Advocate Aurora Health has admitted that\u00a0an employee intentionally removed 57 vials<\/a>\u00a0of the Moderna vaccine from refrigeration.\u00a0\u00a0The intentional act, originally claimed to be accidental, resulted in the destruction of 500 doses of the potentially life-saying vaccine.<\/strong><\/p>\n Advocate Aurora Health said\u00a0the employee was fired<\/strong>. However, an intentional destruction of the doses would seem\u00a0the ultimate product tampering case<\/strong>. Either compromised vaccines would be given patients or 500 people will have to wait longer for the protection from Covid-19.<\/p>\n The\u00a0FBI is reportedly investigating<\/a>\u00a0the incident.\u00a0 This would seem a serious offense in the midst of a pandemic.<\/strong><\/p>\n The Justice Department has been\u00a0investigating fraudulent Covid-19 vaccines or treatments<\/a>.\u00a0 This is effective destruction of real vaccine. It is unclear whether it would be investigated as tampering. Section 1365 states:<\/p>\n (a)Whoever, with reckless disregard for the risk that another person will be placed in danger of death or\u00a0bodily injury<\/a>\u00a0and under circumstances manifesting extreme indifference to such risk, tampers with any consumer product that affects interstate or foreign commerce, or the\u00a0labeling\u00a0<\/a>of, or container for, any such product, or attempts to do so, shall\u2014<\/p>\n (1)\u00a0in the case of an attempt, be fined under this title or imprisoned not more than ten years, or both;<\/p>\n (2)\u00a0if death of an individual results, be fined under this title or imprisoned for any term of years or for life, or both;<\/p>\n (3)\u00a0if\u00a0serious bodily injury<\/a>\u00a0to any individual results, be fined under this title or imprisoned not more than twenty years, or both; and<\/p>\n (4)\u00a0in any other case, be fined under this title or imprisoned not more than ten years, or both.<\/p>\n (b)\u00a0Whoever, with intent to cause serious injury to the business of any person, taints any consumer product or renders materially false or misleading the\u00a0labeling<\/a>\u00a0of, or container for, a consumer product, if such consumer product affects interstate or foreign commerce, shall be fined under this title or imprisoned not more than three years, or both.<\/p><\/blockquote>\n Both section might apply to this circumstance.<\/p>\n This is a case where criminal prosecution would be the only effective deterrent.<\/strong>\u00a0It is difficult for individuals to sue such defendants (or the hospital) due to the risk of contracting Covid-19 or even those who did contract the virus while waiting.<\/p>\n One of the issues for the FBI will be whether the individual disclosed the tampering or was willing to have the compromised vaccine administered to patients.\u00a0\u00a0Even with such disclosure, however, there are 500 people who will have to wait longer for a vaccine in the midst of a national pandemic.<\/strong><\/p>\n![\"\"](\"https:\/\/zh-prod-1cc738ca-7d3b-4a72-b792-20bd8d8fa069.storage.googleapis.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/2020-12-31_6-45-48.jpg?itok=FvKNwiZz\")
