The Fulton County Sheriff, a Republican former district attorney and former county judge<\/a> in the Empire State, said that his deputies will not be enforcing Gov. Andrew Cuomo\u2019s<\/strong> (D) executive order aimed at limiting the size of Thanksgiving gatherings in the homes of citizens to 10. Sheriff Richard Giardino<\/strong> said that the Cuomo order is unconstitutional.<\/p>\nLast week, Gov. Cuomo said on Twitter that New York State would be limiting indoor gatherings at private residences in order to prevent a COVID-19 explosion.<\/p>\n<\/iframe><\/div>\n<p class=\"o-no-text\">\n<p>\u201cNew York follows the science. We know indoor gatherings and parties are a major source of COVID spread,\u201d Gov. Cuomo. \u201cTo slow the spread, NYS will limit indoor gatherings at private residences to 10 people. This limit takes effect Friday at 10pm.\u201d<\/p>\n<p>The move followed another controversial state initiative, requiring students at state colleges to<a href=\"https:\/\/lawandcrime.com\/covid-19-pandemic\/new-york-colleges-forcing-students-to-test-negative-for-covid-19-before-going-home-for-the-holidays-is-it-legal\/\"> test negative for coronavirus<\/a> before going home for the holidays.<\/p>\n<p>Giardino and <a href=\"https:\/\/www.businessinsider.com\/nyc-councilman-says-hell-defy-gov-cuomos-social-distancing-orders-2020-11\">other Republican officials in the state<\/a> have said that Cuomo is clearly overstepping and abusing his authority. The sheriff said his deputies won\u2019t be going house to house to make sure that citizens aren\u2019t celebrating Thanksgiving.<\/p>\n<p>\u201cPeople have enough anxiety in their life without thinking that the police are going to come to their door and check on how many people are there,\u201d Giardino said, <a href=\"https:\/\/www.timesunion.com\/news\/article\/Fulton-County-sheriff-pushes-back-against-Cuomo-15729063.php\">according to the <em>Times Union<\/em>.<\/a> \u201cBut they hear it on TV and think if they add in grandma, they are going to be arrested.\u201d<\/p>\n<p>The former judge predicted that if he actually did enforce Cuomo\u2019s order (which he said is unenforceable because there is no penalty attached to the violation thereof) Fulton County would be hit by an endless parade of \u201cfrivolous lawsuits.\u201d <a href=\"https:\/\/www.nytimes.com\/2020\/11\/15\/us\/coronavirus-us-cases-deaths.html\">Although the COVID-19 pandemic is worsening<\/a> and although <a href=\"https:\/\/www.cdc.gov\/infectioncontrol\/basics\/transmission-based-precautions.html\">precautionary measures<\/a> like mask-wearing are highly politicized, Giardino said that he has faith in people\u2019s \u201ccommon sense.\u201d<\/p>\n<p>\u201cThey are not going to jeopardize family members. They are not going to jeopardize close friends. Most people respect the masks,\u201d he said. \u201cBasically, as a lawyer, former DA and judge, if I got brought into court, I can\u2019t justify it constitutionally.
