SUSAN BERRY<br \/>\nBreitbart.con<\/p>\n<p class=\"subheading\">The Senate again rejected the \u201cBorn-Alive\u201d legislation, which would require babies who survive an abortion to receive the same level of care as newborns of the exact gestational age.<\/p>\n<p>Sen. Ben Sasse (R-NE) attempted to add the measure to the budget resolution bill on Thursday evening.<\/p>\n<p>Democrats Sens. This isn\u2019t about abortion; it\u2019s about human rights.\u201d<\/p>\n<p>Chairman of the Senate Pro-Life Caucus, Sen. Nevertheless, Democrats continue to show their support for infanticide\u201d:<\/p>\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-3\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?creatorScreenName=BreitbartNews&amp;dnt=true&amp;embedId=twitter-widget-3&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1337398186554617857&amp;lang=en&amp;origin=https%3A%2F%2Fwww.breitbart.com%2Fpolitics%2F2021%2F02%2F05%2Fsenate-again-rejects-bill-requiring-care-babies-survive-abortion%2F&amp;siteScreenName=BreitbartNews&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1337398186554617857\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<p>&nbsp;<\/p>\n<p>While the left frequently uses talking points that state the Born-Alive Act is not \u201cnecessary\u201d because Congress already passed the 2002 Born-Alive Infants Protection Act, or because infanticide is already illegal under homicide laws, Patrina Mosley, Family Research Council\u2019s director of Life, Culture, and Women\u2019s Advocacy,\u00a0<a class=\"x5l\" href=\"https:\/\/www.frc.org\/op-eds\/why-we-need-the-born-alive-abortion-survivors-protection-act\" target=\"_blank\" rel=\"noopener external\">addressed<\/a>\u00a0the issue in February 2020:<\/p>\n<blockquote><p>Congress did pass the 2002\u00a0<em>Born-Alive Infants Protection Act<\/em>, but that was only a\u00a0<a class=\"x5l\" href=\"https:\/\/www.congress.gov\/107\/plaws\/publ207\/PLAW-107publ207.pdf\" target=\"_blank\" rel=\"noopener external\">definitional change<\/a>\u00a0stating that all infants who survive abortion are full persons under the law. It neither required any medical care for infants born-alive nor included a provision for prosecuting anyone who failed to provide care.<\/p><\/blockquote>\n<p>Mosley also referred to the murder conviction of Philadelphia abortionist\u00a0Kermit Gosnell to make another point about homicide law:<\/p>\n<blockquote><p>Under current homicide law, there is a distinction between active and passive killing. Active killing is what happened with Pennsylvania abortionist Kermit Gosnell, when he snipped the necks and spines of infants who were, according to him, \u201cbig enough to walk him to the bus stop.\u201d Eyewitnesses who worked with Texas abortionist Douglas Karpen\u00a0<a class=\"x5l\" href=\"https:\/\/www.dailymail.co.uk\/news\/article-2325786\/Douglas-Karpen-Second-house-horrors-abortion-clinic-investigated-Texas.html\" target=\"_blank\" rel=\"noopener external\">testified<\/a>\u00a0that he regularly killed babies born alive by snipping their spinal cords, fatally injuring them with blows to the soft spot on their heads, and twisting their necks.<\/p>\n<p>Gosnell was convicted on three counts of murder under Pennsylvania homicide statue that included prosecutions for infanticide.<\/p><\/blockquote>\n<p>\u201cBut what about an abortionist that simply leaves the infant to die?\u201d Mosley asked. \u201cThe\u00a0Born-Alive Abortion Survivors Protection Act\u00a0would require an active duty physician to treat a child that needs help when he or she is born alive after an abortion. If you kill that child you will have committed murder. At present, if you leave the child to die, you\u2019re not guilty of anything.\u201d<\/p>\n<p>Melanie Israel, research associate at the Heritage Foundation, also\u00a0<a class=\"x5l\" href=\"https:\/\/www.heritage.org\/life\/report\/the-necessity-the-born-alive-abortion-survivors-protection-act\" target=\"_blank\" rel=\"noopener external\">noted<\/a>\u00a0in February 2019 that current federal policy is not sufficient to protect babies who survive a botched abortion.<\/p>\n<p>The 2002 Born-Alive Act \u201cclarifies for purposes of federal law that \u2018every infant \u2026 who is born alive at any stage of development\u2019 is a \u2018person,\u2019 regardless of the circumstances\u2014including induced abortion\u2014surrounding birth,\u201d Israel observed. \u201cBut it does not specify the obligations surrounding\u00a0duty of care\u00a0for such infants.\u201d<\/p>\n<p>In February 2019, the pro-life Susan B.
