(<a href=\"https:\/\/www.lifesitenews.com\/\">LifeSiteNews<\/a>) \u2013\u00a0<i>Dobbs v. Jackson Women\u2019s Health Organization<\/i>\u00a0was not among the decisions released Monday by the U.S. Supreme Court, meaning America will have to wait longer to know whether\u00a0<i>Roe v. Wade<\/i>\u00a0is really being overturned.<\/p>\n<p><iframe loading=\"lazy\" class=\"rumble\" src=\"https:\/\/rumble.com\/embed\/v12cuzz\/?pub=4\" width=\"640\" height=\"360\" allowfullscreen=\"allowfullscreen\" data-lazy-loaded=\"1\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p>Monday\u2019s slate of newly-released decisions and orders\u00a0<a href=\"https:\/\/www.scotusblog.com\/2022\/05\/announcement-of-orders-and-opinions-for-monday-may-16\/\" target=\"_blank\" rel=\"noopener\">included<\/a>\u00a0deportation, criminal sentencing, and campaign finance cases, but nothing about abortion. More than two dozen previously-argued cases still\u00a0<a href=\"https:\/\/apnews.com\/article\/abortion-us-supreme-court-amy-coney-barrett-john-roberts-299fafc4818a63b34bcfaba75f54df4a\" target=\"_blank\" rel=\"noopener\">await<\/a>\u00a0resolution.<\/p>\n<p>On May 2,\u00a0<i>Politico<\/i>\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/breaking-scotus-roe-leaked\/\">published<\/a>\u00a0a leaked draft of a majority opinion by conservative Justice Samuel Alito for\u00a0<i>Dobbs<\/i>,\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/justices-put-tough-questions-to-roe-defenders-in-mississippi-abortion-case\/\">which concerns<\/a>\u00a0Mississippi\u2019s 15-week abortion ban. The draft declares that \u201c<i>Roe<\/i>\u00a0was egregiously wrong from the start,\u201d and therefore it is \u201ctime to heed the Constitution and return the issue of abortion to the people\u2019s elected representatives.\u201d In response, the Court\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/supreme-court-confirms-alito-opinion-overturning-roe-is-real-but-not-final-decision\/\">announced<\/a>\u00a0the draft was authentic but \u201cdoes not represent a final decision by the court or the final position of any member on the issues in the case.\u201d<\/p>\n<p>It remains unclear whether the draft represents a final decision to overturn\u00a0<i>Roe<\/i>, is a tentative decision subject to change, was prepared in anticipation of a majority to overturn, or was written in hopes of persuading Alito\u2019s colleagues to sign on. Regardless, the leak has sent shockwaves across the political spectrum, with pro-lifers tentatively rejoicing, pro-abortion\u00a0<a href=\"https:\/\/twitter.com\/RiegerReport\/status\/1521502005235269930\" target=\"_blank\" rel=\"noopener\">politicians<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/pro-abortion-demonstrators-gather-outside-supreme-court-after-reported-ruling-overturning-roe-v-wade\/\">activists<\/a>\u00a0lashing out in anger, and many speculating that the leak\u00a0<a href=\"https:\/\/www.lifesitenews.com\/opinion\/pro-life-law-firm-condemns-supreme-court-leak-as-pro-abortion-tactic-to-intimidate-justices\/\">may have been intended<\/a> to pressure judges to flip their votes, or to incite hatred and threats against them.<\/p>\n<p>On May 11,\u00a0<i>Politico<\/i>\u00a0followed up its original leak with a\u00a0<a href=\"https:\/\/www.politico.com\/news\/2022\/05\/11\/alito-abortion-draft-opinion-roe-00031648\" target=\"_blank\" rel=\"noopener\">report<\/a>\u00a0that Alito\u2019s opinion \u201cremains the court\u2019s only circulated draft in the pending Mississippi abortion case.\u201d If true, that would indicate the final decision is still several weeks away, as it will take time for the justices to digest and respond to one another\u2019s concurring and dissenting opinions.<\/p>\n<p>If Alito\u2019s opinion does prove to be the Supreme Court\u2019s final decision, its ramifications will be drastic.\u00a0<a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/abortion-policy-absence-roe\" target=\"_blank\" rel=\"noopener\">More than 20 states<\/a>\u00a0currently have laws on the books that would effectively ban abortion within their borders upon\u00a0<i>Roe\u2019s<\/i>\u00a0fall, from pre-<i>Roe<\/i>\u00a0abortion bans that went unenforced to \u201ctrigger laws\u201d designed not to take effect until a ruling like today\u2019s. In those states, abortion would become illegal as soon as the ruling is issued.<\/p>\n<p>More than a dozen other states plus the District of Columbia have laws on the books legally protecting abortion, at least three of which explicitly codify the practice as a \u201cright.\u201d Abortion would remain legal in those jurisdictions, as well as the remaining states that have not spelled out abortion\u2019s status one way or another, but without\u00a0<i>Roe<\/i>\u00a0state residents would have the power to vote on the issue for themselves, or lobby their elected representatives to change the law in either direction.<\/p>\n<p>Pro-lifers in Congress could pursue a\u00a0<a href=\"https:\/\/www.lifesitenews.com\/blogs\/national-review-botches-the-constitution-in-argument-against-federal-abortion-bans\/\">nationwide abortion ban<\/a>\u00a0as well, and many pro-lifers will no doubt urge them to do so, in order to prevent states like California from\u00a0<a href=\"https:\/\/www.lifesitenews.com\/news\/democrat-gov-newsom-announces-125-million-to-attract-abortion-seekers-to-california\/\">attempting<\/a>\u00a0to keep interstate abortions thriving.<\/p>\n<p>___<br \/>\n<a href=\"https:\/\/www.lifesitenews.com\/news\/supreme-court-releases-latest-decisions-but-abortion-ruling-still-to-come\/\">https:\/\/www.lifesitenews.com\/news\/supreme-court-releases-latest-decisions-but-abortion-ruling-still-to-come\/<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>SCOTUS BLOCKBUSTER!
