Everyone from\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/unite-against-big-tech-abuses-social-media-privacy-competition-antitrust-children-algorithm-11673439411?mod=opinion_lead_pos5\">Joe Biden<\/a>\u00a0to would-be\u00a0<a href=\"https:\/\/www.npr.org\/2022\/10\/08\/1127689351\/elon-musk-calls-himself-a-free-speech-absolutist-what-could-twitter-look-like-un\">disinformation Czarina Nina Jankowicz<\/a>\u00a0to\u00a0<em><a href=\"https:\/\/www.cnn.com\/2023\/01\/18\/tech\/davos-conspiracy-theories\/index.html\">New York Times\u00a0<\/a><\/em><a href=\"https:\/\/www.cnn.com\/2023\/01\/18\/tech\/davos-conspiracy-theories\/index.html\">publisher A.G. Sulzberger<\/a>\u00a0have suggested the United States needs to move more in Europe\u2019s direction, toward stricter rules and \u201cillegal hate speech,\u201d which \u201c<a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/at-davos-free-speech-is-the-enemy\">you will have soon also in the U.S<\/a>.,\u201d as European Commission Vice President for Values Vera Jourova put it at the Davos conference this year.<\/p>\n<p>It makes sense. After all, who\u2019s\u00a0<em>for<\/em>\u00a0hate speech? What possible downside can there be to disallowing expressions of racism, antisemitism, xenophobia, transphobia?<\/p>\n<p>C.J. Hopkins can answer that. Following a similar case involving Roger Waters, the American playwright, Substack contributor, and editor of\u00a0<em><a href=\"https:\/\/consentfactory.org\/\">Consent Factory<\/a><\/em>\u00a0has been placed under investigation by a Berlin prosecutor for tweeting an image of his book,\u00a0<em><a href=\"https:\/\/www.amazon.com\/Rise-New-Normal-Reich-2020-2021\/dp\/3982146429\/ref=sr_1_1?hvadid=604585354264&amp;hvdev=c&amp;hvlocphy=9003502&amp;hvnetw=g&amp;hvqmt=e&amp;hvrand=4784842466263943956&amp;hvtargid=kwd-1655589697129&amp;hydadcr=13135_13365964&amp;keywords=the+rise+of+the+new+normal+reich&amp;qid=1686750507&amp;sr=8-1\">The Rise of the New Normal Reich<\/a><\/em>. Unlike the Waters case, there\u2019s absolutely nothing in C.J.\u2019s outside-of-text history that even theoretically could be used to argue hidden\/dangerous subtext.<\/p>\n<p>\u201cIt would take all of about 20 seconds of anyone looking at my actual work to see how absolutely opposed I am to anything resembling, totalitarianism, fascism, authoritarianism, anything,\u201d he says.<\/p>\n<p>I first read C.J. at the outset of the Russiagate scandal, when from the amusing <a href=\"https:\/\/www.youtube.com\/watch?v=14njUwJUg1I\">Statler-and-Waldorf<\/a>\u00a0remove of expat life he wrote\u00a0<a href=\"https:\/\/consentfactory.org\/2017\/03\/23\/the-united-states-of-cognitive-dissonance\/\">witty columns<\/a>\u00a0about how far off the rocker America had fallen. A terrific comic prose stylist, he ripped our culture for obsessing over \u201cPutin-Nazis,\u201d noting the new Russophobia was just \u201ca minor variation on the original War on Terror narrative we\u2019ve been indoctrinated with since 2001.\u201d These columns are worth a re-read. C.J. was ahead of me, Glenn Greenwald, Aaron Mat\u00e9, and others in seeing how Trump-era propaganda campaigns deranged the population.<\/p>\n<p>We had uncomfortable correspondence after Covid-19 hit, when I wasn\u2019t so sure we were dealing with the same kinds of official lies this time, and worried about the wisdom, say, of writing \u201cpandemic\u201d in quotation marks. I rolled my eyes when I saw him cite an old quote from Hermann Goering, saying, \u201cAll you have to do is tell [people] they are being attacked and denounce the pacifists for lack of patriotism and exposing the country to danger.\u201d But he placed it astride this real quote from California State Senator Richard Pan,\u00a0<a href=\"https:\/\/www.latimes.com\/california\/story\/2021-02-05\/california-senator-warns-covid-19-vaccine-extremists\">about \u201canti-vaxxers\u201d<\/a>:<\/p>\n<blockquote class=\"wp-block-quote\"><p><em>These extremists have not yet been held accountable, so they continue to escalate violence against the body public\u2026 We must now summon the political will to demand that domestic terrorists face consequences for their words and actions.