Digital Services Act Challenges the First Amendment<\/b><\/h2>"},"content":{"rendered":"<p><!--more--><span class=\"s1\">Renee Parsons<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On the eve of the Elon Musk \u2013 Donald Trump <a href=\"https:\/\/x.com\/Voz_US\/status\/1823320620568084703\"><span class=\"s2\">conversation<\/span><\/a> which aired over X on August 13th, an obscure EU Commissioner wrote to X Chair\/Owner Musk in a presumptuous, if brazen, letter asserting that the UK\u2019s Constitutionally flawed <a href=\"https:\/\/en.wikipedia.org\/wiki\/Digital_Services_Act\"><span class=\"s2\">Digital Services Act<\/span><\/a> required US compliance.<span class=\"Apple-converted-space\">\u00a0 \u00a0 <\/span>Nothing could be further from the truth.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Written on behalf of the European Commission, EU Commissioner Thierry Breton\u2019s <a href=\"https:\/\/x.com\/ThierryBreton\/status\/1823033048109367549\"><span class=\"s2\">letter<\/span><\/a> aroused considerable public attention as it stirred more interest in the upcoming conversation between America\u2019s two high profile icons.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Breton was part of the von der Leyden Commission which prepared the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\"><span class=\"s2\">DSA<\/span><\/a> based on Ursula von der Leyden\u2019s draft proposal during her campaign for EU President in 2019.<span class=\"Apple-converted-space\">\u00a0 <\/span>In its adoption of the DSA, the EU which does not recognize America\u2019s First Amendment or its intent, assumes an international mandate over all digital communication as it declares itself the lone arbiter of what constitutes all that is fit to print.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Breton\u2019s letter asserted that the legally defective &#8220;<\/span><span class=\"s2\"><i>DSA<\/i><\/span><span class=\"s1\"><i> obligations apply without exceptions or discrimination to the moderation of the whole user community and content of X (including yourself as a user with over 190 million<\/i> <i>followers<\/i>)\u201d while citing X\u2019s responsibility to submit to the \u201c<i>risk of amplification of potential harmful content around the world.\u201d <\/i><span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Breton went on to remind Musk<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201c<i>I am compelled to remind you of the due diligence obligations in the Digital Services Act (DSA)\u201d <\/i>although as a US citizen and X as a US company, neither are under any obligation to comply with the DSA.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">At the same time, Breton\u2019s letter tested the historic borders of a foreign country daring to insinuate itself directly into American politics, not unlike how Israel has assumed ownership of the entire US Congress.<span class=\"Apple-converted-space\">\u00a0 <\/span>The EU\u2019s adoption of the DSA has lost sight of the fact that Great Britain\u2019s ability to influence American policy ended when General Cornwallis surrendered to George Washington at Yorktown in 1781. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">What received little media attention the next day was that Breton\u2019s letter received no green light from EU President Ursula von der Leyden and that Breton took it upon himself to initiate the letter to Musk who had already by targeted by the DSA.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">After creating considerable turmoil on both sides of the pond, Breton was <a href=\"https:\/\/www.foxbusiness.com\/politics\/eu-says-regulator-wasnt-cleared-warn-musk-against-amplifying-harmful-content-trump-x-interview\"><span class=\"s2\">not authorized<\/span><\/a> to issue any warning to Musk citing \u2018<i>harmful content\u2019<\/i> by broadcasting the conversation with former President Trump as it demanded X compliance with the DSA. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">What Breton called X\u2019s \u2018<i>due diligence obligations\u2019<\/i> requires platforms like X to \u2018<i>moderate illegal content\u2019<\/i> that is deemed a \u201c<i>risk to public safety<\/i>.&#8221;\u00a0<span class=\"Apple-converted-space\">\u00a0 <\/span>Breton\u2019s letter, nor does the DSA, define what constitutes \u2018illegal\u2019 content.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Known as UK\u2019s <a href=\"https:\/\/www.politico.eu\/article\/eu-elon-musk-donald-trump-interview-thierry-breton-letter-social-media\/\"><span class=\"s2\">top digital<\/span><\/a> enforcer, Breton was immediately faulted by the EU of \u2018<i>going rogue\u2019<\/i> as it offered<span class=\"Apple-converted-space\">\u00a0 <\/span>that Breton\u2019s \u201c<i>timing and the wording of the letter were neither coordinated or agreed with the president nor with the [commissioners<\/i>].