Brugen<br \/>\nThe Epoch Times,<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-nyc\">New York<\/a>\u00a0Democrat on Sunday defended a controversial bill that could\u00a0<strong>allow the state governor to \u201corder the removal\u201d or detention of an individual deemed to be a suspected case, contact, or carrier of a \u201ccontagious disease\u201d<\/strong>\u00a0if they \u201cpose an imminent and significant threat to the public health.\u201d<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/covid-19-e1609733775805-700x420.jpg?itok=vHVxEQ8P\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/covid-19-e1609733775805-700x420.jpg?itok=vHVxEQ8P\" data-link-option=\"0\"><picture><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/zh-prod-1cc738ca-7d3b-4a72-b792-20bd8d8fa069.storage.googleapis.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/covid-19-e1609733775805-700x420.jpg?itok=vHVxEQ8P\" \/><\/picture><\/a><\/p>\n<p>Assemblyman Nick Perry, sponsor of\u00a0<a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a416\">Bill A416<\/a>\u00a0that\u00a0<strong>could see individuals detained \u201cby a single order \u2026\u00a0in a medical facility or other appropriate\u00a0facility,\u201d<\/strong>\u00a0pushed back against backlash that the legislation would violate Americans\u2019 constitutional rights,\u00a0according to a\u00a0<a href=\"https:\/\/twitter.com\/NNickPerry\/status\/1345797376041226241\">statement<\/a>.<\/p>\n<p><strong>The bill (<a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2021\/A416\">pdf<\/a>) is scheduled to be taken up on Wednesday<\/strong>\u00a0by the assembly\u2019s health committee, and states that it may be used in the event that the governor declares a state of health emergency \u201cdue to an epidemic of any communicable disease.\u201d<\/p>\n<p><strong>It requires the state governor or his or her delegee \u201cto apply for a court order authorizing\u00a0a detention within three business days.\u201d<\/strong><\/p>\n<blockquote><p>\u201c[T]he governor or his or her\u00a0delegee\u00a0may, in his or her discretion, issue and seek enforcement of any other orders that he or she determines are necessary or appropriate to prevent dissemination or transmission of contagious diseases\u00a0\u2026 to require an individual who has been exposed to or infected by a contagious disease to complete an appropriate, prescribed course of treatment, preventive medication or vaccination,\u201d the bill states. \u201cSuch person or persons shall, upon request, be afforded an opportunity to be heard.\u201d<\/p><\/blockquote>\n<p>According to the bill, an individual may be detained for up to 60 days but they may not be detained after it is determined that they are no longer contagious.<\/p>\n<blockquote><p>\u201cNotwithstanding the foregoing provisions, in no event shall any person be detained for more than sixty days without a court order authorizing such detention,\u201d the bill states. \u201cThe governor or his or her delegee shall seek further court review of such detention within ninety days following the initial court order authorizing detention and thereafter within ninety days of each subsequent court review.\u201d<\/p><\/blockquote>\n<p>Responding to widespread criticism of the bill, Perry, a Democrat, noted that earlier versions of the bill were circulated during the 2015-2016 legislative session.<\/p>\n<div class=\"Advert_desktop__1J5vD Advert_align__N0_fw address public health concerns related to the containment of the Ebola virus after it was discovered that Ebola-infected persons had entered the United States,\u201d Perry said on\u00a0<a href=\"https:\/\/twitter.com\/NNickPerry\/status\/1345797376041226241\">Twitter<\/a>, noting that the Ebola virus meant \u201calmost certain death\u201d to anyone who contracted it.<\/p>\n<blockquote><p><strong>\u201cI am an American who understands our Constitution is sacred, and provides us with the right to agree or disagree, and hold different positions on issues that may relate to our civil and constitutional rights.\u201d<\/strong><\/p>\n<p>\u201cThere is no intent, no plan, or provisions in my bill to take away, or violate any rights, or liberties that all Americans are entitled to under our Constitution, either state or federal,\u201d the assemblyman said.<\/p>\n<p><strong>\u201cI urge you all to read the bill carefully, and not accept grossly misinformed and misrepresented interpretations of this bill, even though some provisions in this bill may be applicable to the current COVID-19 pandemic.\u201d<\/strong><\/p><\/blockquote>\n<p>Perry suggested that the bill is now being actively pushed for passage because many health experts believe that the likelihood of \u201csuch a deadly pandemic\u201d that imposes a threat as severe as Ebola \u201cis still real.\u201d<\/p>\n<blockquote><p><em><strong>\u201cSomewhere in the future there maybe the need for people to be protected from a person or persons carrying a very deadly and transmittable virus, and this bill is designed to ensure that our government could lawfully act to protect all the people,\u201d\u00a0<\/strong><\/em>he explained.<\/p><\/blockquote>\n<p>Perry added that he is open to amend and \u201cimprove\u201d the bill in order to address concerns raised by critics in regard to Americans\u2019 Constitutional rights.<\/p>\n<p>___<br \/>\n<a
