&#8216;GRAVE&#8217; ELECTION ISSUES<\/h1>\n<p>by Zachary Stieber<br \/>\nThe Epoch Times<\/p>\n<p>The state of\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-texas\" target=\"_blank\" rel=\"noopener noreferrer\">Texas<\/a>\u00a0argued in a filing to the\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-supreme-court\" target=\"_blank\" rel=\"noopener noreferrer\">Supreme Court<\/a>\u00a0on Friday that<strong>\u00a0the four states it is suing didn\u2019t address \u201cgrave issues,\u201d instead \u201cchoosing to hide behind other court venues and decisions.\u201d<\/strong><\/p>\n<p>Texas\u00a0<a href=\"https:\/\/www.theepochtimes.com\/texas-files-supreme-court-election-lawsuit-against-four-battleground-states_3609460.html\" target=\"_blank\" rel=\"noopener noreferrer\">sued\u00a0Pennsylvania, Georgia, Michigan, and Wisconsin<\/a>\u00a0in the nation\u2019s top court this week,\u00a0alleging that the states unconstitutionally changed election laws, treated voters unequally, and triggered significant voting irregularities by relaxing ballot-integrity measures.<\/p>\n<p><strong>The states \u201cviolated statutes enacted by their duly elected legislatures, thereby violating the Constitution,\u201d the lawsuit alleges.<\/strong><\/p>\n<p>Officials from the defendant states\u00a0<a href=\"https:\/\/www.theepochtimes.com\/mkt_app\/pennsylvania-responds-to-texas-supreme-court-lawsuit-challenging-election_3613333.html\" target=\"_blank\" rel=\"noopener noreferrer\">filed briefs Thursday<\/a>\u00a0urging the Supreme Court to reject the suit.<\/p>\n<p>The request \u201cto exercise its original jurisdiction and then anoint Texas\u2019s preferred candidate for President is\u00a0<strong>legally indefensible<\/strong>\u00a0and is an [affront] to principles of constitutional democracy,\u201d Pennsylvania Attorney General Josh Shapiro wrote.<\/p>\n<p><strong>\u201cTexas is unable to allege that Wisconsin itself did anything to directly injure Texas\u2019s sovereign interests,\u201d Wisconsin Attorney General Joshua Kaul added.<\/strong><\/p>\n<p>In\u00a0<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22O155\/163492\/20201211095715842_TX-v-State-MPI-Reply-2020-12-11.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the new reply<\/a>, Texas Attorney General Ken Paxton and other state attorneys said the defendant states \u201cdo not seriously address grace issues that Texas raises, choosing to hide behind other court venues and decisions in which Texas could not participate and to mischaracterize both the relief that Texas seeks and the justification for that relief.\u201d<\/p>\n<p>\u201c<strong>An injunction should issue because Defendant States have not\u2014and cannot\u2014defend their actions<\/strong>,\u201d they added.<\/p>\n<p><strong>Texas is not asking the Supreme Court to reelect President Donald Trump, according to the filing, nor does it seek to disenfranchise lawful voters.<\/strong><\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/AP18301511868908-1200x800.jpg?itok=ITfemw9v\" (Matt Rourke\/AP Photo)<\/em><\/figcaption><\/figure>\n<p>\u201cTo both points,\u00a0<strong>Texas asks this Court to recognize the obvious fact that Defendant States\u2019 maladministration of the 2020 election makes it impossible to know\u00a0<em>which candidate<\/em>\u00a0garnered the majority of\u00a0<em>lawful<\/em>\u00a0votes<\/strong>. The Court\u2019s role is to strike unconstitutional action and remand to the actors that the Constitution and Congress vest with authority for the next step,\u201d the lawyers argued.<\/p>\n<p>\u201c<strong>Inaction would disenfranchise as many voters as taking action allegedly would<\/strong>. Moreover, acting decisively will not only put lower courts but also state and local officials on notice that future elections must conform to State election statutes, requiring legislative ratification of any change prior to the election. Far from condemning this and other courts to perpetual litigation, action here will stanch the flood of election-season litigation.\u201d<\/p>\n<p>The case has brought a flurry of action from around the nation. Thirty-nine states\u00a0<a href=\"https:\/\/www.theepochtimes.com\/mkt_app\/39-states-pick-sides-in-texas-supreme-court-election-challenge_3613618.html\" target=\"_blank\" rel=\"noopener noreferrer\">have chosen a side<\/a>, with 18 attorneys general siding with Texas and 20 siding with the defendants.<\/p>\n<p>Republican Ohio Attorney General Dave Yost backed neither party and opposed the relief sought by Texas, while state lawmakers in Pennsylvania and other states filed briefs against their own attorneys general.<\/p>\n<p>In a filing late Thursday, outgoing Montana Gov. Steve Bullock, a Democrat,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/montana-governor-files-brief-in-opposition-to-texas-supreme-court-lawsuit_3613948.html\" target=\"_blank\" rel=\"noopener noreferrer\">filed a brief<\/a>\u00a0in support of the defendants. That was the last brief filed before Texas lodged its reply.<\/p>\n<p>In another entry on Friday,<strong>\u00a0Citizens United, Citizens United Foundation, and The Presidential Coalition filed a motion for leave to file a brief in support of Texas<\/strong>.
