Who knew that Pfizer was hit with the largest corporate criminal fine in U.S. history?"},"content":{"rendered":"<h1>Pfizer Hit with Largest Criminal Fine in US History<\/h1>\n<p><!--more-->Caleb Groos<br \/>\nFindLaw Legal Blogs<\/p>\n<div class=\"article-image-large to-center\"><a href=\"https:\/\/www.sott.net\/image\/s29\/593513\/full\/BlotterPlaceholder2.jpg\" target=\"_blank\" rel=\"ibox&amp;ignore_target=true noopener noreferrer\"><img decoding=\"async\" title=\"Click to enlarge\" src=\"https:\/\/www.sott.net\/image\/s29\/593513\/large\/BlotterPlaceholder2.jpg\" alt=\"Prison\" border=\"0\" \/><\/a><\/div>\n<p><strong>Drug maker Pfizer, Inc. and one of its subsidiaries have agreed to pay $2.3 billion dollars to settle civil and criminal charges regarding its marketing of the drug Bextra.<\/strong>\u00a0The criminal portion of the fine is the\u00a0<strong>largest fine ever levied by the United States government for any matter.<\/strong>\u00a0As part of the settlement,\u00a0<strong>Pfizer pled guilty to felony violation of the Food, Drug and Cosmetic Act for marketing the drug with the intent to deceive and mislead the public.<\/strong><\/p>\n<p>Unfortunately, these records don&#8217;t seem to last long &#8212;\u00a0<a title=\"https:\/\/blogs.findlaw.com\/common_law\/\" href=\"https:\/\/blogs.findlaw.com\/common_law\/\" target=\"_blank\" rel=\"noopener noreferrer\">Eli Lilly set the previous record with its illegal Viva Zyprexa campaign<\/a>\u00a0just last January.<\/p>\n<p>Like the Zyprexa case, the criminal charges against Pfiser come from\u00a0<strong>&#8220;off-label&#8221; marketing of a drug &#8212; this time Bextra, an anti-inflammatory which Pfizer yanked from the shelves in 2005<\/strong>.\u00a0<a title=\"https:\/\/www.usdoj.gov\/opa\/pr\/2009\/September\/09-aag-900.html\" href=\"https:\/\/www.usdoj.gov\/opa\/pr\/2009\/September\/09-aag-900.html\" target=\"_blank\" rel=\"noopener noreferrer\">According to the Department of Justice<\/a>\u00a0(DOJ), Pfizer marketed the drug for a variety of uses which the Food and Drug Administration (FDA) specifically refused to approve due to safety concerns. See FindLaw&#8217;s Common Law, for\u00a0<a title=\"https:\/\/blogs.findlaw.com\/common_law\/\" href=\"https:\/\/blogs.findlaw.com\/common_law\/\" target=\"_blank\" rel=\"noopener noreferrer\">basics regarding FDA drug approval and subsequent marketing<\/a>.<\/p>\n<p>The criminal fine against Pfizer is $1.195 billion, with another $105 million to be paid by its subsidiary Pharmacia &amp; Upjohn Company Inc. Whistleblower suits filed in Massachusetts, Pennsylvania and Kentucky triggered the federal investigation.<\/p>\n<p>According to the DOJ, the size of Pfizer&#8217;s fine came in part because of the company&#8217;s duplicitous dealings with federal prosecutors. As one US attorney put it:<\/p>\n<blockquote><p>&#8220;Pfizer violated the law over an extensive time period.
