Judge Blasts DC Jail"},"content":{"rendered":"<h1>&#8220;Utterly Unacceptable&#8221;: Judge Blasts DC Jail For Not Allowing Jan. 6 Capitol Defendant Access To Evidence<\/h1>\n<p><!--more-->by Jack Phillips<br \/>\nThe Epoch Times<\/p>\n<p>A federal Washington D.C. judge faulted a district jail on Thursday for failing to provide evidence to a defendant who was arrested for allegedly being involved in the Jan. 6\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-capitol\">Capitol<\/a>\u00a0breach and has been held there for months.<\/p>\n<p><a href=\"https:\/\/www.zerohedge.com\/s3\/files\/inline-images\/stop-the-steal-1230457438-700x420.jpg?itok=BKY6NAX5\" data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/stop-the-steal-1230457438-700x420.jpg?itok=BKY6NAX5\" data-link-option=\"0\"><picture><img loading=\"lazy\" decoding=\"async\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/stop-the-steal-1230457438-700x420.jpg?itok=BKY6NAX5\" alt=\"\" width=\"500\" height=\"300\" data-entity-type=\"file\" data-entity-uuid=\"951c01b0-68ed-4f16-9fd2-3f2839ba7a25\" data-responsive-image-style=\"inline_images\" \/><\/picture><\/a><\/p>\n<p>Jorden Mink, the defendant in the case,\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/page\/file\/1357221\/download\">was indicted (pdf)<\/a>\u00a0on several federal charges, including destruction of government property and theft. Mink, who has pleaded not guilty, has been held in jail since January. Officials have alleged Mink used a baseball bat to smash windows at the Capitol and passed furniture through the smashed windows to the crowd outside.<\/p>\n<blockquote><p><strong>\u201cI can\u2019t allow someone to sit in prison for this long without access to material,\u201d\u00a0<\/strong>Judge Randolph Moss said at a court hearing on Thursday, saying\u00a0<strong>the delay in evidence was\u00a0\u201cutterly unacceptable\u201d and \u201cnot consistent with due process.\u201d<\/strong><\/p><\/blockquote>\n<p>During the Thursday court hearing, prosecutors said they had given the evidence to the jail in May and didn\u2019t understand why Mink hasn\u2019t been able to obtain the documents. Mink was offered a plea deal, prosecutors noted, but they said he can\u2019t decide on whether to accept the deal because he hasn\u2019t seen the evidence against him.<\/p>\n<p>Randolph ordered prosecutors to work with the jail to grant the defendant access to the evidence against him by the end of Thursday,\u00a0<a href=\"https:\/\/www.cnn.com\/2021\/07\/08\/politics\/judge-blasts-dc-jail-capitol-riot\/index.html\">reported CNN<\/a>. If Mink doesn\u2019t gain access to the documents soon, the judge said, his detention may be reconsidered.<\/p>\n<p>There have been other reports of Jan. 6 defendants not being able to gain access to evidence against them, essentially denying them due process under the Constitution\u2019s Fifth Amendment. Prosecutors have suggested that due to the sheer number of arrests related to the incident, there have been delays.<\/p>\n<p><strong>So far, more than 500 defendants across nearly every U.S. state have been charged over the past six months over the Jan. 6 breach,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/over-535-charged-6-months-after-jan-6-capitol-breach-doj_3890372.html\">according to the Department of Justice<\/a>\u00a0in early July.<\/strong><\/p>\n<p>It comes as\u00a0<a href=\"https:\/\/www.theepochtimes.com\/jan-6-detainees-confined-23-hours-a-day-attorneys-say_3886969.html\">lawyers earlier this month said<\/a>\u00a0that dozens of people in federal custody following the Jan. 6 incident are currently being held in solitary confinement, denied access to legal counsel, and are being denied medical care.<\/p>\n<blockquote><p><em><strong>\u201cThere are about 50 plus or minus that are being detained, that have been in prison for months and will likely remain in prison for many more months until their day in court,\u201d\u00a0<\/strong><\/em>attorney John Pierce\u00a0<a href=\"https:\/\/www.theepochtimes.com\/jan-6-detainees-confined-23-hrs-day-risking-all-for-american-dream_3885912.html\">told<\/a>\u00a0EpochTV\u2019s \u201cThe Nation Speaks.\u201d<\/p><\/blockquote>\n<p>Mink\u00a0<a href=\"https:\/\/www.pittsburghcurrent.com\/capitol-rioter-misses-court-appearance-after-contracting-coivd-in-d-c-jail\/\">was scheduled<\/a>\u00a0to appear before Randolph in April but missed the court date because he tested positive for COVID-19. His attorney, Michael Mosher, said that Mink was having difficulty gaining access to medication that he takes regularly while in jail.<\/p>\n<blockquote><p><em><strong>\u201cHe takes medications to treat those, but since coming to Virginia and DC, he\u2019s not been getting those meds as prescribed,\u201d<\/strong><\/em>\u00a0Moser told a court at the time,\u00a0<a href=\"https:\/\/www.pittsburghcurrent.com\/capitol-rioter-misses-court-appearance-after-contracting-coivd-in-d-c-jail\/\">according<\/a>\u00a0to local media.<\/p><\/blockquote>\n<p>In January, Mink was arrested at his home in Bridgeville, Pennsylvania, and was held in the Butler County Jail.
