Tulsi Gabbard (D-Hawaii) is sponsoring legislation to stop males from participating in women\u2019s sports.<\/h3>\n<\/section>\n<p>&nbsp;<\/p>\n<section>\n<h3 class=\"section_header article_subtitle\">The \u201cProtect Women\u2019s Sports Act\u201d invokes Title IX, a Department of Education rule that seeks to stop sex discrimination in higher education.<\/h3>\n<\/section>\n<p>&nbsp;<\/p>\n<section>\n<h3 class=\"section_header article_subtitle\">The bill has gained support among a number of Republican lawmakers.<\/h3>\n<\/section>\n<section class=\"flex inline_center align_center article_main full_xs\">\n<div class=\"articlediv\">\n<p>&nbsp;<\/p>\n<p>Rep. Tulsi Gabbard (D-Hawaii) introduced legislation to ban biological males from participating in women\u2019s sports.<\/p>\n<p>&nbsp;<\/p>\n<p>Gabbard, a Democrat who ran for the 2020 presidential nomination for her party, is the sponsor of\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/8932\/text?r=20&amp;s=1\" target=\"_blank\" rel=\"noopener noreferrer\">H.R. 8932<\/a>, the \u201cProtect Women\u2019s Sports Act,\u201d alongside Reps. Markwayne Mullin, (R-Okla.), Bill Flores (R-Texas), Bill Johnson (R-Ohio), Rep. Alexander Mooney (R-W.V.), and Rep. Jeff Duncan (R-S.C.).<\/p>\n<p>&nbsp;<\/p>\n<p>The legislation aims \u201cto provide that for purposes of determining compliance with Title IX of the Education Amendments of 1972 in athletics, sex shall be determined on the basis of biological sex as determined at birth by a physician.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>In a joint\u00a0<a href=\"https:\/\/gabbard.house.gov\/news\/press-releases\/reps-gabbard-and-mullin-introduce-bill-ensure-title-ix-protections-women-and\" target=\"_blank\" rel=\"noopener noreferrer\">press release<\/a>\u00a0with Mullin, Gabbard explained that Title IX \u201cled to a generational shift that impacted countless women, creating life-changing opportunities for girls and women that never existed before.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cHowever, Title IX is being weakened by some states who are misinterpreting Title IX, creating uncertainty, undue hardship and lost opportunities for female athletes,\u201d continued the congresswoman from Hawaii. \u201cOur legislation protects Title IX\u2019s original intent which was based on the general biological distinction between men and women athletes based on sex.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cIt is critical that the legacy of Title IX continues to ensure women and girls in sports have the opportunity to compete and excel on a level playing field,\u201d she added.<\/p>\n<p>&nbsp;<\/p>\n<p>Mullin added that \u201cTitle IX was designed to give women and girls an equal chance to succeed, including in sports. Allowing biological males to compete in women\u2019s sports diminishes that equality and takes away from the original intent of Title IX.\u201d\u00a0<a href=\"https:\/\/www.campusreform.org\/article?id=16190\" target=\"_blank\" rel=\"noopener noreferrer\">]<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Title IX\u00a0<a href=\"https:\/\/sites.ed.gov\/titleix\/\" target=\"_blank\" rel=\"noopener noreferrer\">exists\u00a0<\/a>to ensure that \u201cno person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance,\u201d according to the U.S. Department of Education.<\/p>\n<p>&nbsp;<\/p>\n<p>The Trump administration reversed Obama-era Title IX rules related to protecting due process for those accused of sexual assault in the summer of 2020, as<em>\u00a0Campus Reform<\/em>\u00a0previously reported.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/www.heritage.org\/staff\/emilie-kao\" target=\"_blank\" rel=\"noopener noreferrer\">Emilie Kao<\/a>, director of the Heritage Foundation\u2019s DeVos Center for Religion and Civil Society, told\u00a0<em>Campus Reform<\/em>\u00a0that &#8220;Rep. Gabbard took a courageous stand for fairness and female athletes around the country.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cBiology matters in many areas,\u201d she explained. \u201cIt matters in sports because it determines competitiveness, performance, and results. There is widespread bipartisan support for keeping male and female sports separate.