<\/em><\/p><\/blockquote>\n<p>In hindsight it\u2019s incredible how many of us swallowed the notion that people who didn\u2019t take the shot were \u201cterrorists,\u201d and needed the incentive of ever-harsher \u201cconsequences\u201d to repent of their \u201cviolence.\u201d That this was more religious movement than science was hard for some to see at the time. The tell eventually was that none of the messaging relented when details about the inefficacies of the vaccines came to light. Only a few were willing to say anything about this. C.J. was one, and even if you don\u2019t agree with all he says \u2014 style-wise he often conducts literary operations miles behind hyperbolic lines \u2014 he said a great many things that were true and needed hearing. Now, he\u2019s looking at charges for doing so.<\/p>\n<p>One thing\u00a0<em>The New Normal Reich<\/em>\u00a0is not is a celebration of Nazi imagery. Hopkins is taking current governments around the world that used the pandemic to assert sweeping power and comparing them to Nazi rule. Here\u2019s an example, from a column called \u201c<a href=\"https:\/\/consentfactory.org\/2020\/11\/22\/the-germans-are-back\/\">The Germans are Back<\/a>!\u201d in November 2020:<\/p>\n<blockquote class=\"wp-block-quote\"><p><em>On November 18, the German parliament passed a new law, revising the so-called \u201cInfection Protection Act\u201d (\u201cDas Infektionsschutzgesetz\u201d in German), that formally granted the government the authority to issue whatever edicts it wants under the guise of protecting the public health\u2026<\/em><\/p>\n<p><em>Now, this revised \u201cInfection Protection Act\u2026\u201d is not in any way comparable to the \u201c<a href=\"https:\/\/en.wikipedia.org\/wiki\/Enabling_Act_of_1933#:~:text=The%20Enabling%20Act%20allowed%20the%20National%20Ministry%20(essentially%20the%20cabinet,itself%20considered%20a%20constitutional%20amendment.\">Enabling Act of 1933<\/a>,\u201d which formally granted the Nazi government the authority to issue whatever edicts it wanted under the guise of remedying the distress of the people. Yes, I realize that sounds quite similar, but, according to the government and the German media, there is absolutely no equivalence whatsoever, and anyone who even suggests there is\u2026 \u201ca neo-Nazi conspiracy theorist\u201d \u2026 or whatever.<\/em><\/p><\/blockquote>\n<p>In no way does this kind of passage \u201cfurther the aims of a former National Socialist organization.\u201d It compares the current German government to Nazi Germany. The current German government in turn is openly validating that comparison by criminally investigating C.J. for the critique.<\/p>\n<p>What\u2019s more dangerous than outlawing hate speech? Giving someone the authority to define hate speech. Germany has already\u00a0<a href=\"https:\/\/www.spiked-online.com\/2023\/04\/05\/is-germany-persecuting-lockdown-sceptics\/\">jailed<\/a>\u00a0one lockdown critic (Michael Ballweg, arrested in a dubious fraud case), while microbiologist Sucharit Bhakdi was\u00a0<a href=\"https:\/\/www.timesofisrael.com\/germany-clears-anti-vaxxer-who-called-israel-worse-than-nazis\/\">taken to trial<\/a>\u00a0\u2014 acquitted, but still \u2014 for describing Israel as worse than Nazi Germany. The Roger Waters case investigates clearly satirical imagery. Set all those cases aside, however. C.J.\u2019s situation is, openly, a case of a government seeking to criminalize criticism of itself, the dumbest and least defensible version of censorship possible. At the very least, other writers should be taking his side, and journalists should bring this case up anytime anyone even thinks about claming the United States is \u201clagging\u201d behind Europe on the speech-law front. I spoke with Hopkins about his situation:<\/p>\n<p><strong>Matt Taibbi:\u00a0<\/strong>This is pretty scary. How are you doing?