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">memorandum<\/a>, the federal government would contribute $300 of the $400 payment. Individual states &#8212; already pinching pennies amid the coronavirus outbreak &#8212; are responsible for the remaining $100 per person per week, retroactively starting Aug. 1. It&#8217;s possible state governors could push back on footing 25% of the bill.<\/p>\n<p><strong>How it would be funded<\/strong>: Trump is unilaterally seeking to use leftover or unspent\u00a0<a href=\"https:\/\/www.fema.gov\/news-release\/20200220\/what-fema-public-assistance\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">FEMA<\/a>\u00a0funds to pay unemployment benefits.<\/p>\n<p>&#8220;I am directing up to $44 billion from the [Disaster Relief Fund],&#8221; Trump&#8217;s memorandum says. &#8220;At least $25 billion of total DRF balances will be set aside to support ongoing disaster response and recovery efforts and potential 2020 major disaster costs.<\/p>\n<figure class=\"image image-large pull-none hasCaption shortcode\"><span class=\"imageContainer\"><img decoding=\"async\" class=\"\" src=\"https:\/\/cnet4.cbsistatic.com\/img\/rR5_2zw4--jIpNrhbbQnhJPFiD8=\/2020\/08\/06\/2a85aa14-33b1-4076-b7da-0bfde55d7314\/breaking-the-piggy-bank-stimulus-check-cash-money-savings-debt-personal-finance-014.jpg\" alt=\"breaking-the-piggy-bank-stimulus-check-cash-money-savings-debt-personal-finance-014\" \/><\/span><figcaption>There&#8217;s some question about the legality and practicality of some of these orders.<span class=\"credit\">Sarah Tew\/CNET<\/span><\/p>\n<\/figcaption><\/figure>\n<p>Experts predict this year&#8217;s hurricane season will see\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/hurricane-season-2020-forecast-extremely-active-24-named-storms\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-component=\"externalLink\">an &#8220;extremely active&#8221; series of storms.<\/a>\u00a0According to the National Oceanic and Atmospheric Administration\u00a0<a href=\"https:\/\/coast.noaa.gov\/states\/fast-facts\/hurricane-costs.html#:~:text=Of%20the%20246%20(as%20of,almost%20%2422%20billion%20per%20event.\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">hurricanes can cost upwards of $22 billion<\/a>\u00a0per storm.<\/p>\n<p><strong>Could there be a legal challenge?<\/strong>\u00a0This executive action could be challenged legally since the\u00a0<a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artI_S8_C1_2\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">Constitution gives Congress control over federal spending<\/a>. As such,\u00a0<a href=\"https:\/\/www.reuters.com\/article\/us-health-coronavirus-usa-orders-explain\/explainer-trump-wants-to-bypass-u-s-coronavirus-aid-talks-with-executive-order-can-he-idUSKCN2531W0\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">Trump doesn&#8217;t have the legal authority<\/a>\u00a0to issue binding executive orders about how money should be spent during the coronavirus pandemic.<\/p>\n<p><strong>Another objection<\/strong>: The executive orders &#8220;don&#8217;t give the money to the enhanced benefit, but puts a complicated formula there, which will take a while if at all to accomplish to put money in the pockets of the American people,&#8221; Pelosi said Sunday on\u00a0<a href=\"https:\/\/www.foxnews.com\/category\/shows\/fox-news-sunday\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">Fox News<\/a>.<\/p>\n<p>&#8220;The Labor Department working with states believe it could happen much, much faster than that,&#8221; White House economic advisor Larry Kudlow\u00a0<a href=\"https:\/\/twitter.com\/CNNSotu\" target=\"_blank\" rel=\"noopener noreferrer\" data-component=\"externalLink\">said Sunday<\/a>, adding that people could expect checks in a couple of weeks.<\/p>\n<figure class=\"image image-large pull-none hasCaption shortcode\"><span class=\"imageContainer\"><img decoding=\"async\" class=\"\" src=\"https:\/\/cnet4.cbsistatic.com\/img\/n5gT-1TsF2wjKAX3BFSMpBH-AGA=\/2020\/06\/09\/5ee67da1-06c9-462a-bd24-8776da6c7748\/stimulus-mailboxes-coronaviris-2578.jpg\" alt=\"stimulus-mailboxes-coronaviris-2578\" \/><\/span><figcaption>Will there be another check in the mail for a one-time stimulus payment or enhanced unemployment? Both are possible.