{"id":55455,"date":"2021-03-07T19:32:27","date_gmt":"2021-03-07T23:32:27","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=55455"},"modified":"2021-03-07T19:33:34","modified_gmt":"2021-03-07T23:33:34","slug":"flashback-doj-investigates-these-four-states-for-unnecessary-care-home-deaths","status":"publish","type":"post","link":"https:\/\/stateofthenation.co\/?p=55455","title":{"rendered":"FLASHBACK: DoJ Investigates These Four States for Unnecessary Care Home Deaths"},"content":{"rendered":"<h1><strong>DOJ Seeks Data on Care Home Deaths in 4 Democrat-Led States<\/strong><\/h1>\n<p><!--more--><\/p>\n<h3>The Justice Department sent letters to governors of New York and three other Democratic-led states seeking data on whether they violated federal law by ordering public nursing homes to accept recovering COVID-19 patients from hospitals.<\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-55457\" src=\"http:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/www.usnews-1.jpg\" alt=\"\" width=\"970\" height=\"647\" srcset=\"https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/www.usnews-1.jpg 970w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/www.usnews-1-300x200.jpg 300w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/www.usnews-1-768x512.jpg 768w\" sizes=\"auto, (max-width: 970px) 100vw, 970px\" \/><\/p>\n<p><span class=\"lede\">BY BERNARD CONDON,\u00a0<\/span>Associated Press<\/p>\n<p><!--more--><\/p>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>NEW YORK (AP) \u2014 The Justice Department on Wednesday sent letters to the governors of New York and three other Democratic-led states, seeking data on whether they violated federal law by ordering public nursing homes to accept recovering COVID-19 patients from hospitals \u2014 actions that have been criticized for potentially fueling the spread of the virus.<\/p>\n<p>Prosecutors said the fact-finding letters also sent to New Jersey, Pennsylvania and Michigan were aimed at determining whether the orders \u201cmay have resulted in the deaths of thousands of elderly nursing home residents.\u201d<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>\u201cWe must ensure they are adequately cared for with dignity and respect and not unnecessarily put at risk,&#8221; Assistant Attorney General for Civil Rights Division Eric Dreiband said.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>Pennsylvania Gov. Tom Wolf said his office was reviewing the request. Spokespeople for New York Gov. Andrew Cuomo, Michigan Gov. Gretchen Whitmer and New Jersey Gov. Phil Murphy said the fact that all the states are led by Democrats and the timing of the move \u2014 in the midst of the Republican National Convention \u2014 spoke volumes about the political nature of the inquiry.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>\u201cAmericans would all be better served if the Trump administration stopped the partisan games and focused on delivering a real plan to defeat COVID-19,\u201d said Whitmer spokesperson Tiffany Brown.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>The governors&#8217; actions at the height of the pandemic were designed to ensure hospitals had enough bed space for the most serious COVID cases, but were almost immediately criticized by nursing homes and relatives for potentially putting frail, elderly care home residents at risk.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>The New York order issued March 25, for example, specifically told homes they could not refuse to accept recovering COVID-19 patients from hospitals as long as the patients were \u201cmedically stable.\u201d The order barred homes from even testing such patients to see if they still had the virus. Some homes said they feared they would lose their licenses if they didn&#8217;t comply.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>Cuomo, who said the state was following guidelines from the federal Centers for Disease Control and Prevention, reversed the order under pressure May 10, long after New York\u2019s death toll in care homes had climbed to among the nation&#8217;s highest.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>Long-term care facilities represent less than 1% of the U.S. population, but they account for 42% of the COVID-19 deaths, with more than 70,000 fatalities reported by the COVID Tracking Project.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>In its statement announcing its request for data, the Justice Department said that hospital patients were sent \u201coften without adequate testing\u201d to ensure they would not spread the virus to residents. It also cited federal data showing New York, with nearly 32,600 dead, leads the nation in COVID-19 deaths, and is second only to New Jersey in the number of deaths per population.<\/p>\n<p>The Justice Department\u2019s civil rights division said it is evaluating whether to initiate investigations under a federal law called the Civil Rights of Institutionalized Persons Act that protects the rights of people in nursing homes and other facilities.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>The law applies only to nursing homes owned or run by the states. Most nursing homes are privately owned.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>The news was welcomed by Republican lawmakers, including U.S. Rep. Steve Scalise of Louisiana, who is pursuing a congressional inquiry into Cuomo\u2019s handling of nursing homes. Scalise called Wednesday\u2019s announcement \u201cthe right step toward holding Gov. Cuomo and other Democratic governors accountable for issuing deadly \u2018must admit\u2019 orders at nursing homes.\u201d<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>\u201cThese orders resulted in the deaths of tens of thousands of nursing home patients,\u201d he said. \u201cOur nation\u2019s seniors and their loved ones deserve better.&#8221;<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>The Society for Post-Acute and Long-Term Care Medicine, known as AMDA, warned at the time that Cuomo&#8217;s March 25 order posed a \u201cclear and present danger.\u201d<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>\u201cOur concern was we were making decisions in a very hasty way when the hospitals were overcapacity,\u201d Alex Bardakh, the group&#8217;s director of public policy and advocacy, said Wednesday. \u201cDecisions were being made so quickly that they weren\u2019t considering ramifications.\u201d<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>___<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>Associated Press reporters Michael Balsamo in Washington; Jim Mustian in New York; Marina Villeneuve in Albany, New York; David Eggert in Lansing, Michigan, and Mike Catalini in Trenton, New Jersey, contributed to this report.<\/p>\n<\/div>\n<div class=\"Raw-slyvem-0 jsKuwX\">\n<p>Copyright 2020 The\u00a0<a href=\"http:\/\/www.ap.org\/\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>.
