Then<a href=\"https:\/\/www.ajc.com\/news\/atlanta-news\/fulton-election-results-delayed-after-pipe-bursts-in-room-with-ballots\/4T3KPQV7PBEX3JVAIGJBNBSVJY\/\">\u00a0a water pipe broke<\/a>\u00a0in the arena where the Fulton County, Georgia election results were being tallied, prompting a delay in the counting of mail-in ballots. In Philadelphia, Pennsylvania,<a href=\"https:\/\/nypost.com\/2020\/11\/03\/philadelphia-stops-counting-mail-in-ballots-for-the-night\/\">\u00a0election officials stopped counting<\/a>\u00a0mail-in ballots at 9.30pm on election night, resuming the tally at 9.00am the next morning. In Detroit,<a href=\"https:\/\/www.reuters.com\/article\/us-usa-election-michigan-idUSKBN27K2AQ\">\u00a0poll watchers were locked out<\/a>\u00a0of the vote counting room, raising concerns about transparency as election officials processed tens of thousands of mail-in ballots.<\/p>\n<p>By the morning of November 5, with the counting still underway, President Trump<a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1324353932022480896\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0tweeted out<\/a><em>\u201cSTOP THE COUNT!\u201d, followed soon by<a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1324368202139357186\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0a second tweet<\/a>: \u201cANY VOTE THAT CAME IN AFTER ELECTION DAY WILL NOT BE COUNTED!\u201d<\/em><\/p>\n<div class=\"rtcode\">\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-0\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?creatorScreenName=RT_com&amp;dnt=false&amp;embedId=twitter-widget-0&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1324353932022480896&amp;lang=en&amp;origin=https%3A%2F%2Fwww.rt.com%2Fop-ed%2F508738-us-election-stolen-democracy%2F&amp;siteScreenName=RT_com&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1324353932022480896\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<div class=\"rtcode\">\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-1\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?creatorScreenName=RT_com&amp;dnt=false&amp;embedId=twitter-widget-1&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1324368202139357186&amp;lang=en&amp;origin=https%3A%2F%2Fwww.rt.com%2Fop-ed%2F508738-us-election-stolen-democracy%2F&amp;siteScreenName=RT_com&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1324368202139357186\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<p>The interesting thing about this second tweet is that it was blocked from immediate viewing by Twitter staff, who posted their own message, noting that\u00a0<em>\u201cSome or all of the content shared in this tweet is disputed and might be misleading about an election or other civic process.\u201d<\/em>\u00a0Anyone who wanted to read Trump\u2019s tweet had to click a link, which displayed the tweet along with a warning:\u00a0<em>\u201cSome votes may still need to be counted.\u201d<\/em><\/p>\n<p>Both links led the reader to<a href=\"https:\/\/help.twitter.com\/en\/rules-and-policies\/election-integrity-policy\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0a page outlining\u00a0<\/a>Twitter\u2019s &#8216;Civic Integrity Policy,&#8217; which declared that one\u00a0<em>\u201cmay not use Twitter\u2019s services for the purpose of manipulating or interfering in elections or other civic processes. This includes posting or sharing content that may suppress participation or mislead people about when, where, or how to participate in a civic process. In addition, we may label and reduce the visibility of tweets containing false or misleading information about civic processes in order to provide additional context.\u201d<\/em><\/p>\n<p>Later that day, Trump gave a televised address,<a href=\"https:\/\/www.news.com.au\/world\/north-america\/us-politics\/donald-trump-addresses-us-election-results-if-you-count-legal-votes-i-easily-win\/news-story\/70336b9aeaeb3d06aa586b84756e5650\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0in which he noted<\/a>,\u00a0<em>\u201cI have been talking about this for many months with all of you. I have said very strongly that mail-in ballots are going to be a disaster.\u201d<\/em>\u00a0Trump went on to declare that\u00a0<em>\u201cif you count the legal votes, I easily win. If you count the illegal votes, they can try to steal the election from us.\u201d<\/em><\/p>\n<p>At this point, many television broadcast networks cut away from the president\u2019s speech, with one host, MSNBC\u2019s Brian Williams, saying the press conference\u00a0<em>\u201cwas not rooted in reality, and, at this point, where our country is, it\u2019s dangerous.\u201d<\/em><\/p>\n<p>Over the course of the next month,<a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/twitter-has-flagged-200-of-trump-s-posts-as-disputed-or-misleading-since-election-day-does-it-make-a-difference\/ar-BB1bqjGe\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0Twitter flagged<\/a>\u00a0hundreds of President Trump\u2019s tweets as\u00a0<em>\u201cmisleading,\u201d<\/em>\u00a0taking issue with his claims of electoral fraud. Trump lashed out at Twitter via a series of tweets,<a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1333965375193624578\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0declaring<\/a>:\u00a0<em>\u201cSection 230, which is a liability shielding gift from the U.S. to \u201cBig Tech\u201d (the only companies in America that have it \u2013 corporate welfare!), is a serious threat to our National Security &amp; Election Integrity. Our Country can never be safe &amp; secure if we allow it to stand.