<\/p>\n<p><strong>C.J. Hopkins:<\/strong>\u00a0I\u2019m all right, all things considered. I wrote in my piece today that it\u2019s kind of a\u00a0<a href=\"https:\/\/consentfactory.org\/2023\/06\/12\/new-normal-germany-blues\/\">joke<\/a>, and it\u2019s not. I\u2019ve got a good German lawyer now, and the lawyer\u2019s going to be dealing with the Berlin State prosecutor, so that\u2019s a big relief. Other than that, I\u2019m basically just angry.<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0Appropriate! Has anybody else raised any attention to your case? Other journalists, writers, artists?<\/p>\n<p><strong>C.J. Hopkins:<\/strong>\u00a0Not anyone who has a really big megaphone. There are a lot of websites that repost my stuff when I write them,\u00a0<em>OffGuardian<\/em>\u00a0is one of them. They\u00a0<a href=\"https:\/\/off-guardian.org\/2023\/06\/10\/political-satirist-cj-hopkins-facing-criminal-prosecution\/\">put a thing up<\/a>. That\u2019s about it. And some people on Twitter have done it, but no journalists\u2026 I copied one of my tweets to a lot of German journalists. Haven\u2019t heard a peep.<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0How did you first find out about this? What was the sequence, did they contact you in writing?<\/p>\n<p><strong>C.J. There\u2019s a letter from the state prosecutor of Berlin notifying me that I am under investigation for \u2014 I think I\u2019ve got it memorized by now \u2014 \u201cdisseminating propaganda, the contents of which are intended to further the aims of a former National Socialist Organization.\u201d<\/p>\n<p>You know, German is already\u00a0<a href=\"https:\/\/faculty.georgetown.edu\/jod\/texts\/twain.german.html\">a pretty difficult language<\/a>. So try German legalese\u2026<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0What does it mean to be informed that you\u2019re under investigation? In America, they wouldn\u2019t have to do that. Obviously they would just investigate and then you would be told you were indicted or not. So what\u2019s the difference and what\u2019s the next step?<\/p>\n<p><strong>C.J. Hopkins:<\/strong>\u00a0The way it works here apparently is that you get this letter, and the state prosecutor is notifying me that I\u2019m now under criminal investigation for these charges, and then I have a chance to respond. They give me two weeks to respond to this notification. That\u2019s what my lawyer is going to do. He\u2019s going to file a response, which is basically a motion to dismiss \u2014 that\u2019s the way Americans would understand it. It\u2019s my chance and my lawyer\u2019s chance to write to the prosecutor and say, \u201cOkay, these charges are ridiculous and here\u2019s why.\u201d The prosecutor will consider that response, and then they will decide whether to go forward with the prosecution or not.<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0They\u2019re giving you a hard time about the content or the cover?<\/p>\n<p><strong>C.J. Hopkins:<\/strong>\u00a0It\u2019s two tweets. I don\u2019t know what the tweets are because they haven\u2019t produced them\u2026 The tweets I think have been removed from Twitter, so I can\u2019t find them. It\u2019s not clear whether the tweets are the full cover of my book, or just the artwork of my book. For example, like\u00a0<a href=\"https:\/\/zerohedge.com\/\">ZeroHedge<\/a>\u00a0just put on\u00a0<a href=\"https:\/\/www.zerohedge.com\/geopolitical\/political-satirist-cj-hopkins-under-criminal-investigation-berlin\">the piece that they just ran<\/a>\u00a0about the story. Anyway, what they\u2019re charging me with or investigating me for is basically disseminating something with a swastika on it. And the weird part about it is, of course, you\u2019re allowed to display swastikas in Germany for certain purposes. For historical purposes and what have you. You\u2019re not allowed to display them if you\u2019re a Nazi or neo-Nazi. But promoting Nazi ideology, of course, is exactly the opposite of what I was doing. But the part of the law that they cited states exactly that I posted this image in order to further the aims of a Nazi organization,<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0But you\u2019re certainly not enthusiastic about Nazism anywhere, are you?