Chief Justice John Roberts and fellow conservative Justices Clarence Thomas, Brett Kavanaugh and Amy Coney Barrett joined Justice Stephen Breyer\u2019s opinion, as did Sonia Sotomayor and Elena Kagan.<\/p>\n<p>Breyer said Texas and the other states that challenged the law failed to show they were harmed by it.<\/p>\n<p>\u201cNeither the individual nor the state plaintiffs have shown that the injury they will suffer or have suffered is \u2018fairly traceable\u2019 to the \u2018allegedly unlawful conduct\u2019 of which they complain,\u201d Breyer wrote.<\/p>\n<p>The decision marks the third time that Obamacare, officially known as the Affordable Care Act, has survived a challenge before the Supreme Court since former President Barack Obama signed the landmark legislation into law in 2010.<\/p>\n<p>Defenders of Obamacare worried that the Supreme Court \u2013 with its 6-3 majority of Republican-appointed justices \u2013 would scrap the law, a crucial element of the nation\u2019s health-care system.<\/p>\n<p>President\u00a0<a href=\"https:\/\/www.cnbc.com\/joe-biden\/\">Joe Biden<\/a>, who served as Obama\u2019s vice president when the law was signed, praised Thursday\u2019s ruling as a \u201cmajor victory\u201d for millions of Americans who were at risk of losing their health care in the midst of the Covid pandemic if the law was overturned.<\/p>\n<p>Biden also vowed to expand Obamacare, a central promise of his presidential campaign.<\/p>\n<p>\u201cAfter more than a decade of attacks on the Affordable Care Act through the Congress and the courts, today\u2019s decision \u2013 the third major challenge to the law that the U.S. Supreme Court has rejected \u2013 it is time move forward and keep building on this landmark law,\u201d Biden said in a statement.<\/p>\n<p>\u201cToday\u2019s decision affirms that the Affordable Care Act is stronger than ever, delivers for the American people, and gets us closer to fulfilling our moral obligation to ensure that, here in America, health care is a right and not a privilege,\u201d he said.<\/p>\n<p>Obama said the Supreme Court\u2019s ruling makes clear that the law will endure, and the principle of universal health-care coverage has been established.<\/p>\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-0\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/Tweet.html?creatorScreenName=tuckerhiggins&amp;dnt=false&amp;embedId=twitter-widget-0&amp;features=eyJ0ZndfZXhwZXJpbWVudHNfY29va2llX2V4cGlyYXRpb24iOnsiYnVja2V0IjoxMjA5NjAwLCJ2ZXJzaW9uIjpudWxsfSwidGZ3X2hvcml6b25fdHdlZXRfZW1iZWRfOTU1NSI6eyJidWNrZXQiOiJodGUiLCJ2ZXJzaW9uIjpudWxsfSwidGZ3X3R3ZWV0X2VtYmVkX2NsaWNrYWJpbGl0eV8xMjEwMiI6eyJidWNrZXQiOiJjb250cm9sIiwidmVyc2lvbiI6bnVsbH19&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1405578416095731712&amp;lang=en&amp;origin=https%3A%2F%2Fwww.cnbc.com%2F2021%2F06%2F17%2Fobamacare-survives-after-supreme-court-rejects-latest-republican-challenge.html&amp;sessionId=02865e4b1673459b3c1245583c6c69ecd122c3b8&amp;siteScreenName=CNBC&amp;theme=light&amp;widgetsVersion=82e1070%3A1619632193066&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1405578416095731712\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<p>&nbsp;<\/p>\n<p>Two of former President Donald Trump\u2019s Supreme Court picks, Kavanaugh and Barrett, joined the court\u2019s overwhelming majority in rejecting the latest Republican effort to overturn the law. Democrats had warned during Barrett\u2019s confirmation hearings that she was likely to cast a vote in the case that would jeopardize Obamacare.<\/p>\n<p>Justices Samuel Alito and Neil Gorsuch, both conservatives, dissented from the court\u2019s majority opinion.<\/p>\n<p>\u201cToday\u2019s decision is the third installment in our epic Affordable Care Act trilogy, and it follows the same pattern as installments one and two,\u201d Alito wrote in a dissent that was joined by Gorsuch. \u201cIn all three episodes, with the Affordable Care Act facing a serious threat, the Court has pulled off an improbable rescue.\u201d<\/p>\n<p>Trump tried unsuccessfully throughout his one term in office to overturn Obamacare. However, Congress as part of the 2017 tax bill effectively\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/12\/21\/upshot\/individual-health-insurance-mandate-end-impact.html\" target=\"_blank\" rel=\"noopener\">eliminated<\/a>\u00a0Obamacare\u2019s so-called individual mandate penalties by reducing them to $0.<\/p>\n<p>Texas and more than a dozen other Republican-led states then filed suit, arguing that that change to the law rendered it unconstitutional. The Supreme Court had previously upheld the mandate under Congress\u2019 power to tax, but the GOP-led states argued that the tax justification was no longer valid if the penalty was nonexistent.<\/p>\n<p>Those states, backed by Trump\u2019s Department of Justice, argued that the entire Affordable Care Act should be erased if the individual mandate provision was found to be unlawful.<\/p>\n<p>The case made its way through federal district court and the U.S. Court of Appeals for the Fifth Circuit, which agreed that the individual mandate was unconstitutional. But 20 Democrat-led states, led by California, asked the Supreme Court to reverse the appeals court\u2019s judgment, arguing that with the mandate reduced to zero Americans have the choice whether or not to buy insurance.<\/p>\n<p>The Supreme Court agreed in March 2020 to hear the case.<\/p>\n<p>A spokeswoman for Trump did not immediately respond to CNBC\u2019s request for comment on the court\u2019s ruling.<\/p>\n<p>Numerous Biden administration officials and the top Democrats in Congress were quick to celebrate the decision.<\/p>\n<p>\u201cEach time, in each arena, the Affordable Care Act has prevailed,\u201d Senate Majority Leader Chuck Schumer, D-N.Y., said on the Senate floor minutes after the ruling.<\/p>\n<p>\u201cLet me say definitively: The Affordable Care Act has won, the Supreme Court has ruled, the ACA is here to stay. And now, we\u2019re going to try to make it bigger and better,\u201d Schumer said.<\/p>\n<p>\u201cWhat a day,\u201d he added.<\/p>\n<p>House Speaker Nancy Pelosi, who was instrumental in the law\u2019s passage, hailed the ruling and praised Obamacare as a \u201cpillar of American health and economic security.\u201d<\/p>\n<p>\u201cToday\u2019s Supreme Court decision is a landmark victory for Democrats\u2019 work to defend protections for people with preexisting conditions,\u201d the California Democrat said during her weekly press conference.<\/p>\n<p>White House chief of staff Ron Klain tweeted \u201cIt\u2019s still a BFD\u201d \u2014 an apparent reference to Biden\u2019s infamous hot-mic comment at the signing of the bill in 2010, when he whispered to Obama, \u201cthis is a
