It\u2019s more illustrative of the Supreme Court than anything else,&#8221; said Cuomo (via the\u00a0<a href=\"https:\/\/nypost.com\/2020\/11\/26\/gov-cuomo-supreme-court-church-ruling-irrelevant-despite-decision\/\"><em>NY Post<\/em><\/a>), while knocking the Supreme Court&#8217;s (arguably) conservative bias given the addition of Justice Amy Coney Barrett.<\/p>\n<div class=\"ad__wrapper-element\"><\/div>\n<p>&#8220;<strong>It\u2019s irrelevant of any practical impact because of the zone they were talking about is moot. It expired last week<\/strong>,&#8221; he added. &#8220;It doesn\u2019t have any practical effect.&#8221;<\/p>\n<p>&#8220;The lawsuit was about the Brooklyn zone. The Brooklyn zone no longer exists as a red zone. That\u2019s muted. So that restriction is no longer in effect. Most patients recover, but a small percentage die.<\/p>\n<p>The plaintiffs were likely to prevail on First Amendment ground, the court ruled.<\/p>\n<p>Justice Neil Gorsuch,\u00a0a Donald Trump appointee, wrote a separate opinion siding with the conservative majority, saying churches and synagogues were treated differently than commercial institutions by the state.<\/p>\n<blockquote><p><em><strong>\u201cIt is time \u2014 past time \u2014 to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues, and mosques,\u201d<\/strong><\/em>\u00a0Gorsuch argued.<\/p><\/blockquote>\n<p>Justice Brett Kavanaugh, a Trump appointee, also concurred, noting that temporary injunctions were warranted but that the Nov. 25 decisions were not final.<\/p>\n<p><strong>Trump appointee Amy Coney Barrett and George W. (Angela Weiss\/AFP via Getty Images)<\/em><\/p>\n<p>Bush appointee John Roberts, the court\u2019s chief justice, said in a dissenting opinion that \u201cthere is simply no need\u201d to grant injunctive relief.<\/p>\n<blockquote><p>\u201c<strong>Numerical capacity limits of 10 and 25 people, depending on the applicable zone, do seem unduly restrictive.<\/strong>\u00a0And it may well be that such restrictions violate the Free Exercise Clause.<\/p>\n<p><strong>It is not necessary, however, for us to rule on that serious and difficult question at this time<\/strong>,\u201d he alleged.<\/p><\/blockquote>\n<p><strong>Barack Obama appointees Sonia Sotomayor and Elena Kagan joined with Bill Clinton appointee Stephen Breyer in a separate dissenting opinion.<\/strong><\/p>\n<p>Breyer wrote that he also believed there is not a need to issue injunctive relief because the parts of Brooklyn and Queens where the\u00a0Diocese\u2019s churches and the two applicant synagogues are located are no longer within red or orange zones. Cuomo, whose office didn\u2019t respond to a request for comment, had made that argument last week in a court filing.<\/p>\n<blockquote><p>\u201cThe applicants point out that the State might reimpose the red or orange zone restrictions in the future. But, were that to occur, they could refile their applications here, by letter brief if necessary. And this Court, if necessary, could then decide the matter in a day or two, perhaps even in a few hours,\u201d Breyer wrote.<\/p>\n<p>\u201cWhy should this Court act now without argument or full consideration in the ordinary course (and prior to the Court of Appeals\u2019 consideration of the matter) when there is no legal or practical need for it to do so?