<span class=\"credit\">Angela Lang\/CNET<\/span><\/p>\n<\/figcaption><\/figure>\n<h2>Eviction order: Protections have not been renewed yet<\/h2>\n<p>The\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/heals-vs-cares-vs-heroes-the-biggest-sticking-points-in-the-proposals-and-how-they-compare\/\">CARES Act<\/a><\/span>\u00a0banned\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/eviction-moratorium-in-august-the-current-update-on-rent-relief-and-landlord-laws\/\">late fees and eviction filings<\/a><\/span>\u00a0until July 25 on properties backed by federal mortgage programs &#8212; like Fannie Mae &#8212; or those that receive federal funds like HUD. The Republican-authored HEALS Act didn&#8217;t address stipulations on evictions, and Trump&#8217;s executive order is surprisingly low on detail.<\/p>\n<p>It leaves the decision to ban evictions in the hands of Health and Human Services Secretary Alex Azar and Centers for Disease Control and Prevention Director Robert Redfield, taking no official stance itself.<\/p>\n<p>&#8220;The secretary of Health and Human Services and the director of CDC shall consider whether any measures temporarily halting residential evictions of any tenants for failure to pay rent are reasonably necessary to prevent the further spread of COVID-19 from one state or possession into any other state or possession,&#8221;\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/executive-order-fighting-spread-covid-19-providing-assistance-renters-homeowners\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">the White House&#8217;s memo regarding evictions said<\/a>.<\/p>\n<p>In addition, the order doesn&#8217;t specify if it will provide financial assistance to renters, leaving that decision to Treasury Secretary Steven Mnuchin and Housing and Urban Development Secretary Ben Carson.<\/p>\n<figure class=\"image image-large pull-none hasCaption shortcode\"><span class=\"imageContainer\"><img decoding=\"async\" class=\"\" src=\"https:\/\/cnet2.cbsistatic.com\/img\/7VIQ-kN0r2EXzUpJmu7CkKm4Y0I=\/2020\/08\/05\/b418f3ea-cafe-4dc9-bf22-212ed6fb3a0c\/poor-small-change-pennies-on-the-dollar-money-cash-stimulus-payments-personal-finance-001.jpg\" alt=\"poor-small-change-pennies-on-the-dollar-money-cash-stimulus-payments-personal-finance-001\" \/><\/span><figcaption>If your student loan is deferred, it&#8217;s possible you&#8217;ll have to make up the full amount later.<span class=\"credit\">Sarah Tew\/CNET<\/span><\/p>\n<\/figcaption><\/figure>\n<h2>Student loan payment deferral extends original deadline<\/h2>\n<p>The White House&#8217;s\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/memorandum-continued-student-loan-payment-relief-covid-19-pandemic\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">memorandum on student loan deferral<\/a>\u00a0moves to waive student loan interest until Dec. 31, 2020, extending the current relief under the CARES Act that is set to expire Sept. 30 by two months. Payments are scheduled to restart on Jan. 1, 2021.<\/p>\n<p><strong>There&#8217;s a catch<\/strong>: Trump&#8217;s memo applies to loans &#8220;held by the Department of Education,&#8221; which doesn&#8217;t include privately held student loans, such as through a bank.<\/p>\n<h2>The contentious payroll tax cut: How it works<\/h2>\n<p>A pet project of Trump&#8217;s that he&#8217;s been pushing for months, the &#8220;payroll tax holiday&#8221; seeks to defer your federal tax withholding, which means you&#8217;d take home more money per paycheck &#8212; temporarily. Since this is a deferral and not tax forgiveness, you would still have to pay those taxes after the deferral period passes &#8212; without having to pay additional interest or tax. The memo includes language to explore avenues for eliminating the deferred tax altogether.<\/p>\n<p><strong>The fine print<\/strong>: Trump&#8217;s\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/memorandum-deferring-payroll-tax-obligations-light-ongoing-covid-19-disaster\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">memorandum<\/a>\u00a0covers a four-month period from Sept. 1, 2020, through Dec. 31, 2020, for people earning less than $100,000 a year, or less than $4,000 every two weeks (pre-tax).