\u201d\u00a0 <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">With a false sense of influence since no EU Members are elected to public office,<span class=\"Apple-converted-space\">\u00a0 <\/span>Breton\u2019s letter constituted interference in American politics as House Judiciary Committee Chair, Rep. Jim Jordan informed the Commissioner that the Committee \u201c<a href=\"https:\/\/www.benzinga.com\/news\/24\/08\/40427913\/gop-led-house-judiciary-committee-slams-eus-thierry-breton-for-trying-to-intimidate-elon-musks-x-fre\"><span class=\"s2\"><i>condemned the European Union\u2019s actions<\/i><\/span><\/a><i>, threatening to investigate their attempts to infringe on free speech.\u201d<\/i> <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Jordan went on to \u201c<i>demand that you stop any attempt to intimidate individuals or entities engaged in political speech in the United States\u201d <\/i>and that the Committee<i> <\/i>is conducting oversight on whether the US State Department has colluded to censor lawful speech as it subpoenaed the Department to respond to the Biden Administration\u2019s silence.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Background for Breton\u2019s over-reaction has blamed social media in the UK for false information while fueling far-right sentiment within the EU that precipitated the spread of\u00a0<a href=\"https:\/\/www.ft.com\/uk-riots\"><span class=\"s2\">recent riots in the UK<\/span><\/a>.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">While the DSA is little more than a blatant censorship campaign, the EU\u2019s attempt is to <a href=\"https:\/\/thehill.com\/opinion\/technology\/3468836-a-new-eu-law-will-influence-us-free-speech-more-than-elon-musk\/\"><span class=\"s2\">rein in big tech<\/span><\/a> firms as it enforces European values regarding free expression, corporate responsibility and fostering a pluralistic society. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Referred to as the \u201c<a href=\"https:\/\/edri.org\/our-work\/eu-attempt-to-regulate-big-tech\/\"><span class=\"s2\">new constitution for the internet<\/span><\/a>\u201d suggests a rulebook for platforms to handle material that has been deemed illegal, yet fails to define what the DSA calls illegal or harmful content as well as dis or misinformation.<span class=\"Apple-converted-space\">\u00a0 <\/span>The DSA requires independent audits to assure compliance as the EU hires 200 employees to enforce the law. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As the war in Ukraine began in 2022, European policymakers felt a sense of urgency to move the legislation forward to ensure that major tech platforms protected against the spread of \u2018illegal\u2019 content, were transparent and properly regulated; thereby attempting to block the Russians from informing the public about the conduct of the war.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Across the pond, the US cabal is laboring to destroy America\u2019s Constitutional Republic via multiple effort; not the least of which is the struggle to neuter the First Amendment. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It is expected that some US big tech firms may already be in compliance with the DSA in removing \u2018<i>extremist<\/i>\u2019 content even without being confronted given its need to conform while sanctity of the First Amendment still blocks a wholesale auction on free speech. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As a harbinger of what is to come within the US, the EU took the liberty of <a href=\"https:\/\/www.techdirt.com\/2023\/01\/06\/if-you-dont-want-eu-style-censorship-to-take-over-the-internet-support-section-230\/\"><span class=\"s2\">setting up an office<\/span><\/a> in Silicon Valley in order to liaison on the DSA despite its clear danger to free internet speech even as the Europeans had earlier insisted they would <a href=\"https:\/\/www.techdirt.com\/tag\/dsa\/\"><span class=\"s2\">never support<\/span><\/a> censorship of content.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On this side of the pond, there is a new era aborning as <a href=\"https:\/\/reason.com\/2024\/04\/30\/should-free-speech-pessimists-look-to-europe\/\"><span class=\"s2\">establishment elite media<\/span><\/a> like the NY Times dramatic 2019 op ed entitled \u201c<i>Free Speech is Killing US<\/i>\u201d accusing even the First Amendment of \u2018<i>eroding our democracy<\/i>\u201d which claims \u2018disinformation\u2019 or hate speech a result of unmonitored free speech.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/01\/29\/us-could-learn-europes-online-speech-rules\/\"><span class=\"s2\">Washington Post<\/span><\/a>, no longer the heyday of independent journalism, suggested that \u201c<i>The US could Learn from EU\u2019s Speech Rules<\/i>\u201d which also dismissed the First Amendment.<span class=\"Apple-converted-space\">\u00a0 <\/span>In a recent article in a liberal political news publication which reviewed the EU\u2019s charges against X, <a href=\"https:\/\/www.politico.eu\/article\/eu-charges-musks-x-for-letting-disinfo-run-wild\/\"><span class=\"s2\">Politico<\/span><\/a> never once mentioned the First Amendment.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In 2022, Musk bought what was then called Twitter, renamed it to X and promised to open dialogue in the name of free speech which has, to a large extent, been successful as it presented otherwise previous limited articles to a wider audience.