{"id":58799,"date":"2021-04-02T16:40:06","date_gmt":"2021-04-02T20:40:06","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=58799"},"modified":"2021-04-02T16:40:06","modified_gmt":"2021-04-02T20:40:06","slug":"new-york-city-reaches-peak-stupid-with-lawsuit-against-supermajors","status":"publish","type":"post","link":"https:\/\/stateofthenation.co\/?p=58799","title":{"rendered":"New York City Reaches &#8220;Peak Stupid&#8221; with Lawsuit Against Supermajors"},"content":{"rendered":"<h1>Big Oil Beats NYC Appeal On Climate Change Lawsuit<\/h1>\n<p><!--more-->by Charles Kennedy<br \/>\nOilPrice.com<\/p>\n<p><strong>A federal appeals court on Thursday\u00a0<a href=\"https:\/\/www.ca2.uscourts.gov\/decisions\/isysquery\/d41529ae-15b7-4818-9847-7e2fd4421114\/1\/doc\/18-2188_opn.pdf#xml=https:\/\/www.ca2.uscourts.gov\/decisions\/isysquery\/d41529ae-15b7-4818-9847-7e2fd4421114\/1\/hilite\/\">ruled in favor<\/a>\u00a0of five of the world\u2019s biggest oil companies<\/strong>\u00a0in an appeal over a climate lawsuit that New York City was seeking re-opened.<\/p>\n<p>The United States Court of Appeals for the Second Circuit<strong>\u00a0ruled that New York City can\u2019t hold the five firms &#8211; Exxon, Chevron, ConocoPhillips, BP, and Shell &#8211; responsible for damages caused by global warming\u00a0<\/strong>under New York tort law.<\/p>\n<p><strong>The city sued the five companies in 2018,<\/strong>\u00a0and then a federal district judge also\u00a0<a href=\"https:\/\/www.cnbc.com\/2018\/07\/19\/judge-tosses-nycs-climate-change-lawsuit-against-5-big-oil-companies.html\">dismissed<\/a>\u00a0NYC\u2019s lawsuit arguing that problems pertaining to climate change should be tackled by Congress and the executive branch.<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/2021-04-01_fxhy5orcrj.jpg?itok=rARPaS50\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/2021-04-01_fxhy5orcrj.jpg?itok=rARPaS50\" data-link-option=\"0\"><picture><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/zh-prod-1cc738ca-7d3b-4a72-b792-20bd8d8fa069.storage.googleapis.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/2021-04-01_fxhy5orcrj.jpg?itok=rARPaS50\" alt=\"\" width=\"500\" height=\"209\" data-entity-type=\"file\" data-entity-uuid=\"8321c18a-f1ad-468b-b2f8-f69f252a5f31\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p>In today\u2019s ruling, in which NYC\u2019s appeal was dismissed again, the court judges said \u201cWe affirm for substantially the same reasons as those articulated in the district court\u2019s opinion.\u201d<\/p>\n<blockquote><p><strong>\u201cGlobal warming presents a uniquely international problem of national concern. It is therefore not well-suited to the application of state law,\u201d\u00a0<\/strong>U.S. Circuit Court Judge Richard J. Sullivan wrote in Thursday\u2019s ruling.<\/p>\n<p>\u201cThe City of New York has sidestepped those procedures and instead instituted a state-law tort suit against five oil companies to recover damages caused by those companies\u2019 admittedly legal commercial conduct in producing and selling fossil fuels around the world.