<\/p>\n<p>The memo&#8217;s language specifies that Mnuchin, as Treasury secretary, can\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/26\/7508A\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">exercise his authority<\/a>\u00a0to &#8220;defer the withholding, deposit, and payment of the tax.&#8221; According to the US Code cited, Mnuchin could extend this for one year.<\/p>\n<p>Payroll taxes\u00a0<a href=\"https:\/\/www.ssa.gov\/news\/press\/factsheets\/HowAreSocialSecurity.htm\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">fund social security and Medicare<\/a>.<\/p>\n<figure class=\"image image-large pull-none hasCaption shortcode\"><span class=\"imageContainer\"><img decoding=\"async\" class=\"\" src=\"https:\/\/cnet2.cbsistatic.com\/img\/DRtAc5PvAN-i4FnZnD6P-08uClM=\/2020\/08\/04\/e8a2f17c-6b28-4994-9137-25cf39dfeea0\/stimulus-check-in-us-mail-envelope-cash-money-2020011.jpg\" alt=\"stimulus-check-in-us-mail-envelope-cash-money-2020011\" \/><\/span><figcaption>There are limits to the president&#8217;s executive powers, which could be put to the test in the coming days.<span class=\"credit\">Sarah Tew\/CNET<\/span><\/p>\n<\/figcaption><\/figure>\n<p><strong>Could Trump be sued?<\/strong>\u00a0Congress is authorized with writing and passing laws regarding financial decisions. The White House can&#8217;t forgive taxes\u00a0<a href=\"https:\/\/www.npr.org\/2020\/08\/08\/900516854\/in-executive-actions-trump-extends-unemployment-benefits\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">without Congressional approval<\/a>.<\/p>\n<p>When asked if he was concerned about the legality of an executive action\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=1GO126WAUmA\" target=\"_blank\" rel=\"noopener noreferrer\" data-component=\"externalLink\">during a press conference Friday<\/a>, the president said, &#8220;No, not at all &#8230; well, you always get sued. Everything you do, you get sued.&#8221;<\/p>\n<h2>How could an executive order differ from legislation?<\/h2>\n<p>So far, the executive actions signed by Trump will only cover the four topics above, rather than the large scope of either the\u00a0<span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/heals-vs-cares-vs-heroes-the-biggest-sticking-points-in-the-proposals-and-how-they-compare\/\">Democrats&#8217; or Republicans&#8217; stimulus proposals<\/a><\/span>. Democrats have said that\u00a0<a href=\"https:\/\/www.pscp.tv\/w\/1PlKQNkoneVGE\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">an executive order won&#8217;t go far enough<\/a>.<\/p>\n<h2>Will negotiations over the stimulus package continue?<\/h2>\n<p><span class=\"link\"><a href=\"https:\/\/www.cnet.com\/news\/stimulus-package-talks-could-resume-this-week-heres-whats-happening-today\/\">Stimulus check discussions could ramp again this week<\/a><\/span>, with Democratic leaders repeating their call for bipartisan negotiations to agree on a more comprehensive solution.<\/p>\n<p>&#8220;We are ready to meet the White House and Republicans halfway,&#8221;\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/meet-the-press\/coronavirus-aid-bill-stalled-white-house-adviser-questions-democrats-good-n1236239\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">Democratic Minority Whip Dick Durbin said Sunday<\/a>. &#8220;We&#8217;ve said that from the start.&#8221;<\/p>\n<p>Mnuchin didn&#8217;t confirm whether talks would restart, but expressed openness to the possibility. &#8220;If we can get a fair deal, we&#8217;re willing to do it this week,&#8221;\u00a0<a href=\"https:\/\/www.cnbc.com\/2020\/08\/10\/mnuchin-is-open-to-more-coronavirus-stimulus-talks-were-prepared-to-put-more-money-on-the-table.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-component=\"externalLink\">he told CNBC<\/a>, Monday.<\/p>\n<p>If talks resume swiftly, the legislation could presumably go to a vote in one chamber as soon as Tuesday or Wednesday. Both chambers must vote before the legislation lands on Trump&#8217;s desk for his signature.
