{"id":67015,"date":"2021-05-28T18:13:17","date_gmt":"2021-05-28T22:13:17","guid":{"rendered":"http:\/\/stateofthenation.co\/?p=67015"},"modified":"2021-05-28T18:13:17","modified_gmt":"2021-05-28T22:13:17","slug":"the-public-must-be-given-the-opportunity-to-question-why-california-is-returning-murders-child-molesters-and-rapists-back-into-our-neighborhoods","status":"publish","type":"post","link":"https:\/\/stateofthenation.co\/?p=67015","title":{"rendered":"&#8220;The public must be given the opportunity to question why California is returning murders, child molesters, and rapists back into our neighborhoods"},"content":{"rendered":"<h1>Orange County DA Joins Opposition To Early Release Of 76,000 Prisoners<\/h1>\n<p><!--more-->by Vanessa Serna<br \/>\nThe Epoch Times<\/p>\n<p><a href=\"https:\/\/www.theepochtimes.com\/t-orange-county-district-attorney\">Orange County District Attorney<\/a>\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-todd-spitzer\">Todd Spitzer<\/a>\u00a0joined 43\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-california\">California<\/a>\u00a0counties\u00a0on May 26\u00a0in filing a civil lawsuit against the early release of 76,000 state\u00a0inmates.<\/p>\n<blockquote><p><em><strong>\u201cIt is my job as district attorney to keep Orange County safe,\u201d<\/strong><\/em>\u00a0Spitzer said in a press release.<\/p>\n<p>\u201c<strong>The public must be given the opportunity to question why the California Department of Corrections and Rehabilitation would decide that returning murders, child molesters, and rapists back into our neighborhoods more quickly somehow constitutes an emergency<\/strong>.\u201d<\/p><\/blockquote>\n<p>The lawsuit\u00a0filed in Sacramento Superior Court\u00a0is intended to invalidate emergency regulations by the California Department of Corrections and Rehabilitation (CDCR) to release state prisoners that receive credit for good behavior.<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/GettyImages-654263522-700x420_0.jpg?itok=chQYuXJF\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/GettyImages-654263522-700x420_0.jpg?itok=chQYuXJF\" data-link-option=\"0\"><picture><img loading=\"lazy\" decoding=\"async\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/GettyImages-654263522-700x420_0.jpg?itok=chQYuXJF\" alt=\"\" width=\"500\" height=\"300\" data-entity-type=\"file\" data-entity-uuid=\"d23f1c50-7d67-4c07-9086-872546c5d6b5\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p>The\u00a0CDCR\u00a0<a href=\"https:\/\/www.cdcr.ca.gov\/proposition57\/\">said<\/a>\u00a0it would begin increasing the good conduct credit (GCC) rate for eligible inmates on May 1, affording them an opportunity for early release.<\/p>\n<p>Approved by\u00a0the California Office of Administrative Law, the move comes as the state looks to\u00a0increase good behavior incentives of those incarcerated\u00a0by allowing a reduction of prison time\u00a0for the well-behaved.<\/p>\n<p>Of those eligible, 63,000\u00a0inmates currently incarcerated due to violent crimes will be able to attain \u201cgood behavior credits\u201d\u00a0that will allow them to reduce sentences by one-third.\u00a0The figure includes 20,000 inmates sentenced to life in prison with the possibility of parole.<\/p>\n<p><strong>Prior to the\u00a0new rule becoming effective, good behavior credits only granted a one-fifth reduction of prison sentences.<\/strong><\/p>\n<p>The new law would also allow 10,000\u00a0inmates who are imprisoned for a\u00a0second nonviolent\u00a0offense under California\u2019s three-strikes law to have their sentences\u00a0reduced to one-half instead of one-third. Another 2,900 inmates who were convicted of a third nonviolent strike\u00a0will get similar reductions.\u00a0In essence, the\u00a0inmates will receive one day of credit for every\u00a0day served.<\/p>\n<p>CDCR spokesperson Vicky Waters has said the new measures won\u2019t result in the automatic release of any inmate.<\/p>\n<blockquote><p>\u201cUnder the statute, incarcerated individuals are able to receive credits for good behavior and participation in the rehabilitation program,\u201d Waters told The Epoch Times. \u201cProposition 57, which voters overwhelmingly approved in 2016 and upheld in November, gave the California Department of Corrections and Rehabilitation the authority to submit regulations to provide additional opportunities for incarcerated people to receive these good conduct credits.<\/p>\n<p>\u201cThis effort incentivizes incarcerated individuals to have sustained good behavior and encourages them to participate in rehabilitative and educational programs, which can help reduce recidivism to make our communities safer.
