{"id":89009,"date":"2021-10-09T17:22:17","date_gmt":"2021-10-09T21:22:17","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=89009"},"modified":"2021-10-09T17:22:17","modified_gmt":"2021-10-09T21:22:17","slug":"virginia-judge-hands-victory-to-parents-sides-against-prosecutor-on-school-board-recall","status":"publish","type":"post","link":"http:\/\/stateofthenation.co\/?p=89009","title":{"rendered":"Virginia Judge Hands Victory To Parents, Sides Against Prosecutor On School Board Recall"},"content":{"rendered":"<p><!--more-->By Jack Phillips<br \/>\nThe Epoch Times<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-virginia\">Virginia<\/a>-based parent group attempting to oust five\u00a0Loudoun County School Board members was given a small win after a\u00a0Loudoun County Circuit Court judge ruled Tuesday in favor of the organization\u2019s recall petition against a board member who sought to dismiss it.<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/schoolboard.jpg?itok=U0zkMSGt\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/schoolboard.jpg?itok=U0zkMSGt\" data-link-option=\"0\"><picture><img loading=\"lazy\" decoding=\"async\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/schoolboard.jpg?itok=U0zkMSGt\" alt=\"\" width=\"500\" height=\"300\" data-entity-type=\"file\" data-entity-uuid=\"e1ce030b-c361-47b4-8eec-8e943c9d5d45\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p>On Tuesday,\u00a0<strong>a judge denied\u00a0Loudoun County school board member Beth Barts\u2019 motion to dismiss the case\u00a0<\/strong>and also removed\u00a0Loudoun County Commonwealth\u2019s Attorney\u00a0Buta Biberaj from the case.<\/p>\n<p>The group Fight For Schools and others have alleged that Barts was involved in a private Facebook group that violated the\u00a0School Board\u2019s Code of Conduct and other laws after members allegedly tried to attempt to\u00a0<a href=\"https:\/\/www.theepochtimes.com\/critical-race-theory-feud-on-full-display-at-school-board-meeting_3870079.html\">reveal private information<\/a>\u00a0about parents and opponents.<\/p>\n<p>Judge Jeanette Irby, meanwhile, ruled that\u00a0Biberaj should be removed from the case due to a public perception issue, arguing the public may not trust the prosecutor to be impartial.<\/p>\n<blockquote><p><em><strong>\u201cI have the utmost respect for Ms. Biberaj \u2026 however, if she continued on this case there would never be acceptance on this case,\u201d\u00a0<\/strong><\/em>Irby said, according to local media outlets.<\/p><\/blockquote>\n<p>An attorney for Citizens of Leesburg, another plaintiff in the case, cited a Twitter post made by\u00a0Biberaj in which she shared a letter to the editor published in\u00a0Loudoun Now that supported the district\u2019s diversity, equity, and inclusion work\u2014which is closely aligned with the quasi-Marxist critical race theory that\u2019s now at the center of many heated school board debates across the United States.<\/p>\n<p>Biberaj was also listed as a member of the same private Facebook group in which Barts had belonged\u2014Anti-Racist Parents of Loudoun\u2014where members were allegedly sought to reveal private information, or \u201cdoxx,\u201d parents and opponents of critical race theory.<\/p>\n<p>The Epoch Times has contacted the\u00a0Loudoun County Commonwealth\u2019s Attorney\u2019s office and the school district for comment.<\/p>\n<div class=\"Advert_tablet__3QEBr Advert_mobile__1rlLc Advert_placement__1I4yb Advert_align__N0_fw\"><\/div>\n<p>Ian Prior, who is involved in the charge to remove Barts from the school board, said he is pleased with the judge\u2019s decision on Tuesday.<\/p>\n<blockquote><p>\u201cWe are ecstatic,\u201d Prior told\u00a0<a href=\"https:\/\/wjla.com\/news\/local\/judge-denies-motion-dismiss-lawsuit-remove-loudoun-county-school-board-member-beth-barts-citizens-leesburg-lcso\">WJLA<\/a>.<\/p>\n<p>\u201cI can say for months, parents have been asking for a seat at the table. We haven\u2019t been heard by the school board. They haven\u2019t given us that opportunity. The leaders here haven\u2019t stepped up to try to come to resolution about what\u2019s going on in schools, but yesterday the court gave us that seat at the table.\u201d<\/p><\/blockquote>\n<p>\u201cI feel like the judge looked at the evidence and made a decision that was right,\u201d Fight for Schools supporter Erin Dunbar, also a parent, said after the hearing, according to\u00a0<a href=\"https:\/\/loudounnow.com\/2021\/10\/05\/barts-recall-case-advances-commonwealths-attorney-disqualified\/\">Loudoun Now<\/a>.<\/p>\n<blockquote><p><strong>\u201cI think she\u2019s unbiased. She\u2019s looking at the evidence in front of her and I think she\u2019s actually going to give us a fair trial.\u201d<\/strong><\/p><\/blockquote>\n<p>Earlier this year, when she was censured over her social media activity, Barts said in a statement:<\/p>\n<div class=\"Advert_tablet__3QEBr Advert_mobile__1rlLc Advert_placement__1I4yb Advert_align__N0_fw\"><\/div>\n<blockquote><p><em><strong>\u201cIt\u2019s not my job to be liked. It\u2019s my job to ask hard questions, work to provide the best education for our kids, make sure our teachers are paid what they really deserve, and represent the people of Leesburg.\u201d<\/strong><\/em><\/p><\/blockquote>\n<p>Her statement came after\u00a0School Board Vice Chairwoman Atoosa Reaser asserted in March that Barts repeatedly violated the school board\u2019s code of conduct.<\/p>\n<p>Meanwhile, a several-month-long Loudoun County Sheriff\u2019s Office investigation found that social media posts in the private Facebook group did not constitute criminal action, according to\u00a0<a href=\"https:\/\/wjla.com\/news\/local\/no-charges-filed-against-loudoun-county-group-accused-of-targeting-parents-that-oppose-crt\">local media<\/a>.
