He is the\u00a0<strong>first person to face sentencing for an Espionage Act offense during the admnistration of President Joe Biden<\/strong>.<\/p>\n<p>As vice president under President Barack Obama, Biden\u00a0<a href=\"https:\/\/whistleblowersblog.org\/2021\/01\/articles\/government-whistleblowers\/biden-and-harris-histories-on-whistleblowing\/\">contributed<\/a>\u00a0to the creation of whistleblower protections in the Dodd-Frank Wall Street Reform and Consumer Protection Act, while simultaneously serving in an administration that, while\u00a0<a href=\"https:\/\/www.justice.gov\/oip\/blog\/foia-post-2009-creating-new-era-open-government\">promising<\/a>\u00a0&#8220;a new era of open government,&#8221;\u00a0<strong>relentlessly targeted individuals who revealed US\u00a0war crimes and other classified information<\/strong>.<\/p>\n<p>Kiriakou\u2014a former CIA agent who under Obama was\u00a0<a href=\"https:\/\/www.washingtonpost.com\/local\/former-cia-officer-john-kiriakou-sentenced-to-30-months-in-prison-for-leaks\/2013\/01\/25\/49ea0cc0-6704-11e2-9e1b-07db1d2ccd5b_story.html\">sentenced<\/a>\u00a0to 30 months&#8217; imprisonment for\u00a0<a href=\"https:\/\/www.csmonitor.com\/World\/terrorism-security\/2009\/0420\/p99s01-duts.html\">exposing<\/a>\u00a0US\u00a0torture\u2014<a href=\"https:\/\/dissenter.substack.com\/p\/daniel-hale-whistleblower-guilty-plea\">told<\/a>\u00a0Kevin Gosztola that he is\u00a0<strong>&#8220;dissappointed that Daniel Hale&#8217;s case was continued in the Biden Justice Department.&#8221;<\/strong><\/p>\n<p>&#8220;I had hopes that Biden&#8217;s Justice Department appointee would recognize the public service that Daniel Hale provided when he revealed illegality and abuse in the drone program,&#8221; said Kiriakou.<\/p>\n<p>Hale, who was an intelligence analyst for the US\u00a0Air Force before moving on to the National Security Agency and then the National Geospatial-Intelligence Agency,\u00a0<em>&#8220;knowingly took highly classified documents and disclosed them without authorization, thereby violating his solemn obligations to our country,&#8221;<\/em>\u00a0according to a\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/former-intelligence-analyst-pleads-guilty-disclosing-classified-information\">statement<\/a>\u00a0from Raj Parekh, the acting U.S. attorney for the Eastern District of Virginia.<\/p>\n<div class=\"Advert_desktop__1J5vD Advert_borderTop__2PX5m Advert_placement__1I4yb\"><\/div>\n<figure class=\"caption caption-img\" role=\"group\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/zh-prod-1cc738ca-7d3b-4a72-b792-20bd8d8fa069.storage.googleapis.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/dronewar.jpg?itok=d-ZlQLfv\" alt=\"\" width=\"500\" height=\"278\" data-entity-type=\"file\" data-entity-uuid=\"751fe2a6-1305-48fa-a6eb-75a371895698\" data-responsive-image-style=\"inline_images\" \/><figcaption><em>US Air Force image<\/em><\/figcaption><\/figure>\n<p>According to Gosztola, Hale&#8217;s whistleblowing led to the\u00a0<a href=\"https:\/\/theintercept.com\/2014\/08\/05\/watch-commander\/\">revelation<\/a>\u00a0by\u00a0<em>The Intercept<\/em>\u00a0that\u00a0<strong>&#8220;nearly half of the people on the U.S. government&#8217;s widely shared database of terrorist suspects are not connected to any known terrorist group,&#8221;<\/strong>\u00a0<a href=\"https:\/\/theintercept.com\/drone-papers\/find-fix-finish\/\">details<\/a>\u00a0on how the Obama administration approved targeted assassinations, and\u00a0<a href=\"https:\/\/theintercept.com\/drone-papers\/the-assassination-complex\/\">information<\/a>\u00a0about Bilal el-Berjawi, a Briton &#8220;who was stripped of his citizenship before being killed in a U.S. drone strike in 2012.&#8221;<\/p>\n<p>The\u00a0<em>Post<\/em>\u00a0reports that Hale admitted in court to writing an anonymous chapter in Scahill&#8217;s 2016 book,\u00a0<em><a href=\"https:\/\/www.simonandschuster.com\/books\/The-Assassination-Complex\/Jeremy-Scahill\/9781501144141\">The Assassination Complex: Inside the Government&#8217;s Secret Drone Warfare Program<\/a>,\u00a0<\/em>which divulged information taken from top-secret documents about drone strike protocols, civilian casualties, and Pentagon officials&#8217; debate about the accuracy of intelligence.<\/p>\n<p><strong>&#8220;These documents detailed a secret, unaccountable process for targeting and killing people around the world, including US\u00a0citizens, through drone strikes,&#8221;<\/strong>\u00a0Betsy Reed, editor-in-chief of\u00a0<em>The Intercept<\/em>,\u00a0<a href=\"https:\/\/theintercept.com\/2019\/05\/09\/statement-on-the-indictment-of-alleged-drone-strike-whistleblower\/\">said<\/a>\u00a0after Hale&#8217;s indictment. &#8220;They are of vital public importance, and activity related to their disclosure is protected by the First Amendment.&#8221;<\/p>\n<p>Hale had initially centered his defense on First Amendment grounds, and his numerous defenders condemned his prosecution as a violation of press freedom and freedom of speech. His lawyer, Jesselyn Radack, issued a\u00a0<a href=\"https:\/\/whisper.exposefacts.org\/statement-on-daniel-hales-pleading\/\">statement<\/a>\u00a0saying &#8220;the U.S. government&#8217;s policy of punishing people who provide journalists with information in the public interest is a profound threat to free speech, free press, and a healthy democracy.&#8221;<\/p>\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-0\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/Tweet.html?dnt=false&amp;embedId=twitter-widget-0&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1377799037479313410&amp;lang=en&amp;origin=https%3A%2F%2Fwww.zerohedge.com%2Fpolitical%2Fdrone-whistleblower-case-be-first-espionage-act-conviction-biden-presidency&amp;siteScreenName=zerohedge&amp;theme=light&amp;widgetsVersion=e1ffbdb%3A1614796141937&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1377799037479313410\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<p>&#8220;Classified information is published in the press every day; in fact, the biggest leaker of classified information is the US\u00a0government,&#8221; wrote Radack.\u00a0<strong>&#8220;However, the Espionage Act is used uniquely to punish those sources who give journalists information that embarrasses the government or exposes its lies.&#8221;<\/strong><\/p>\n<p>&#8220;Every whistleblower jailed under the Espionage Act is a threat to the work of national security journalists and the sources they rely upon to hold the government accountable,&#8221; she added.<\/p>\n<p>Medea Benjamin, co-founder of the women-led peace group CodePink,\u00a0<a href=\"https:\/\/twitter.com\/medeabenjamin\/status\/1377643945296023552\">tweeted<\/a>\u00a0that it&#8217;s &#8220;outrageous that drone whistleblower Daniel Hale will be going to prison for exposing the drone murders by the U.S. military. Why don&#8217;t the murderers go to jail? Or the ones who ok the murders?
