Kate Brown over a COVID-19\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-vaccine-mandate\">vaccine mandate<\/a>\u00a0for state employees.<\/p>\n<figure class=\"caption caption-img inline-images image-style-inline-images\" role=\"group\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/kate%20brown.jpg?itok=8JkLh4Q3\" alt=\"\" width=\"500\" height=\"300\" data-entity-type=\"file\" data-entity-uuid=\"e5e00a40-5b11-4308-ad61-8bf7ad7b2321\" data-responsive-image-style=\"inline_images\" \/><figcaption><em>Oregon Governor Kate Brown (Getty Images)<\/em><\/figcaption><\/figure>\n<div class=\"Advert_desktop__1J5vD Advert_tablet__3QEBr Advert_mobile__1rlLc Advert_placement__1I4yb Advert_align__N0_fw\">\n<aside id=\"in-content-video\" class=\"Advert_verticallySpaced__wnPy3\">\n<div id=\"google_ads_iframe_\/21841313772,21778456762\/zerohedge\/in_content_video_0__container__\"><\/div>\n<\/aside>\n<\/div>\n<p>The plaintiffs\u2014including the Oregon Fraternal Order of Police and the Kingsley Firefighters Association\u2014argued in a\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-lawsuit\">lawsuit<\/a>\u00a0filed Friday in a Jefferson County court (<a href=\"https:\/\/www.foporegonlodge7.com\/wp-content\/uploads\/2021\/09\/Complaint-Declaratory-Judgment-CM.pdf?fbclid=IwAR3_kVGBkdzprCgKFrDVUDz1NmdEhdsMRG4gmk21-OPpSVTVltuQASbGBt8\">pdf<\/a>) that Brown\u2019s executive order violates a number of laws and want it blocked.<\/p>\n<p>\u201cPlaintiffs seek an order declaring EO No. 21-29 is unenforceable because it conflicts with Oregon statutes, would result in a common law wrongful discharge of the Plaintiffs, conflicts with the Oregon Constitution\u2019s guarantee of free expression, and conflicts with the United States Constitution guarantee of equal protection, free exercise, and due process,\u201d the complaint states.<\/p>\n<p>Brown issued an executive order (<a href=\"https:\/\/www.oregon.gov\/gov\/Documents\/executive_orders\/eo_21-29.pdf\">pdf<\/a>) on Aug. 13 that imposed a mandatory vaccine requirement on all executive branch employees. In the order, Brown said that, to date, around 70 percent of the state\u2019s executive branch employees had taken the vaccine voluntarily, prompted in part by state efforts like organizing onsite vaccine clinics and financial incentives.<\/p>\n<p>Citing the rise in COVID-19 infections and noting that both private and public employers across the United States have imposed mandates, Brown said it was time for tougher measures in Oregon.<\/p>\n<p>\u201cWith the Delta variant raging in Oregon, with the state\u2019s ability to fully return to in-person work continuing to be hampered by the risks from COVID-19, having implemented a series of incentives aimed at achieving voluntary compliance, and with full FDA approval of the COVID-19 vaccine expected within weeks, the time has come for any remaining state employees and those who work alongside them in state government to get vaccinated,\u201d she wrote in the order.<\/p>\n<p>The order gives Oregon state workers until Oct. 18 to provide proof of vaccination or face consequences that could include dismissal.<\/p>\n<p>Ten days after Brown\u2019s order, the Food and Drug Administration (FDA) gave\u00a0<a href=\"https:\/\/www.theepochtimes.com\/us-drug-regulators-approve-pfizers-covid-19-vaccine_3961021.html\">full regulatory approval<\/a>\u00a0to the Pfizer-BioNTech COVID-19 vaccine.<\/p>\n<p>The plaintiffs argued in the complaint that enforcement of the order would result in wrongful termination, and they have asked the court to declare it unlawful and block its enforcement.<\/p>\n<p>\u201cThe individual plaintiffs are Executive Branch employees \u2026 who want to exercise control over their own medical treatment and are being forced to choose between their rights privileges and liberties as citizens on the one hand and their employment, careers, and financial futures on the other,\u201d the complaint states.<\/p>\n<p>The Epoch Times has reached out to the governor\u2019s office for comment on the suit.<\/p>\n<p>Brown\u2019s spokesperson Liz Merah defended the executive order in a statement to The Associated Press.<\/p>\n<p>\u201cGiven the seriousness of the situation, employer vaccine requirements have become an important tool, and state government plays a part.
