Burns was taken into the police station after eluding to the possibility that the Diamond District in New York would be burned to the ground.\u00a0 It is a prototypical violent speech cases and, as many on this blog will not be surprised to read, I believe it raises a serious concern for free speech.<\/p>\n<p>Ironically, we\u00a0<a href=\"https:\/\/jonathanturley.org\/2014\/12\/04\/should-michael-browns-father-in-law-be-criminally-charged-for-inciting-a-riot\/\">previously discussed the issue of violent speech<\/a>\u00a0in a column where I argued against charging Michael Brown\u2019s stepfather during the Ferguson rioting.<\/p>\n<p>Burns told a reporter with Fox News<\/p>\n<blockquote><p>\u201cYou know I\u2019m a leader of this \u2018FTP\u2019 movement. It means a lot of things. It can mean free the people, it can mean for the people, it can also mean \u2018fire to property.\u2019 You know that\u2019s very possible \u2026<\/p>\n<p>Today, I\u2019m giving a demonstration from Barclay\u2019s Center at 6 p.m. to City Hall, and that\u2019s the first stop \u2014 and we\u2019re hoping [Mayor] De Blasio and [Gov.] Cuomo come out and talk to us and give the youth some direction. But if they don\u2019t, then [the] next stop is the Diamond District,\u201d he said, referring to a block on Manhattan\u2019s 47th Street known for jewelry shops. \u201cAnd gasoline, thanks to Trump, is awfully cheap. So, we\u2019re giving them a chance right now to do the right thing.\u201d<\/p><\/blockquote>\n<p>The police responded by saying that they searched for the man in the interview and \u201ctook him in.\u201d<\/p>\n<div class=\"artSplitter mol-img-group\">\n<div class=\"mol-img\">\n<div class=\"image-wrap fff-pic\">\n<p><img loading=\"lazy\" decoding=\"async\" id=\"i-8b8dc28671b375c1\" class=\"blkBorder img-share b-loaded\" src=\"https:\/\/i2.wp.com\/i.dailymail.co.uk\/1s\/2020\/06\/07\/06\/29317526-8395887-image-a-10_1591509478698.jpg?resize=634%2C751&amp;ssl=1\" alt=\"The NYPD revealed on Twitter that they located Burns and brought him in for questioning about his claims\" width=\"634\" height=\"751\" \/><\/p>\n<div class=\"overlay-icon mobile-gallery\">\n<div class=\"mobile-gallery-icon\">It was then reportedly Burns, 34, whose real name is\u00a0<a href=\"https:\/\/www.nydailynews.com\/new-york\/nyc-crime\/ny-protester-fox-news-interview-threat-burn-diamond-district-20200607-5wl7bc5y7zgnjefl6aq5qhbqtq-story.html\">Israel Burns, has been charged with one count each of making terroristic threats, aggravated harassment<\/a>, and false reporting.<\/div>\n<div><\/div>\n<\/div>\n<div>The case raises the issue of violent speech, a controversial area of prosecution.\u00a0 I do not believe that these comments would satisfy the standard established by the Supreme Court in 1969 in\u00a0<em>Brandenburg v. Ohio<\/em>\u00a0as advocating imminent violence. Violent speech is protected under the Constitution absent such a threat of imminent violence. I have\u00a0<a href=\"http:\/\/usatoday30.usatoday.com\/news\/opinion\/2005-05-02-speech_x.htm\">previously written about the dangerous line of criminalizing speech<\/a>. I currently have a case in the federal court on this issue in\u00a0<em>United States v. Al-Timimi.<\/em><\/div>\n<div><\/div>\n<div>The Burns case is reminiscent of\u00a0<em>Watts v. United States<\/em>, where the defendant spoke at a rally against the military draft and said, \u201cIf they ever make me carry a rifle, the first man I want to get in my sights is L.B.J.\u201d\u00a0\u00a0He was prosecuted under a federal statute that prohibited \u201cany threat to take the life of or to inflict bodily harm upon the President of the United States.\u201d The Supreme Court overturned the conviction and held that the words were not a \u201ctrue \u2018threat\u201d but \u201cpolitical hyperbole.\u201d<\/div>\n<\/div>\n<div>\n<div class=\"topic_block\">\n<p class=\"annotation\">Likewise, in\u00a0<em>NAACP v. Claiborne Hardware Co.<\/em>, white merchants in Claiborne County, Mississippi, involved a civil action based on a statement made by NAACP Field Secretary Charles Evers that<\/p>\n<blockquote>\n<p class=\"annotation\">\u201cblack people that any \u2018uncle toms\u2019 who broke the boycott would \u2018have their necks broken\u2019 by their own people.\u201d The Supreme Court found\u00a0that Evers\u2019 \u201cemotionally charged rhetoric . . . did not transcend the bounds of protected speech set forth in\u00a0<em>Brandenburg<\/em>. . . . An advocate must be free to stimulate his audience with spontaneous and emotional appeals for unity and action in a common cause. When such appeals do not incite lawless action, they must be regarded as protected speech.\u201d<\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<div>This Burns case is certainly not abstract or purely hyperbolic given the arson that has occurred in these protests.\u00a0 However, it still demonstrates the concern among many in the free speech community over this exception to the protections under the First Amendment.\u00a0 Burns was making inflammatory statements about these protests.\u00a0 If he was planning an attack, he would have been charged with conspiracy or actual terrorism.\u00a0 He was threatening what he viewed as the status quo and a privilege class. Most of us are appalled by the statements.
