EUA Vaccines CANNOT Be Mandated!"},"content":{"rendered":"<h1><strong>117 Employees File Lawsuit Against Texas Hospital For Mandating COVID-19 Vaccine<\/strong><\/h1>\n<p><!--more-->By Jack Phillips<br \/>\nThe Epoch Times<\/p>\n<p>More than 100\u00a0employees at Houston Methodist Hospital filed a lawsuit against their employer for requiring all staff members to receive a COVID-19 vaccine in order to keep their jobs.<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/VACCINES-BOOSTERS-700x420.jpg?itok=V_6LvnGd\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/VACCINES-BOOSTERS-700x420.jpg?itok=V_6LvnGd\" data-link-option=\"0\"><picture><img loading=\"lazy\" decoding=\"async\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/VACCINES-BOOSTERS-700x420.jpg?itok=V_6LvnGd\" alt=\"\" width=\"500\" height=\"300\" data-entity-type=\"file\" data-entity-uuid=\"392a6bed-e614-4ae8-a98f-af7a05de0738\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p>Saying the COVID-19 vaccines are\u00a0<strong>experimental and they don\u2019t want to be \u201cguinea pigs,\u201d<\/strong>\u00a0the 117 employees argued in court that it\u2019s unlawful for their employers to require them to take the shots.<\/p>\n<blockquote><p><strong>\u201cMethodist Hospital is forcing its employees to be human \u2018guinea pigs\u2019 as a condition for continued employment,\u201d their\u00a0<a href=\"https:\/\/assets.documentcloud.org\/documents\/20793442\/nurses-v-methodist-hospital-houston-texas-covid-vaccine-mandate.pdf\">lawsuit (pdf) states<\/a>.\u00a0<\/strong>They wrote that the hospital\u2019s COVID-19 vaccination mandate\u00a0\u201crequires the employee to subject themselves to medical experimentation as a prerequisite to feeding their families.\u201d<\/p><\/blockquote>\n<p>They took issue receiving \u201cexperimental COVID-19 mRNA\u201d vaccines such as ones made by Pfizer and Moderna.<\/p>\n<blockquote><p><em><strong>\u201cFor the first time in the history of the United States, an employer is forcing an employee to participate in an experimental vaccine trial as a condition for continued employment,\u201d\u00a0<\/strong><\/em>the lawsuit states.<\/p><\/blockquote>\n<p>The plaintiffs cited a letter\u2014included in the lawsuit\u2014from the\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-ceo\">CEO<\/a>\u00a0and president of Houston Methodist, Marc Boom, who allegedly directed employees to \u201cplease see the HR policy that outlines the consequences of not being compliant by June 7, which include suspension and eventually termination.\u201d<\/p>\n<p>Meanwhile, at the top of the lawsuit, an alleged quote from\u00a0David Bernard, a CEO of a Houston Methodist branch, was included. Bernard purportedly told an employee that \u201c100 percent vaccination is more important than your individual freedom. \u2026\u00a0Everyone [sic] of you is replaceable. If you don\u2019t like what your [sic] doing you can leave and we will replace your spot.\u201d<\/p>\n<p><strong>A spokesperson for Houston Methodist disputed the quote in a statement to The Epoch Times, saying on May 30 that Bernard \u201cdid NOT say that to this disgruntled employee,\u201d and he \u201chas respect for all his employees\u2014we are a values-based organization with respect as one of our core values.\u201d The spokesperson did not comment on the letter from Boom.<\/strong><\/p>\n<p>The lawsuit also asserted that employers\u2019 mandating COVID-19 vaccines is problematic because \u201cthere is much\u201d the Food and Drug Administration (FDA) \u201cdoes not know about these products\u00a0even as it authorizes them for emergency use,\u00a0including their effectiveness against infection, death, and transmission of SARS-CoV-2, the virus that is allegedly the cause of the COVID disease.\u201d The FDA approved an emergency use authorization for the vaccines made by\u00a0<a href=\"https:\/\/www.theepochtimes.com\/fda-authorizes-moderna-covid-19-vaccine-for-emergency-use_3625207.html\">Moderna<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.theepochtimes.com\/moderna-covid-19-vaccine-passed-by-fda-advisory-panel-for-emergency-use_3623568.html\">Pfizer<\/a>\u00a0in December 2020 and gave the emergency authorization for Johnson &amp; Johnson\u2019s vaccine in early 2021.