\u201d<\/em><\/p>\n<p>He<a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1333965375839621120\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0continued<\/a>:\u00a0<em>\u201cTherefore, if the very dangerous &amp; unfair Section 230 is not completely terminated as part of the National Defense Authorization Act (NDAA), I will be forced to unequivocally VETO the Bill when sent to the very beautiful Resolute desk. Take back America NOW. Thank you!\u201d<\/em><\/p>\n<div class=\"rtcode\">\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-2\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?creatorScreenName=RT_com&amp;dnt=false&amp;embedId=twitter-widget-2&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1333965375839621120&amp;lang=en&amp;origin=https%3A%2F%2Fwww.rt.com%2Fop-ed%2F508738-us-election-stolen-democracy%2F&amp;siteScreenName=RT_com&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1333965375839621120\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<p>On December 2, Congress<a href=\"https:\/\/sputniknews.com\/us\/202012021081340598-us-congress-settles-on-final-version-of-ndaa-without-termination-of-section-230-demanded-by-trump\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0called the president\u2019s bluff<\/a>, passing the NDAA without any reference to Section 230, thereby setting up a presidential veto that not only threatens US national security in terms of potentially delaying critical defense funding, but, more importantly, perpetuates the notion of electoral fraud that has irrevocably damaged the perception of American \u2018democracy\u2019 across the globe. In a world where perception creates its own reality, this outcome cannot be taken lightly.<\/p>\n<p>For most Americans, Section 230 of the Communications Decency Act of 1996 does not readily resonate as one of the most fundamental influences of their modern social-media-intensive lives. Section 230 provides immunity to social media companies against being sued for content posted on their sites, creating a legal framework that prevents these companies from being defined as a publisher and thus liable for defamation. While the US Supreme Court eventually struck down most of the Act as an unconstitutional restriction of free speech, Section 230 remained.<\/p>\n<p>Then came 2016, and allegations from Hillary Clinton, the Democratic Party, and the administration of Barack Obama that Russia used social media to post disinformation in an effort to tilt the election in favor of Donald Trump. The likes of Facebook and Twitter were suddenly placed on the proverbial Congressional hot seat, having to respond to accusations that the hands-free approach to monitoring content posted on their platforms had facilitated what was being described by those who lost the 2016 election as an assault against American democracy.<\/p>\n<p>Faced with the real threat of a Congressional backlash, both Facebook and Twitter undertook to weed out what they called\u00a0<em>&#8220;political disinformation&#8221;<\/em>\u00a0from their platforms. While much of their early effort seemed focused on purging \u2018bots\u2019 (that is, fake accounts) allegedly controlled by outside actors such as Russia and Iran, the controversy over Section 230 again raised its head when, in October 2019, the CEO of Twitter, Jack Dorsey,<a href=\"https:\/\/www.nytimes.com\/2019\/10\/30\/technology\/twitter-political-ads-ban.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0announced he was banning all political ads<\/a>\u00a0from his service. According to Dorsey, these ads had\u00a0<em>\u201csignificant ramifications that today\u2019s democratic infrastructure may not be prepared to handle.\u201d<\/em><\/p>\n<p>Dorsey\u2019s decision was immediately praised by the Democrats, who were still operating under a working assumption that Russia was trying to repeat its success of 2016 by helping Trump get re-elected in 2020, and would once again seek to use these platforms as an echo chamber of misinformation to damage Democratic political interests. The Republicans, not surprisingly, viewed Dorsey\u2019s actions as an act of political censorship that represented little more than a partisan act intended to silence conservatives.<\/p>\n<p>Then, on May 26, 2020, came<a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1265255835124539392\">\u00a0the tweet<\/a>\u00a0from America\u2019s tweeter-in-chief that changed the entire landscape of the Section 230 debate.\u00a0<em>\u201cThere is NO WAY (ZERO!) that Mail-In Ballots will be anything less than substantially fraudulent,\u201d<\/em>\u00a0Trump tweeted.\u00a0<em>\u201cThis will be a Rigged Election. No way!\u201d<\/em><\/p>\n<p>Twitter responded,\u00a0<a href=\"https:\/\/twitter.com\/TwitterSafety\/status\/1265838823663075341\" target=\"_blank\" rel=\"noopener noreferrer\">posting<\/a>:\u00a0<em>\u201cWe added a label to two @realDonaldTrump Tweets about California\u2019s vote-by-mail plans as part of our efforts to enforce our civic integrity policy. We believe those Tweets could confuse voters about what they need to do to receive a ballot and participate in the election process. We also wanted to provide additional context and conversation with regard to voter fraud and mail-in ballots. We have a range of remediations, and in some cases, we add labels that link to more context.