Slates<\/h1>\n<p><!--more--><\/p>\n<h3>The lawsuit before the Supreme Court seeks to direct the Vice President to refuse to include the Electoral votes from five states until those state legislatures can certify their votes<\/h3>\n<p>by FRANK SALVATO<br \/>\nNational File<\/p>\n<p>In one of the most potent lawsuits to reach the US Supreme Court, the Amistad Project has filed a lawsuit on a point of constitutional order that would force the President of the Senate \u2013 Vice President Mike Pence \u2013 to remand the Electoral College votes of five states to their respective legislatures for certification.<\/p>\n<p>The Thomas More Society\u2019s Amistad Project filed a lawsuit on December 22, 2020, claiming that a several federal and state laws, some enacted under the guise of COVID protection, had unconstitutionally and illegally delegated the authority of the various state legislatures to certify Electoral College votes to state executive branches.<\/p>\n<div class=\"code-block code-block-9\">\n<p><ins class=\"adsbygoogle\" data-ad-client=\"ca-pub-7736901076965574\" data-ad-slot=\"9354669129\" data-ad-format=\"auto\" data-full-width-responsive=\"true\" data-adsbygoogle-status=\"done\"><ins id=\"aswift_0_expand\" tabindex=\"0\" title=\"Advertisement\" aria-label=\"Advertisement\"><ins id=\"aswift_0_anchor\"><\/ins><\/ins><\/ins>The Amistad Project is arguing that the state legislatures of <a href=\"https:\/\/nationalfile.com\/electoral-college-pennsylvania-michigan-legislatures-open-door-for-congress-to-challenge-electors\/\" target=\"_blank\" rel=\"noopener noreferrer\">Pennsylvania, Michigan<\/a>, Wisconsin, Georgia, and Arizona \u2013 by virtue of this unconstitutional transfer of power, were prohibited from exercising their rightful power under the US Constitution to certify the presidential Electors\u2019 votes cast on December 14, 2020, in their respective states.<\/p>\n<p>Under <a href=\"https:\/\/www.archives.gov\/founding-docs\/constitution-transcript#toc-article-ii-\" target=\"_blank\" rel=\"noopener noreferrer\">Article II<\/a> of the US Constitution, presidential Electors must be appointed by each state in the manner prescribed by the state\u2019s legislature:<\/p>\n<div class=\"jeg_ad jeg_ad_article jnews_content_inline_ads \">\n<div class=\"ads-wrapper align-center \">\n<div class=\"ads_code\">\n<blockquote><p><em>\u201cEach State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and state legislatures from delegating their power to state executive branch officials in any capacity as there is no authority granted to delegate the power.<\/p>\n<p>\u201cThere are textual and structural arguments for these state statutes being unconstitutional,\u201d the lawsuit reads, adding that the offending state laws are an \u201cunconstitutional delegation of the state legislative prerogatives of post-election certifications of Presidential votes and of Presidential electors.\u201d<\/p>\n<p>The lawsuit also contends that some of the state legislatures in question, many of which are adjourned until January 2021, are being deliberately prevented from meeting \u2013 for partisan political purposes \u2013 to perform their post-election certification duty per the US constitutional stricture \u2013 so that the legislatures can legally perform their constitutional mandates.<\/p>\n<p>\u201cThe very body that is responsible for how these electors are selected, can\u2019t even meet after the election, up through January. So that\u2019s unconstitutional, in that it\u2019s a delegation of authority to a governor of a legislative function. That is not allowed,\u201d Phil Kline, director of the Amistad Project, told reporters.<\/p>\n<div class=\"code-block code-block-7\">\n<p><ins class=\"adsbygoogle\" Project seeks from the US Supreme Court is for the High Court to declare sections of the federal and state laws that empower the several state executives with post-election certification authority as unconstitutional.<\/p>\n<p>The lawsuit also seeks to <a href=\"https:\/\/nationalfile.com\/law-prohibits-pence-from-accepting-electoral-votes-from-fraudulently-certified-states-constitutional-lawyer\/\" target=\"_blank\" rel=\"noopener noreferrer\">prevent Vice President Mike Pence<\/a>, who will be presiding over the counting the Electoral College votes, and Congress from including the votes from Arizona, Georgia, Michigan, Pennsylvania, and Wisconsin until their individual state legislatures are able to meet and \u2013 independent of their states\u2019 executive branches \u2013 certify the votes.<\/p>\n<p>A call from National File reporters to