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The current Breton letter is not the DSA\u2019s first foray in the US as X was targeted by the EU in 2023.<span class=\"Apple-converted-space\">\u00a0 <\/span>The EU opened official proceedings based on suspected infringement of \u2018<i>breaching its obligations on transparency\u2019<\/i> and failure to respect the<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Digital_Services_Act\"><span class=\"s2\">Digital Services Act<\/span><\/a><\/span><span class=\"s2\">.<\/span><span class=\"s3\"> <span class=\"Apple-converted-space\">\u00a0 <\/span><\/span><span class=\"s1\">X has been<\/span><span class=\"s4\"><span class=\"Apple-converted-space\">\u00a0<\/span><\/span><span class=\"s1\"> <a href=\"https:\/\/www.politico.eu\/article\/eu-charges-musks-x-for-letting-disinfo-run-wild\/\"><span class=\"s2\">formally charged X<\/span><\/a> with a possible multi million euro fine as the DSA will investigate <a href=\"https:\/\/mail.google.com\/mail\/u\/0\/#inbox\"><span class=\"s2\">X\u2019s systems and policies<\/span><\/a> including the possible spread of terrorist and violent content linked to the October 7<\/span><span class=\"s5\"><sup>th<\/sup><\/span><span class=\"s1\"> Hamas attack in Israel.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">A very loose array of penalties and compliance requirements spells out a complex <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/dsa-enforcement\"><span class=\"s2\">DSA Enforcement<\/span><\/a> process of comprehensive investigative, imposition of non-compliance penalties and sanction powers that enables any national authority or the European Commission to implement non compliance or infringement charges without identifying any specific legal framework <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In a confusing array of penalties, fines fluctuate up to 6% of global turnover or periodic penalties of up to 5% of average daily worldwide turnover or fines of up to 1% worldwide annual turnover,<span class=\"Apple-converted-space\">\u00a0 <\/span>some of which may be appealed before EU courts.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As the unraveling of civil society in the UK was exacerbated by race riots, claiming social media misinformation and \u201cillegal\u201d content were cited as causes for an acceleration of<span class=\"Apple-converted-space\">\u00a0 <\/span>violence between its native born citizens at 75% of the population (down from 88% in 2001) and its 2.5 million immigrants population, more than 80% from non-European countries. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">UK\u2019s Prime Minister Keir Starmar defined the source of violence as \u2018<i>far right thuggery\u2019<\/i> in contrast to what Nigel Farage referred to a \u2018<i>mass, uncontrolled immigration<\/i>.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Americans watch in alarmed anticipation as the US braces for its own impending civil unrest.<span class=\"Apple-converted-space\">\u00a0 <\/span>There is an element of suspense as social media may be blamed for reporting false narratives and anti-immigrant sentiment on violence related to illegals who have crossed the southern border, as they merge into the American population and may surface as foreign agents of wanton violence.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In 2023, the European Commission identified nineteen on line platforms with more than 45 million active users that would be required to comply with its restrictions including the largest and most influential US sites:<span class=\"Apple-converted-space\">\u00a0 <\/span>Apple, Amazon, Bing, Facebook, Google, Instagram, LinkedIn, YouTube and its favorite current target X (formerly Twitter).<span class=\"Apple-converted-space\">\u00a0 <\/span>\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As civil unrest continues, it becomes obvious that claims of disinformation, hate speech and \u2018illegal\u2019 verbiage becomes a convenient measure to test every digital platform to determine whether they will respond in compliance with the EU or whether other platforms besides X will be accosted. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The real lesson in Breton\u2019s letter to Musk is that social media platforms that do not conform to the DSA, like X, can expect to experience continued institutional harassment and on going provocation until they achieve satisfactory conformance to all of its requirements. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">What largely escapes public notice is the DSA\u2019s dual purpose since it<span class=\"Apple-converted-space\">\u00a0 <\/span>has the ability to ultimately diminish the level of advertising revenue necessary for continued functions, to sufficiently disrupt operation and production creating an unsustainable level of fiscal instability as the platform weakens and loses its contributors and accounts and ability to represent the public\u2019s interest in free speech.<span