<\/p>\n<p>The lawsuit was filed by Jared Woodfill, a Houston-area attorney, who told ABC News that\u00a0<strong>the Houston Methodist mandate violates the\u00a0Nuremberg Code of 1947, written after the fall of the Nazi regime in Germany.<\/strong><\/p>\n<blockquote><p>\u201cTo promote its business and increase profits at the expense of other health care providers and their employees\u2019 health, defendants advertise to the public that they \u2018require all employees and employed physicians to get a COVID-19 vaccine.\u2019\u00a0More clearly, defendants\u2019 employees are being forced to serve as human \u2018guinea pigs\u2019 to increase defendants\u2019 profits,\u201d Woodfill said, adding that it is a \u201csevere and blatant\u201d violation of Texas law and the\u00a0<a href=\"https:\/\/media.tghn.org\/medialibrary\/2011\/04\/BMJ_No_7070_Volume_313_The_Nuremberg_Code.pdf\">Nuremberg Code<\/a>\u2014a\u00a0set of research ethics principles relating to human experimentation.<\/p><\/blockquote>\n<p>Houston Methodist, the attorney claimed, forced employees to get the shot to \u201cpromote its business\u201d over its \u201cemployees\u2019 health.\u201d He noted that most of the plaintiffs in the suit aren\u2019t health care providers.<\/p>\n<p>Boom issued a statement after the lawsuit was filed, saying that 99 percent of the hospital\u2019s nearly 30,000 employees have received a COVID-19 vaccine.<\/p>\n<blockquote><p><strong>\u201cWe proudly stand by our employees and our mission to protect our patients.<\/strong><\/p>\n<p>\u201cIt is unfortunate that the few remaining employees who refuse to get vaccinated and put our patients first are responding in this way,\u201d Boom said, according to a spokesperson for the hospital system. \u201cIt is legal for health care institutions to mandate vaccines, as we have done with the flu vaccine since 2009.\u201d<\/p><\/blockquote>\n<p>A full legal response from Houston Methodist has yet to be filed.<\/p>\n<p>The Houston Methodist spokesperson also included a link to the federal\u00a0<a href=\"https:\/\/www.eeoc.gov\/newsroom\/eeoc-issues-updated-covid-19-technical-assistance\">Equal Employment Opportunity Commission (EEOC) on May 28 having posted<\/a>\u00a0updated guidelines that suggest employers can make employees be vaccinated.<\/p>\n<p>According to the agency\u2019s guidance issued on May 28, EEOC laws \u201cdo not prevent an employer from requiring all employees physically entering the workplace to be vaccinated for COVID-19, so long as employers comply with the reasonable accommodation provisions of the ADA and Title VII of the Civil Rights Act of 1964 and other EEO considerations.<\/p>\n<blockquote><p><strong>\u201cOther laws, not in EEOC\u2019s jurisdiction, may place additional restrictions on employers.\u201d<\/strong><\/p><\/blockquote>\n<p>The lawsuit was filed in a state court in Montgomery County, Texas, and alleges wrongful discharge as well as a violation of the at-will employment doctrine\u2019s public policy exception.<\/p>\n<p>___<br \/>\n<a href=\"https:\/\/www.zerohedge.com\/covid-19\/117-employees-file-lawsuit-against-texas-hospital-mandating-covid-19-vaccine\">https:\/\/www.zerohedge.com\/covid-19\/117-employees-file-lawsuit-against-texas-hospital-mandating-covid-19-vaccine<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>117 Employees File Lawsuit Against Texas Hospital For Mandating COVID-19 Vaccine<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-67544","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"_links":{"self":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts\/67544","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=67544"}],"version-history":[{"count":0,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=\/wp\/v2\/posts\/67544\/revisions"}],"wp:attachment":[{"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=67544"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=67544"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/stateofthenation.co\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=67544"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