<\/p>\n<p><strong>C.J. Hopkins:<\/strong>\u00a0I\u2019m laughing because it would take all of about 20 seconds of anyone looking at my actual work to determine how absolutely opposed I am to anything resembling totalitarianism, fascism, authoritarianism, anything. The book is not comparing Germany to the Nazi regime. The name of the book is\u00a0<em>The Rise of the New Normal<\/em>. Yes, I wrote about Germany. I live here. I also wrote about the U.S. I wrote about the U.K. I wrote about Australia and New Zealand, and the \u201cNew Normal\u201d is the way that I\u2019ve referred to the whole phenomenon that started in 2020. This is a global phenomenon. It\u2019s not specific to Germany. But yes, I wrote a number of articles specifically about Germany because I live here.<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0But one could interpret this as the German government being upset at being so compared? No?<\/p>\n<p><strong>C.J. Hopkins:<\/strong>\u00a0That\u2019s exactly the way that I interpret it. If anyone with even a mid-range IQ were to glance at my body of work for 20, 30 seconds, they could determine my intentions and where my sympathies lie. The only way that I could interpret this, Matt, is as intimidation, bullying.<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0Lastly, you\u2019re a playwright by profession. How has all of this affected your relationships with people in like the theater world? Is there anything left of those relationships at this point?<\/p>\n<p><strong>C.J. Hopkins:\u00a0<\/strong>Nothing . It was one component of the massive heartbreak that I experienced over the last few years\u2026 Basically 99% of my old theater friends, theater colleagues, some of them just went silent and disappeared. Others I had huge fights with and falling out episodes with. The way the arts community and the theater community has reacted to all of this is just absolutely heartbreaking.<\/p>\n<p><strong>Matt Taibbi:<\/strong>\u00a0This is a particularly important issue for theater, isn\u2019t it? What they told people about the transmissibility of the virus had a massive impact on attendance and the ability to put on plays. Wouldn\u2019t you think that there\u2019d be a little bit of a re-think from people who were affected?<\/p>\n<p><strong>C.J. Hopkins:\u00a0<\/strong>Well, you know about Tim Robbins. When Tim Robbins out and\u00a0<a href=\"https:\/\/www.racket.news\/p\/tim-robbins-and-the-lost-art-of-finding\">said<\/a>\u00a0those things on your site \u2014 \u201cI was guilty of everything I came to understand was not healthy,\u201d and \u201cWe\u2019ve restricted people from working for too long,\u201d that sort of thing \u2014 bless him. It was really important. He\u2019s the exception to the rule. You\u2019re talking about how it affected the theater. A lot of my plays are experimental plays,\u00a0<em>avant-garde<\/em>\u00a0plays, whatever you want to call them. There was a company, a British company, that did a revival of my oldest, best-known play, and they toured it in the U.K.. They took, took it to Australia recently.<\/p>\n<p>They were on the verge of being completely destroyed. You know, the original UK tour that they had scheduled was to open in March of 2020, and boom, they were this close to bankruptcy. So many small theater companies went through it. Really this is the lifeblood of the theater, this is where the new ideas for the theater are created. This is where the fresh blood comes from. So many of these small theater companies, which struggle to survive normally, they get by on a shoestring, and they were crushed. I think part of the problem is, Matt, the entertainment business and the theater world, it\u2019s a world that is\u00a0<em>dominated<\/em>\u00a0by fear. Everyone in the business is so terrified of alienating anyone or offending anyone who\u2019s going to then mention it to someone\u2019s agent who\u2019s going to have drinks with some casting agent and producer, and then they\u2019ll never work again.<\/p>\n<p><strong>Matt Taibbi:\u00a0<\/strong>So, in that atmosphere, you couldn\u2019t have your name being dropped \u2013 people would treat it\u2019s as if it\u2019s radioactive.<\/p>\n<p><strong>C.J.