&#8221;<\/em><\/p>\n<div class=\"rtcode\">\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-3\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?creatorScreenName=RT_com&amp;dnt=false&amp;embedId=twitter-widget-3&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1265255845358645254&amp;lang=en&amp;origin=https%3A%2F%2Fwww.rt.com%2Fop-ed%2F508738-us-election-stolen-democracy%2F&amp;siteScreenName=RT_com&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1265255845358645254\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<div class=\"rtcode\">\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-4\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?creatorScreenName=RT_com&amp;dnt=false&amp;embedId=twitter-widget-4&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1265838824451694597&amp;lang=en&amp;origin=https%3A%2F%2Fwww.rt.com%2Fop-ed%2F508738-us-election-stolen-democracy%2F&amp;siteScreenName=RT_com&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1265838824451694597\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<p>The Twitter label\u00a0<em>\u201cGet the facts about mail-in ballots\u201d<\/em>\u00a0contained<a href=\"https:\/\/twitter.com\/i\/events\/1265330601034256384\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0a link that took the reader to a news story<\/a>\u00a0that noted, among other things, that Trump\u2019s claims were\u00a0<em>\u201cunsubstantiated, according to CNN, Washington Post and others. Experts say mail-in ballots are very rarely linked to voter fraud.\u201d<\/em><\/p>\n<p>Twitter would have done well to avoid consulting either<a href=\"https:\/\/zpatriot.com\/2020\/12\/02\/secret-recordings-show-cnns-anti-trump-bias-comes-from-top\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0CNN<\/a>\u00a0or the<a href=\"https:\/\/www.investors.com\/politics\/commentary\/the-washington-post-takes-anti-trump-bias-to-a-new-level\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0Washington Post<\/a>, both of which have a history of blatant anti-Trump bias when it comes to their political reporting, and, instead, to have relied on the conclusions of<a href=\"https:\/\/www.foxnews.com\/projects\/pdf\/election_reform_report.pdf\">\u00a0the bipartisan September 2005 Report of the Commission on Federal Election Reform<\/a>, \u2018Building Confidence in US Elections\u2019, co-chaired by former Democratic President Jimmy Carter and former Republican Secretary of State James Baker. On page 46 of that report, under the heading\u00a0<em>\u201cAbsentee Ballot and Voter Registration Fraud\u201d<\/em>, the authors note that\u00a0<em>\u201cabsentee ballots remain the largest source of potential voter fraud.\u201d<\/em>\u00a0 The report cites a 1998 case in which the result of the City of Miami mayoral race was reversed and a new election ordered because of absentee-voter fraud.\u00a0<em>\u201cAbsentee balloting,\u201d<\/em>\u00a0the report observed,\u00a0<em>\u201cis vulnerable to abuse in several ways,\u201d concluding that \u201cvote buying schemes are far more difficult to detect when citizens vote by mail.\u201d<\/em><\/p>\n<p>Two days after Twitter\u2019s editorial intervention, Trump signed<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/executive-order-preventing-online-censorship\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0an executive order<\/a>\u00a0that, among other things, declared<em>\u00a0\u201cit is the policy of the United States that the scope of that immunity [afforded by Section 230] should be clarified: the immunity should not extend beyond its text and purpose to provide protection for those who purport to provide users a forum for free and open speech, but, in reality, use their power over a vital means of communication to engage in deceptive or pretextual actions, stifling free and open debate by censoring certain viewpoints.\u201d<\/em><\/p>\n<p>Trump\u2019s executive order was little more than an act of political theater. Even the president recognized that, void of Congressional action terminating Section 230, his order would most likely not survive a legal challenge in the courts.<\/p>\n<p>The president made the issue of mail-in voting and what he believed to be its potential for widespread fraud a centerpiece of his campaign during the summer of 2020. In August, in an<a href=\"https:\/\/www.newsmax.com\/newsfront\/trump-mail-in-ballots\/2020\/08\/12\/id\/981762\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0interview with Fox News\u2019s Sean Hannity<\/a>, he declared that mail-in voting in the November election would result in\u00a0<em>\u201ccatastrophic corruption\u201d,<\/em>\u00a0and noted that\u00a0<em>\u201cthis whole thing with this mail-in ballot, that\u2019s a rigged election waiting to happen. It\u2019s rigged and everyone knows it.\u201d<\/em><\/p>\n<p>Trump\u2019s concerns over the possibility of mail-in voter fraud served as the foundation for his post-election claims of a\u00a0<em>\u201cstolen election\u201d<\/em>\u00a0and his ongoing battle with Twitter and Congress over Section 230. The fact is that, as things currently stand, there has been no cognizable case presented to any court anywhere by the Trump legal team that proves electoral fraud in the 2020 election.
