{"id":217226,"date":"2024-03-15T17:06:55","date_gmt":"2024-03-15T21:06:55","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=217226"},"modified":"2024-03-15T17:06:55","modified_gmt":"2024-03-15T21:06:55","slug":"political-sting-on-tiktok","status":"publish","type":"post","link":"https:\/\/stateofthenation.co\/?p=217226","title":{"rendered":"<h2><b>Political Sting on TikTok<\/b><\/h2>"},"content":{"rendered":"<p><!--more-->Renee Parsons<\/p>\n<p class=\"p1\"><span class=\"s1\">At the outset, let me share that I have no experience with TikTok, having viewed its videos less than could be counted on one hand.<span class=\"Apple-converted-space\">\u00a0 <\/span>I am, however, an unabashed devotee of the First Amendment and view the recent adoption of a ban on TikTok as nothing less than a political sting on an unconstitutional expansion of government censorship as well as an element in the neocon geopolitical target on China. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">While <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/BILLS-118hr7521rh\/pdf\/BILLS-118hr7521rh.pdf\"><span class=\"s3\">HR 7521<\/span><\/a> was approved by the <a href=\"https:\/\/energycommerce.house.gov\/posts\/fact-check-the-truth-about-h-r-7521-the-protecting-americans-from-foreign-adversary-controlled-applications-act\"><span class=\"s3\">House Energy and Commerce Committee<\/span><\/a> on a unanimous 50 \u2013 0 vote on March 11<\/span><span class=\"s4\"><sup>th<\/sup><\/span><span class=\"s2\"> with minimal hearing,<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201c<a href=\"https:\/\/www.congress.gov\/congressional-report\/118th-congress\/house-report\/417\"><span class=\"s3\"><i>Protecting Americans from Foreign Adversary Controlled Application Act<\/i><\/span><\/a>\u201d was immediately scheduled for a House floor vote less than 48 hours later.<\/span><span class=\"s5\"> <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">The Act was brought to the House floor \u2018<i>under suspension\u2019<\/i> which limited debate with no amendments allowed,<\/span> <span class=\"s2\">a common practice to deny opposition a real opportunity to publicly air its merits and allow a roll call vote to test its strength. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">In a convenient realignment of the Uniparty, it is obvious that the Federal government perceives TikTok\u2019s alleged moral decay on <a href=\"https:\/\/tuckercarlson.com\/uncensored-the-tiktok-ban\/?utm_medium=email&amp;utm_source=na&amp;utm_campaign=20240314_march14dailybrief&amp;utm_content=314787\"><span class=\"s3\">170 million<\/span><\/a> GenZ as an attack on national security rather than potential election interference or that an estimated 24,000 undocumented<span class=\"Apple-converted-space\">\u00a0 <\/span>Chinese immigrants who have already crossed the US border.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><span class=\"s2\"><span class=\"Apple-converted-space\">\u00a0\u00a0 \u00a0 \u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Touted as a ban on what former Rep. Ron Paul calls the \u2018<i>most dangerous, anti American act since the Patriot Act<\/i>\u201d, HR 7521 banned the TikTok app on \u2018<i>national security\u2019<\/i> grounds without providing any shred of evidence of where or how viewing the app threatens national security. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Predominately owned by international investors rather than the Chinese Communist party, the TikTok ban allows the President as sole authority to identify and eliminate any app or website as a \u2018<i>national security\u2019<\/i> hazard unless its owner divests within 180 days of enactment.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s6\">\u2026\u201d<\/span><span class=\"s2\"><i>to protect the national security of the United States from the threat posed by foreign adversary controlled applications, <\/i><\/span><span class=\"s7\"><i>such as<\/i><\/span><span class=\"s2\"><i> TikTok and any <\/i><\/span><span class=\"s7\"><i>successor application or service and any other application or service <\/i><\/span><span class=\"s2\"><i>developed or provided by ByteDance Ltd. or an entity under the control of ByteDance Ltd<\/i>..\u201d<\/span> <span class=\"s2\">and<\/span><span class=\"s5\"> <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">\u201c..<i>it shall be unlawful to distribute, maintain, update, enable or host foreign adversary controlled apps<\/i>\u2026\u201d well you get the point.<span class=\"Apple-converted-space\">\u00a0 <\/span>This is about more than TikTok although a convenient scapegoat\u2026<\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">At first glance, it might seem reasonable to believe that the 13 page Act was totally focused on TikTok which begs the question of why it was written in unnecessarily complicated verbiage rather than more simple, straightforward legislative language.<span class=\"Apple-converted-space\">\u00a0 <\/span>The Act required an entire reading to fully understand its implications since the actual legislative language as approved by Congress is rarely ever read aloud or even mentioned during a Floor debate.<span class=\"Apple-converted-space\">\u00a0 <\/span>In other words, loopholes may exist that become more obvious, less vague or innocuous upon close scrutiny.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">House debate was clearly focused on China as the alleged \u2018<i>foreign adversary\u2019<\/i> although other countries may qualify as \u2018foreign adversary\u2019 as Israel based on its bazillion dollar gifts over the years and US initiated multiple wars in the Middle East on behalf of its proxy for Israel. <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">The final vote was a spectacular <a href=\"https:\/\/clerk.house.gov\/evs\/2024\/roll086.xml\"><span class=\"s3\">352 \u2013 65<\/span><\/a> with 15 Republicans and 50 Democrats voting against which occurs, most often, on behalf of AIPAC, or in this case, on behalf of the <a href=\"https:\/\/twitter.com\/realstewpeters\/status\/1768320953509949464\"><span class=\"s3\">ADL<\/span><\/a>.