Sixty Day Incarceration for Infowar\u2019s Host Owen Shroyer for J 6 Speech<\/span><\/h2>\n

Renee Parsons\u00a0<\/span><\/span><\/p>\n

Hopeful of a probation sentence, on the morning of Tuesday, September 12<\/span>th<\/sup><\/span>, Infowars Host and consummate ace reporter Owen Shroyer<\/span><\/a> was sentenced to sixty days in Federal prison by US District Court Judge Timothy Kelly in DC.\u00a0 <\/span>This is less than the 120 days that the DOJ recommended; while any jailing of a journalist sets an egregious unconstitutional precedence against the First Amendment.\u00a0<\/span><\/span><\/p>\n

Here\u2019s a brief history of Owen\u2019s predicament:<\/span><\/p>\n

Although Owen never entered the Capitol Building on January 6th, his difficulties began in December 2019 when Shroyer \u2018disrupted<\/span><\/a><\/span>\u2019<\/span> a House Judiciary Committee impeachment hearing of President Donald Trump as the DOJ cited Shroyer\u2019s \u2018unlawful history at the US Capitol.<\/i>\u201d \u00a0 \u00a0<\/span><\/span><\/p>\n

As a result of his presence on January 6<\/span>th<\/sup><\/span>,\u00a0 <\/span>the DOJ targeted Shroyer with \u2018Disorderly<\/i><\/span> and Disruptive Conduct on US Capitol Grounds<\/i>\u201d and \u201cParading, Demonstrating, or Picketing in a Capitol Building;\u201d<\/i> both of which have been exploited to charge multiple J6 defendants.\u00a0 <\/span>By February 2020 with no evidence of any underlying crime, Shroyer agreed to a Deferred Prosecution Agreement which identified a realignment of \u2018restricted\u2019 Capitol Grounds area with DOJ assurance of no incarceration; upon which the government ultimately reneged.\u00a0 \u00a0<\/span><\/span><\/p>\n

A Criminal Complaint<\/span><\/a> was filed on August 19, 2021<\/span> with a Statement of Offense<\/span><\/a> in June, 2023.\u00a0 <\/span>Ultimately Owen plead guilty<\/span><\/a> to a Misdemeanor charge of Entering and Remaining in a Restricted Building or Grounds.\u00a0<\/span><\/p>\n

The Sentencing Agreement<\/span><\/a> of\u00a0 <\/span>September 5, 2023 submitted by US Attorney Matthew Graves states unequivocally that\u00a0<\/span><\/span><\/p>\n

\u201cOne of the most important factors in Shroyer\u2019s case is his access to and use of the platform that is his Internet streaming program, both before, during, and after January 6th<\/i>\u201d as well as Shroyer\u2019s assertion of the \u2018false certification of Biden.\u2019 \u00a0<\/span><\/i><\/span><\/p>\n

In other words, Owen was being pursued due to his role on Infowars and another Defendant who dared challenge the validity of the 2020 election.<\/span><\/p>\n

Substantiating the DOJ\u2019s prosecution included Shroyer\u2019s use of a bullhorn as the Agreement asserts that\u00a0<\/span><\/span><\/p>\n

\u201cShroyer helped create January 6. The government respectfully requests that this Court sentence him to 120 days of incarceration, 12 months of supervised release, 60 hours of community service, and $500 in restitution.\u201d\u00a0 <\/span><\/i>\u00a0 \u00a0<\/span><\/span><\/p>\n

Owen totally completed the community service requirement which the government continues to claim he has failed to complete. \u00a0<\/span><\/span><\/p>\n

Defense attorney Norm Pattis said Shroyer attended Trump’s \u201cStop the Steal\u201d rally as a journalist who intended to cover the event for his Infowars show. “The First Amendment permits and protects the rights of individuals to assemble and engage in demonstrations that confront and criticize the government, even when those demonstrations become rowdy or unruly<\/i><\/span>,” <\/span>Pattis wrote.<\/span>\u00a0 \u00a0<\/span><\/span><\/p>\n

In a novel legal interpretation, prosecutors<\/span><\/a> said the First Amendment doesn\u2019t protect the conduct for which Shroyer was charged as if \u2018unlawful\u2019 acts are not protected by the First Amendment.\u00a0<\/span><\/span><\/p>\n

The Sentencing Agreement cited<\/span>\u00a0<\/span><\/span><\/p>\n

\u201c<\/span>Shoyer\u2019s rhetoric in advance of January 6<\/i><\/span>th<\/sup><\/i><\/span>\u201d included \u201cstoking the flames of a potential disruption\u201d <\/i>as he \u201cstoked <\/i><\/span>the fires of discontent with the outcome of the 2020 Presidential election online, driving a mob of individuals to descend on Washington, D.C. on January 6<\/i><\/span>th<\/sup><\/i><\/span>.<\/i><\/span><\/p>\n

The Agreement further\u00a0 <\/span>claims that \u201cAnd the First Amendment is no bar to the Court\u2019s consideration of Shroyer\u2019s words and actions at sentencing.<\/i>\u201d\u00a0 <\/span>In other words, the First Amendment is no longer applicable to one\u2019s speech.\u00a0<\/span><\/span><\/p>\n

\u00a0<\/span><\/i><\/span>\u201cFinally, his statements and actions after January 6 illustrate his complete lack of remorse<\/i>.\u201d<\/span>\u00a0 \u00a0<\/span><\/span><\/p>\n

In an Infowars broadcast in August, 2022, Shroyer suggested \u201cthe FBI should be investigated for their role on January 6<\/i>\u201d and that \u201cDemocrats stood down security intentionally\u201d <\/i>which has been confirmed<\/span><\/a> by former Capitol Hill Police Chief Stephen Sund. \u00a0 \u00a0<\/span><\/span><\/p>\n

As Speaker McCarthy continues to limit public release of the January 6<\/span>th<\/sup><\/span>\u00a0 <\/span>video, the truth of\u00a0 <\/span>the \u2018insurrection\u2019 remains inaccessible.\u00a0<\/span><\/span><\/p>\n
