Dear ModeRNA,<\/strong><\/p>\n

In order for the FDA to authorize any biological product for emergency use, THE LAW<\/a> REQUIRES THAT ALL OF THE FOLLOWING CRITERIA BE PROVEN:<\/p>\n

  1. EMERGENCY:<\/strong> There must be an emergency involving a disease that poses a risk of death to the target patient demographic.<\/li>\n
  2. EFFECTIVENESS: <\/strong>The biological product being considered must be shown to be effective in PREVENTING the deadly disease.<\/li>\n
  3. SAFETY: <\/strong>The biological product being considered must be shown to be safe.<\/li>\n
  4. POSITIVE BENEFIT\/RISK RATIO: <\/strong>The benefits of the biological product must outweigh the risks.<\/li>\n<\/ol>\n

    The evidence below shows that ModeRNA has FAILED to prove all of the above mandatory criteria, so the FDA has no other legal recourse than to reject ModeRNA\u2019s request for Emergency Use Authorization of their biological product.<\/p>\n
