Andrew Cuomo\u2019s<\/a>\u00a0alleged undercounting of nursing-home deaths amid the\u00a0<a href=\"https:\/\/www.foxnews.com\/category\/health\/infectious-disease\/coronavirus\">COVID-19 pandemic<\/a>\u00a0may rise to the level of a\u00a0<a href=\"https:\/\/www.foxnews.com\/category\/us\/crime\">criminal<\/a>\u00a0offense.<\/p>\n<p class=\"speakable\">Cuomo has found himself at the center of a federal investigation into whether his administration sought to hide the true toll of the pandemic.<\/p>\n<p>The New York Post\u00a0<a href=\"https:\/\/nypost.com\/2021\/02\/11\/cuomo-aide-admits-they-hid-nursing-home-data-from-feds\/\" target=\"_blank\" rel=\"noopener\">reported earlier this month<\/a> that Melissa DeRosa, Cuomo\u2019s top aide, told lawmakers the administration\u00a0had withheld the numbers for fear of them being &#8220;used against us.&#8221;<\/p>\n<div class=\"image-ct inline\">\n<div class=\"m\"><picture><source srcset=\"https:\/\/a57.foxnews.com\/static.foxnews.com\/foxnews.com\/content\/uploads\/2021\/02\/1470\/828\/AP21051500670925.jpg?ve=1&amp;tl=1 2x\" media=\"(max-width: 767px)\" \/><source srcset=\"https:\/\/a57.foxnews.com\/static.foxnews.com\/foxnews.com\/content\/uploads\/2021\/02\/1862\/1048\/AP21051500670925.jpg?ve=1&amp;tl=1 2x\" media=\"(min-width: 767px)\" \/><\/picture><\/div>\n<\/div>\n<p>In an op-ed for the\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/why-cuomo-should-be-worried-about-a-federal-probe-11613945987\" target=\"_blank\" rel=\"noopener\">Wall Street Journal<\/a>, John B. Andrew Cuomo speaks during a news conference against a backdrop of medical supplies at the Jacob Javits Center that will house a temporary hospital in response to the COVID-19 outbreak in New York.\u00a0\u00a0(AP)<\/p><\/div>\n<p>&#8220;Even if it cannot be proved that the Cuomo administration knowingly provided false information to Justice and the (Centers for Medicare and Medicaid Services), New York\u2019s willful failure to provide information may itself constitute a criminal offense\u2014particularly if the intent was to thwart a federal investigation\u2014which, after all, is exactly what Ms. DeRosa reportedly said the administration did,&#8221; Daukas wrote.<\/p>\n<p>And on Saturday, Fox News legal analyst Gregg Jarrett said DeRosa\u2019s admission to lawmakers \u2013 if true \u2013 constitutes a\u00a0<a href=\"https:\/\/www.foxnews.com\/opinion\/cuomos-nursing-home-scandal-crimes-gregg-jarrett\">potential obstruction of justice charge<\/a>. Per the federal statute, Jarrett noted, if a government official falsifies or hides evidence to avoid triggering an investigation (or acts out of fear that such a probe may occur) that official is still culpable under the law of obstruction.&#8221;<\/p>\n<p>The nursing home scandal has dealt a harsh blow to the governor\u2019s high favorability. Early on in the pandemic, the governor went on television for daily briefings that were paternal, almost philosophical, and also sharply critical of the\u00a0<a href=\"https:\/\/www.foxnews.com\/category\/person\/donald-trump\">Trump administration<\/a>. They became must-see TV across the country, aided in part by his\u00a0<a href=\"https:\/\/www.foxnews.com\/media\/cnns-chris-cuomo-mocked-tweeting-resignation-texas-mayor-brother\">CNN news host brother<\/a>.<\/p>\n<p>Despite his state&#8217;s death toll \u2014 more than 46,000 people in New York state have died of COVID-19, according to\u00a0<a href=\"https:\/\/www.foxnews.com\/category\/us\/education\/college\">Johns Hopkins University<\/a> \u2014 Cuomo&#8217;s popularity soared. In October, Cuomo took an early victory lap, releasing a book titled &#8220;American Crisis: Leadership Lessons from the COVID-19 Pandemic.&#8221;<\/p>\n<p>But the nursing home issue exploded onto the political scene with two recent revelations. First, the state&#8217;s Democratic attorney general chastised the Cuomo administration for minimizing the death toll at nursing homes by excluding certain fatalities from the count.
