{"id":44979,"date":"2021-01-01T13:25:43","date_gmt":"2021-01-01T17:25:43","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=44979"},"modified":"2021-01-01T13:25:43","modified_gmt":"2021-01-01T17:25:43","slug":"vp-pence-is-really-on-the-hot-seat","status":"publish","type":"post","link":"https:\/\/stateofthenation.co\/?p=44979","title":{"rendered":"VP Pence is really on the hot seat!"},"content":{"rendered":"<h1>Pence Asks Judge to Reject GOP Congressman&#8217;s Elector Lawsuit<\/h1>\n<p><!--more--><div id=\"attachment_44980\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-44980\" src=\"http:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/01\/GetFile.jpg\" alt=\"\" width=\"600\" height=\"500\" class=\"size-full wp-image-44980\" srcset=\"https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/01\/GetFile.jpg 600w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/01\/GetFile-300x250.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><p id=\"caption-attachment-44980\" class=\"wp-caption-text\">(Getty)<\/p><\/div><\/p>\n<p>NEWSMAX<\/p>\n<p>Vice President Mike Pence asked a federal judge in Texas to deny a Republican congressman\u2019s emergency request for a court order that would essentially allow the vice president to reverse Donald Trump\u2019s election loss during a joint session of Congress Wednesday.<\/p>\n<p>Rep.\u00a0Louie Gohmert of Texas should have sued the U.S. Senate or the House of Representatives if he disagrees with the established way that Electoral College votes are counted, Justice Department attorneys representing Pence said in a filing Thursday.<\/p>\n<p>\u201cThe vice president &#8212; the only defendant in this case &#8212; is ironically the very person whose power they seek to promote,\u201d the government said. \u201cThe Senate and the House, not the vice president, have legal interests that are sufficiently adverse to plaintiffs.\u201d<\/p>\n<p>Gohmert argues Pence can hand Trump a second term by simply rejecting swing states\u2019 slates of Democratic electors and instead choosing competing GOP electors when the Senate and House meet jointly to open and count certificates of electoral votes. Election experts have said such a finding would create a major conflict of interest.<\/p>\n<p>The House asked for the judge\u2019s permission to file its own brief, in which it argues Gohmert is trying\u00a0to \u201cupend\u201d Congress\u2019\u00a0longstanding role in counting the votes of the Electoral College and invalidate the Electoral Count Act, which has governed the process since 1887.<\/p>\n<p>\u201cThe House also has a compelling interest in ensuring that the public\u2019s confidence in the processes for confirming the results of the 2020 presidential election is not undermined by this last-minute suit, which would authorize the vice president to ignore the will of the nation\u2019s voters,\u201d House attorneys said in the request.<\/p>\n<p>In another filing Thursday, Colorado elector Alan Kennedy argued Gohmert\u2019s lawsuit is based on flawed legal arguments and debunked claims of election fraud.<\/p>\n<p>\u201cPlaintiffs conclude their Electoral College fantasy by proposing unlimited discretion for defendant Pence to usurp the electoral process as plaintiffs desire,\u201d Kennedy, a lawyer, said in a motion to intervene in the case. \u201cOn behalf of the American People, please stop this madness.\u201d<\/p>\n<p>Kennedy argues that competing slates of electors cannot be chosen because, among other things, they don\u2019t exist. States can only choose one slate &#8212; and the swing states at issue already did so &#8212; for President-elect Joe Biden and Vice President-elect Kamala Harris, he said.<\/p>\n<p>\u201cIf an incumbent vice president could keep his or her job that way, then votes of millions of people and votes of duly elected and certified electors would be meaningless, and our nation\u2019s most cherished principle &#8212; \u2018here, We the People rule\u2019 &#8212; would be eviscerated,\u201d Kennedy said.<\/p>\n<p>The vice president has the constitutional role of presiding over the Senate, which has traditionally included overseeing the formal acceptance of the Electoral College vote.<\/p>\n<p>\u201cI can tell you that the argument is something we expected and are not worried about,\u201d Gohmert\u2019s attorney Howard Kleinhendler said in an email, adding that a more-detailed response will be filed Friday.<\/p>\n<p>The Dec. 27 lawsuit by Gohmert echoes Trump\u2019s claim that Biden won the election only through rampant voter fraud perpetrated by thousands of corrupt Democratic officials and election workers.
