Kamala Harris to serve as vice president is now docketed at the U.S. District Court for the District of Columbia.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Filed by Robert C. Laity of New York State pro se, the suit names Harris as defendant and is assigned to Judge Emmet G. Sullivan, the jurist presiding over the ongoing case of <a class=\"external\" href=\"https:\/\/www.justice.gov\/file\/1015126\/download\" target=\"_blank\" rel=\"noopener\"><em>USA v. Michael T. Flynn<\/em><\/a>.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">The cover sheet, consisting of two pages and completed on August 31, indicates that Laity cited as the suit\u2019s \u201cCause of Action,\u201d \u201cArticle II, Sec. 1, Clause 5 &amp; 12th Amendment, USConst. requires a President and VP to be \u2018Natural Born Citizens&#8217;\u201d.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Page 4 of the suit states that the definition of \u201cnatural born Citizen\u201d is \u201cborn in the United States to parents who were both U.S. Citizens themselves.\u201d<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Laity noted the matter to be one of \u201ccivil rights\u201d associated with \u201cVoting\u201d and did not request a jury trial.\u00a0 Page 2 claims that Harris is \u201cattempting to usurp the Vice-Presidency and\/or the Presidency of the United States, by fraud, during a time when this nation is at war with other nations.\u201d<\/p>\n<p data-amp-original-style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-56151 size-large\" src=\"http:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-2-768x1056-1-745x1024.jpg\" alt=\"\" width=\"640\" height=\"880\" srcset=\"https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-2-768x1056-1-745x1024.jpg 745w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-2-768x1056-1-218x300.jpg 218w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-2-768x1056-1.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p>&nbsp;<\/p>\n<hr \/>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-56150\" src=\"http:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-3-768x1056-1-745x1024.jpg\" alt=\"\" width=\"640\" height=\"880\" srcset=\"https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-3-768x1056-1-745x1024.jpg 745w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-3-768x1056-1-218x300.jpg 218w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Scan_20200913-3-768x1056-1.jpg 768w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p>The complaint can be read here:\u00a0 <a href=\"https:\/\/www.thepostemail.com\/wp-content\/uploads\/2020\/09\/6738187-0-17479.pdf\">6738187-0\u201317479<\/a><\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">In addition to the \u201cnatural born Citizen\u201d requirement, Laity wrote in the suit, \u201c\u2026the 12th Amendment requires that a Vice-President of the United States also be eligible to the Office of the Presidency., that he\/she be also a \u201cNatural Born Citizen\u201d of the United States of America\u2026\u201d (p. 2).<\/p>\n<p>The <a class=\"external\" href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-12\/\" target=\"_blank\" rel=\"noopener\">12th Amendment<\/a> reads, in pertinent part:<\/p>\n<p class=\"amp-wp-708c5f1\" data-amp-original-style=\"padding-left: 40px; text-align: justify;\">\u2026But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">In an email Sunday morning, Laity told The Post &amp; Email, \u201cI spoke with the Clerk of the Court on Friday.\u00a0 I am arranging for service of the Summons and Complaint on Senator Kamala Harris, AGUS William Barr and Michael R. Sherwin, U.S. Attorney for D.C. as required by law.\u00a0 They will then have (60) days to Answer the Complaint.\u201d<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Shortly after her nomination was announced by Democratic presidential candidate Joe Biden last month, Harris\u2019s eligibility as a \u201cnatural born Citizen\u201d was challenged publicly, including in at least one <a class=\"external\" href=\"https:\/\/www.newsweek.com\/some-questions-kamala-harris-about-eligibility-opinion-1524483\" target=\"_blank\" rel=\"noopener\">mainstream<\/a> publication.\u00a0 The question arises, wrote Chapman University Professor of Law John Eastman at <em>Newsweek<\/em>, from the fact that Harris\u2019s parents may not have been \u201csubject to the jurisdiction\u201d of the United States when she was born in Oakland, CA on October 20, 1964 given their respective foreign citizenship at the time. <a class=\"external\" href=\"https:\/\/www.nbcnews.com\/nightly-news\/video\/trump-fuels-baseless-birther-theory-about-kamala-harris-90091077686\" target=\"_blank\" rel=\"noopener\">Some<\/a> in the media reacted by attempting to portray questions about Harris\u2019s constitutional eligibility as a \u201cracist birther conspiracy,\u201d while others <a class=\"external\" href=\"https:\/\/www.usatoday.com\/story\/news\/factcheck\/2020\/08\/11\/fact-check-kamala-harris-citizen-eligible-serve-president\/3344836001\/\" target=\"_blank\" rel=\"noopener\">declared<\/a> Harris unequivocally eligible.