{"id":40214,"date":"2020-12-06T17:40:49","date_gmt":"2020-12-06T21:40:49","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=40214"},"modified":"2020-12-06T17:40:49","modified_gmt":"2020-12-06T21:40:49","slug":"rejected-georgia-appeal-going-to-supreme-court","status":"publish","type":"post","link":"https:\/\/stateofthenation.co\/?p=40214","title":{"rendered":"Rejected Georgia Appeal Going to Supreme Court"},"content":{"rendered":"<h1>Lin Wood Plans SCOTUS Petition After Court Rejects Georgia Appeal<\/h1>\n<p><!--more-->Zachary Stieber<br \/>\nThe Epoch Times<\/p>\n<p>Attorney Lin Wood said Sunday he plans to file a petition with the U.S. Supreme Court after a federal appeals court denied his appeal in a case seeking to block the certification of the 2020 election in <a href=\"https:\/\/www.theepochtimes.com\/t-georgia\">Georgia<\/a>.<\/p>\n<blockquote><p><em><strong>\u201cThe stakes are high as the case deals with a disputed Presidential election,\u201d\u00a0<\/strong><\/em>Wood said in an email to The Epoch Times.<\/p>\n<p><strong>\u201cI intend to timely file a petition with the United States Supreme Court.\u201d<\/strong><\/p><\/blockquote>\n<p>A panel from the U.S. Court of Appeals for the 11th Circuit on Saturday upheld a Nov. 19 ruling by judge Steven Grimberg, a Trump appointee, who\u00a0<a href=\"https:\/\/www.theepochtimes.com\/federal-judge-rejects-trump-attorneys-bid-to-delay-georgia-certification-of-votes_3586950.html\">said<\/a>\u00a0that Wood\u00a0lacked legal standing as an individual voter to challenge Georgia\u2019s election procedures.<\/p>\n<div class=\"ad__wrapper-element\"><\/div>\n<blockquote><p>\u201cWe agree with the district court that\u00a0<strong>Wood lacks standing to sue because he fails to allege a particularized injury.<\/strong>\u00a0And because Georgia has already certified its election results and its slate of presidential electors, Wood\u2019s requests for emergency relief are moot to the extent they concern the 2020 election,\u201d the panel wrote in\u00a0<a href=\"https:\/\/beta.documentcloud.org\/documents\/20420495-appeals-court-rules-against-lin-wood\">a 20-page opinion<\/a>.<\/p>\n<p>\u201c<strong>The Constitution makes clear that federal courts are courts of limited jurisdiction,\u00a0<\/strong>U.S. Const. art. III; we may not entertain post-election contests about garden-variety issues of vote counting and misconduct that may properly be filed in state courts.\u201d<\/p><\/blockquote>\n<p><strong>The panel consisted of Trump appointee Barbara Lagoa, Obama appointee Jill Pryor, and George W. (Jessica McGowan\/Getty Images)<\/em><\/p>\n<p>A spokesman for Georgia Secretary of State Brian Raffensperger, who was named in the suit,\u00a0didn\u2019t reply to a request for comment.<\/p>\n<p>Wood, known for representing Richard Jewell in the 1996 Atlanta Olympics bombing case and Kentucky teenager Nicholas Sandmann after news outlets smeared him,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/attorney-sues-to-stop-georgia-certifying-election-results-without-review-of-signatures_3579032.html\">filed the suit last month<\/a>\u00a0arguing that the change to election rules by state officials violated the U.S. Constitution.<\/p>\n<p><strong>State officials were unauthorized to change the manner of processing absentee ballots in a way that was contrary with the state election code, and hence, the counting of absentee ballots for the general election in the state is therefore \u201cimproper and must not be permitted,\u201d<\/strong>\u00a0Wood alleged, adding:<\/p>\n<blockquote><p>\u201cTo allow otherwise would erode the sacred and basic rights of Georgia citizens under the United States Constitution to participate in and rely upon a free and fair election.\u201d<\/p><\/blockquote>\n<p>Grimberg dismissed the suit about a week later, arguing that Wood lacked standing and couldn\u2019t show a likelihood of success on the merits.
