Phillips said in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.232890\/gov.uscourts.dcd.232890.12.0.pdf\" target=\"_blank\" rel=\"noopener\">court document (pdf)<\/a> that <strong>nearly 20 cases related to the Jan. 6 incident are not proceeding after John Pierce, the lawyer, went missing.<\/strong><\/p>\n<figure class=\"caption caption-img inline-images image-style-inline-images\" role=\"group\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/jan.-6-clash-700x420.jpg?itok=UsOQkeeV\" alt=\"\" width=\"500\" height=\"300\" data-entity-type=\"file\" data-entity-uuid=\"7dc88295-c011-4bed-87f5-438623bc83a2\" data-responsive-image-style=\"inline_images\" \/><figcaption><em>Police release tear gas into a crowd during clashes at the U.S. Capitol Building in Washington on Jan. 6, 2021. (Shannon Stapleton\/Reuters)<\/em><\/figcaption><\/figure>\n<p>Pierce, according to the court filing,<strong> is \u201creportedly ill with COVID-19, on a ventilator, and unresponsive.\u201d <\/strong>Pierce\u2019s law firm associate, Ryan Marshall\u2014who is not a licensed attorney\u2014has been appearing in Pierce\u2019s place at court hearings and proceedings. Marshall also was the one who revealed Pierce\u2019s alleged hospitalization and condition, said the filing.<\/p>\n<p>The lawyer, who generally posts on Twitter several times per day, has not posted since Aug. 20.<\/p>\n<p>\u201cBecause Mr. Pierce is unavailable and Mr. Marshall cannot ethically or legally represent Mr. Pierce\u2019s clients,\u201d Phillips said, \u201cthe government is making the Court aware of Mr. Pierce\u2019s reported illness so that it can take any steps it believes necessary to ensure the defendant\u2019s rights are adequately protected while Mr. Pierce remains hospitalized.\u201d<\/p>\n<p>But later in the court filing, <strong>the U.S. attorney\u2019s office said it obtained\u00a0\u201cconflicting information about Mr. Pierce\u2019s health and whereabouts.\u201d<\/strong><\/p>\n<p>When it was revealed publicly that Pierce was hospitalized with COVID-19, a report from NPR, citing unnamed sources, said that he may have been suffering from dehydration, exhaustion, and is believed to have symptoms related to COVID-19.<\/p>\n<p>And a colleague of Pierce, Brody Womack, told <a href=\"https:\/\/www.insider.com\/17-capitol-riot-cases-paused-after-attorney-john-pierce-hospitalized-2021-8\" target=\"_blank\" rel=\"noopener\">Business Insider<\/a> that <strong>Pierce \u201cappears to have been suffering from dehydration and exhaustion in relation to his tireless work on behalf of his clients,<\/strong> including the many defendants he represents in connection with the January 6, 2021 protest at the Capitol.\u201d<\/p>\n<div class=\"Advert_tablet__3QEBr Advert_mobile__1rlLc Advert_placement__1I4yb Advert_align__N0_fw\">\n<aside id=\"in-content-1\" class=\"Advert_centered__2tRj9 Advert_verticallySpaced__wnPy3\" data-google-query-id=\"CK_x3qHG4PICFUv4KAUdPA4O5Q\">\n<div id=\"google_ads_iframe_\/21841313772,21778456762\/zerohedge\/in_content_1_0__container__\"><iframe id=\"google_ads_iframe_\/21841313772,21778456762\/zerohedge\/in_content_1_0\" title=\"3rd party ad content\" name=\"google_ads_iframe_\/21841313772,21778456762\/zerohedge\/in_content_1_0\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" sandbox=\"allow-forms allow-popups allow-popups-to-escape-sandbox allow-same-origin allow-scripts allow-top-navigation-by-user-activation\" data-google-container-id=\"4\" data-load-complete=\"true\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/aside>\n<\/div>\n<p>On Aug. 26, Marshall appeared in place of Pierce, telling a U.S. attorney\u2019s assistant that he hasn\u2019t had any contact with Pierce and adding that one of his friends \u201chad told him that Mr. Pierce was sick with COVID-19 and another had said he was not,\u201d the filing said.<\/p>\n<p>\u201cFrom the government\u2019s perspective,\u201d said Phillips\u2019 office, \u201cgiven Mr. Pierce\u2019s reported illness and the fact that Mr. Marshall is not a licensed attorney, <strong>this case is effectively at a standstill.\u201d<\/strong><\/p>\n<p>Even though Marshall \u201chas been the government\u2019s main or sole point of contact for many of the defendants represented by Mr. Pierce, the government does not believe it appropriate to continue to communicate with him in Mr. Pierce\u2019s absence, during which he would necessarily be acting without supervision by a licensed attorney,\u201d the court document said.<\/p>\n<p>Some of Pierce\u2019s clients said they are starting to become concerned.<\/p>\n<p>Paul Rae, an alleged Proud Boy from Florida who has pleaded not guilty, told <a href=\"https:\/\/abcnews.go.com\/US\/unresponsive-lawyer-jan-defendants-leaves-cases-standstill-prosecutors\/story?id=79736173\" target=\"_blank\" rel=\"noopener\">ABC News<\/a> on Monday that <strong>he is \u201ca bit concerned\u201d about the lawyer\u2019s health<\/strong> and the overall situation regarding his representation.