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">While the Framers mandated that the president and commander-in-chief be a \u201cnatural born Citizen,\u201d they did not define the term. Historical references in the Congressional Globe and at least four U.S. Supreme Court cases, including <a class=\"external\" href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/88\/162\" target=\"_blank\" rel=\"noopener\"><em>Minor v. Happersett<\/em><\/a> cited by Laity on page 3 of the complaint, indicate that a person born in the country to parents owing no other allegiance than to the United States was \u201cno doubt\u201d a natural born Citizen, while as to those born within the United States to non-citizen parents, there remained uncertainty.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">In January of last year, Harris announced her presidential candidacy but <a class=\"external\" href=\"https:\/\/www.cnbc.com\/2019\/12\/03\/kamala-harris-drops-out-of-2020-presidential-race.html\" target=\"_blank\" rel=\"noopener\">withdrew<\/a> from the race at the end of the year, citing a lack of funds. On the September 13, 2020 edition of \u201c<a class=\"external\" href=\"https:\/\/www.foxnews.com\/shows\/sunday-morning-futures\" target=\"_blank\" rel=\"noopener\">Sunday Morning Futures<\/a>,\u201d Rep. Devin Nunes (<a class=\"external\" href=\"https:\/\/nunes.house.gov\/\" target=\"_blank\" rel=\"noopener\">R-CA22<\/a>) claimed that Harris was Barack Hussein Obama\u2019s choice for the Democratic presidential nominee, a preference carrying over to Biden\u2019s nomination of her as his running mate on <a class=\"external\" href=\"https:\/\/www.usatoday.com\/story\/news\/factcheck\/2020\/08\/11\/fact-check-kamala-harris-citizen-eligible-serve-president\/3344836001\/\" target=\"_blank\" rel=\"noopener\">August 11<\/a>.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Nunes further said that should Biden, who many believe has been exhibiting signs of cognitive decline, be unable to finish his first term if elected, Harris would become the next President of the United States.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Like Harris, Obama\u2019s eligibility to serve as president was questioned beginning in 2007 when credible media reports stated that he was born in Indonesia or Kenya and not Hawaii, as he claimed. In 2012, as Obama sought reelection, Breitbart News <a class=\"external\" href=\"https:\/\/www.breitbart.com\/politics\/2012\/05\/17\/The-Vetting-Barack-Obama-Literary-Agent-1991-Born-in-Kenya-Raised-Indonesia-Hawaii\/\" target=\"_blank\" rel=\"noopener\">located<\/a> a 1991 promotional brochure produced by his then-literary agent stating that Obama was \u201cborn in Kenya and raised in Indonesia and Hawaii.\u201d<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">The biography, which stood unchanged for approximately 16 years, was altered in 2007, shortly after he declared himself a presidential candidate, to say that Obama was \u201cborn in Hawaii.\u201d<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">There remains doubt as to Obama\u2019s eligibility given that his claimed father was never a U.S. citizen as well as the fact that a 5+-year criminal investigation determined his \u201c<a class=\"external\" href=\"https:\/\/obamawhitehouse.archives.gov\/sites\/default\/files\/rss_viewer\/birth-certificate-long-form.pdf\" target=\"_blank\" rel=\"noopener\">long-form<\/a>\u201d birth certificate, purportedly held by the State of Hawaii and released publicly on April 27, 2011, is a \u201c<a class=\"external\" href=\"https:\/\/www.youtube.com\/watch?v=jk3KRxTfkLM\" target=\"_blank\" rel=\"noopener\">computer-generated forgery<\/a>.\u201d<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Neither Congress nor the U.S. Justice Department has addressed the claims generated from the probe, which was conducted by former police detective and private investigator Mike Zullo under the authority of the Maricopa County, AZ Sheriff\u2019s Office (MCSO).