<span class=\"Apple-converted-space\">\u00a0 <\/span>The vote was \u2018Spectacular\u2019 given its timing and urgency rather than a commitment to world peace or banning corruption or buttressing the US Constitution \u2013 as the Congress rarely unites to benefit the American people or to prohibit US participation in espionage or election interference via any foreign adversary or any unilateral action closing the US border. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">While the US makes no secret of spying or conducting surveillance on its own citizens, the US would prefer to limit that right to its own homegrown intel networks as it spies directly on the Chinese with our own three letter agencies. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As Rep. Tom Massie (Ky) labeled the Act a Trojan Horse which has the intent to mislead the public or deceive its real purpose; therefore raising the potential future use of the Act against other social media sites like <a href=\"http:\/\/stateofthenation.co\/?p=217037\"><span class=\"s8\">X or Rumble<\/span><\/a><\/span> <span class=\"s9\">or to eliminate certain politically offensive websites, all in the name of protecting Americans from TikTok.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Most importantly, the Act generously provides the <a href=\"http:\/\/stateofthenation.co\/?p=217037\"><span class=\"s3\">President with very broad sole authority<\/span><\/a> via an interagency process<span class=\"Apple-converted-space\">\u00a0 <\/span>to decide which websites or apps Americans can visit or digitally add with broad discretion beyond TikTok and ban any web site or other social media site deemed to be a \u2018national security\u2019 threat.<span class=\"Apple-converted-space\">\u00a0 <\/span>Majority of Americans, however, prefer not to have information sharing decided by government bureaucrats, even in the Oval Office. <span class=\"Apple-converted-space\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s2\">Questions remain exactly how the Federal government will criminalize TikTok violators since the Attorney General has an identified role. Will the FBI pursue the GenZ Americans who dare to enjoy the site?<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">Here are a few not-so-fun facts to consider:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li7\"><span class=\"s11\">(1) civil penalties <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<p class=\"p8\"><span class=\"s2\">a.<span class=\"Apple-converted-space\">\u00a0 <\/span>Establishes a violation schedule to <i>include $5000 for a convoluted FACA violation<\/i> or<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"p8\"><span class=\"s2\">b. <i>$500 for data and information violations with the US Attorney General conducting investigations and initiating charges before the appropriate Federal District Court<\/i>; <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li7\"><span class=\"s11\">(2)<span class=\"Apple-converted-space\">\u00a0 <\/span>Defining a \u2018covered company\u2019<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<ol class=\"ol1\">\n<li class=\"li10\"><span class=\"s12\"><i> (A)<\/i><\/span><span class=\"s13\"> \u201c<\/span><span class=\"s14\"><i>an entity that operates, directly or indirectly (including through a parent company, subsidiary, or affiliate), a website, desktop application, mobile application,\u00a0has <\/i><\/span><span class=\"s15\"><i>more than 1,000,000 monthly active users;\u201d<\/i><\/span><\/li>\n<\/ol>\n<ul class=\"ul1\">\n<li class=\"li10\"><span class=\"s13\">(B) Exclusion \u201c\u2026.<\/span><span class=\"s14\"><i>does not include an entity that operates a website, desktop application, mobile application, or augmented or immersive technology application whose primary purpose is to allow users to post product reviews, business reviews, or travel information and reviews<\/i><\/span><span class=\"s18\">\u201d <\/span><span class=\"s14\">which could easily be edited out<\/span><span class=\"s18\">.<\/span><span class=\"s13\"><span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<ul class=\"ul1\">\n<li class=\"li10\"><span class=\"s14\">*<span class=\"Apple-converted-space\">\u00a0 <\/span>(3) Foreign Adversary Controlled Application<span class=\"Apple-converted-space\">\u00a0 <\/span>The term \u2018\u2018foreign adversary controlled<span class=\"Apple-converted-space\">\u00a0 <\/span>application\u2019\u2019 means a \u2018<i>website, desktop application,<span class=\"Apple-converted-space\">\u00a0 <\/span>mobile application, or augmented or immersive technology application that is operated, directly or indirectly (including through a parent company, subsidiary, or affiliate), by\u2026\u201d<\/i><\/span><\/li>\n<\/ul>\n<ul class=\"ul1\">\n<li class=\"li10\"><span class=\"s14\">(6. A) Qualified Divestiture:<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201c<i>the President determines, through an interagency process, would result in the relevant covered company no longer being controlled by a foreign adversary<\/i>; or<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<p class=\"p12\"><span class=\"s1\"> B. \u201c<i>precludes the establishment or maintenance of any operational relationship\u00a0precludes the establishment or maintenance of any operational relationship<\/i>\u201d\u2026\u00a0 <span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li10\"><span class=\"s14\"><i>Section 3<\/i><span class=\"Apple-converted-space\">\u00a0 <\/span><i>Judicial Review \u2013 <\/i>this one got my attention: another indication this process is about more than TT<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<p class=\"p13\"><span class=\"s1\"><i>Right of Action<\/i><\/span><\/p>\n<p class=\"p13\"><span class=\"s1\"><i>Exclusive Jurisdiction:<span class=\"Apple-converted-space\">\u00a0 <\/span>DC Circuit Court of Appeal<\/i><\/span><\/p>\n<p class=\"p13\"><span class=\"s1\"><i>Statute of Limitations: not later than 165 days after enactment; action finding or determination 90 days after enactment<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/span><\/p>\n<hr \/>\n<p class=\"p7\"><span class=\"s2\">Renee Parsons\u00a0served on the ACLU\u2019s Florida State Board of Directors and as president of the ACLU Treasure Coast Chapter.