<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">According to <a href=\"https:\/\/www.thepostemail.com\/2018\/08\/19\/is-kamala-harris-eligible-to-be-president\/\">Zullo<\/a> in August 2018, citing two U.S. intelligence agents, \u201cIt\u2019s been <a href=\"https:\/\/www.thepostemail.com\/2018\/08\/18\/mike-zullo-connects-former-intelligence-officials-to-obama-birth-certificate-phony-narrative\/\">an open secret<\/a>\u201d in Washington, DC that Obama could never satisfy the constitutional requirement of being born on American soil.\u201d<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">In April 2008, the U.S. Senate passed <a class=\"external\" href=\"https:\/\/www.congress.gov\/bill\/110th-congress\/senate-resolution\/511\/text\" target=\"_blank\" rel=\"noopener\">Resolution 511<\/a>, with Obama and then-Democratic presidential contender Sen. Hillary Clinton voting in favor, stating that Republican presidential candidate <a class=\"external\" href=\"https:\/\/www.congress.gov\/bill\/110th-congress\/senate-resolution\/511\/text\" target=\"_blank\" rel=\"noopener\">John McCain<\/a> was a natural born Citizen.\u00a0 McCain was born outside of the United States to two U.S.-citizen parents, one of whom was an admiral in the Navy stationed in Panama.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">In 2015, days after Texas Sen. Ted Cruz (R) announced he would seek the presidency, former Solicitors General Neal Katyal and Paul Clement published an <a class=\"external\" href=\"https:\/\/harvardlawreview.org\/2015\/03\/on-the-meaning-of-natural-born-citizen\/\" target=\"_blank\" rel=\"noopener\">essay<\/a> in the <em>Harvard Law Review<\/em> claiming that, although born in Canada to a non-U.S. citizen father, Cruz was a \u201cnatural born Citizen\u201d of of the United States by virtue of his mother\u2019s American citizenship.\u00a0 The year prior, Cruz <a href=\"https:\/\/www.thepostemail.com\/2017\/07\/12\/exclusive-u-s-government-considers-citizenship-sitting-u-s-senator-private\/\">renounced<\/a> the Canadian citizenship bestowed upon him at birth after claiming to have been unaware of it.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Harris\u2019s Senate office did not respond to questions from constituent <a href=\"https:\/\/www.thepostemail.com\/2017\/12\/04\/california-constituent-sen-kamala-harris-not-natural-born-citizen\/\">Gary Wilmott<\/a> nor to those posed by this publication when asked in 2017 and 2018, respectively, about her parents\u2019 citizenship status as <a class=\"external\" href=\"https:\/\/www.presstelegram.com\/2018\/08\/15\/san-franciscos-decline-could-hurt-kamala-harris-presidential-ambitions\/\" target=\"_blank\" rel=\"noopener\">rumors<\/a> about her plans to seek the presidency swirled world in various political circles.<\/p>\n<p class=\"amp-wp-7d27179\" data-amp-original-style=\"text-align: justify;\">Despite a number of lawsuits reaching its chambers during the last 12 years, the U.S. Supreme Court has declined to rule on the meaning of \u201cnatural born Citizen.\u201d\u00a0 According to Associate Justice Clarence Thomas in 2010, the high court was \u201c<a class=\"external\" href=\"https:\/\/www.wnd.com\/2010\/04\/142101\/\" target=\"_blank\" rel=\"noopener\">evading the issue<\/a>.\u201d<\/p>\n<p>Under \u201cRelief Sought\u201d on page 7, Laity wrote:<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-56149\" src=\"http:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Laity-v-Harris-p7-Relief-Sought.jpg\" alt=\"\" width=\"830\" height=\"674\" srcset=\"https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Laity-v-Harris-p7-Relief-Sought.jpg 830w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Laity-v-Harris-p7-Relief-Sought-300x244.jpg 300w, https:\/\/stateofthenation.co\/wp-content\/uploads\/2021\/03\/Laity-v-Harris-p7-Relief-Sought-768x624.jpg 768w\" sizes=\"auto, (max-width: 830px) 100vw, 830px\" \/><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<p>___<br \/>\n<a href=\"https:\/\/www.thepostemail.com\/2020\/09\/13\/harris-eligibility-suit-docketed-in-federal-court\/\">https:\/\/www.thepostemail.com\/2020\/09\/13\/harris-eligibility-suit-docketed-in-federal-court\/<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Harris Eligibility Suit Docketed in Federal Court<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-56147","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"_links":{"self":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts\/56147","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=56147"}],"version-history":[{"count":0,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts\/56147\/revisions"}],"wp:attachment":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=56147"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=56147"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=56147"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
