The Biden Administration is once again flouting our laws and precedents to push their radical agenda. There can be no serious or scientific discussion about containing the spread of COVID-19 that doesn\u2019t begin at our southern border.\u201d<\/p>\n<div class=\"7thb8Z5H\">\n<div id=\"div-gpt-ad-1567704208086-0\" data-google-query-id=\"CJi9i6a-g_MCFWCDywEdopMM9Q\">\n<div id=\"google_ads_iframe_\/1011927,22478146730\/LIN_300_by_250_bottom_0__container__\"><iframe id=\"google_ads_iframe_\/1011927,22478146730\/LIN_300_by_250_bottom_0\" title=\"3rd party ad content\" name=\"google_ads_iframe_\/1011927,22478146730\/LIN_300_by_250_bottom_0\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" data-google-container-id=\"6\" data-load-complete=\"true\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<p>The administration has not written or clarified the mandate\u2019s rules. Brnovich <a role=\"link\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2021\/09\/14\/arizona-attorney-general-mark-brnovich-sues-over-biden-vaccine-rules\/8339562002\/\" target=\"_blank\" rel=\"noopener\">said his<\/a> \u201clawsuit is valid because it seeks to declare that the federal government doesn\u2019t have the authority to create such rules.\u201d<\/p>\n<p>A reporter asked about Brnovich\u2019s office recognizing federal safety regulations regarding hard hats at construction sites. The AG <a role=\"link\" href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2021\/09\/14\/arizona-attorney-general-mark-brnovich-sues-over-biden-vaccine-rules\/8339562002\/\" target=\"_blank\" rel=\"noopener\">told the reporter<\/a>, \u201cStay tuned for the next lawsuit.\u201d<\/p>\n<p>Um, hard hats don\u2019t inject a substance into your body. But don\u2019t get me started on federal safety regulations because a libertarian could go on forever about them.<\/p>\n<p>Let\u2019s get to the brief.<\/p>\n<p>Brnovich cites the Equal Protection Clause in his brief due to the Biden administration exempting illegal aliens from the vaccine mandate.<\/p>\n<p>The Equal Protection Clause falls under the <a role=\"link\" href=\"https:\/\/www.law.cornell.edu\/constitution\/amendmentxiv\" target=\"_blank\" rel=\"noopener\">14th Amendment, Section 1<\/a>: \u201cNo state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.\u201d<\/p>\n<p>Brnovich explains in the complaint why the <a role=\"link\" href=\"https:\/\/legalinsurrection.com\/wp-content\/uploads\/2021\/09\/Vaccine_Equal_Protection_Complaint_FINAL.pdf\">mandate violates the clause<\/a>:<\/p>\n<blockquote><p>7. Although the precise contours of the federal vaccination mandates are not yet clear, the violation of the Equal Protection Clause is already evident and egregious. In a nutshell: unauthorized aliens will not be subject to any vaccination requirements even when released directly into the United States (where most will remain), while roughly a hundred million U.S. citizens will be subject to unprecedented vaccination requirements. This reflects an unmistakable and unconstitutional\u2014brand of favoritism in favor of unauthorized aliens.<\/p>\n<p>8. This discrimination in favor of unauthorized aliens violates the Equal Protection Clause. Notably, alienage is a suspect class that triggers strict scrutiny. More typically (and almost invariably previously), this discrimination was against aliens rather than for them. See, e.g., Graham v. Richardson, 403 U.S. 365, 371, 375-376 (1971); Application of Griffiths, 413 U.S. 717, 721 1973). But the same principle applies to favoritism against U.S. citizens in favor of aliens. Defendants\u2019 actions could never conceivably pass strict scrutiny.<\/p><\/blockquote>\n<p>\u201cBecause Defendants\u2019 respect for individual rights vis-\u00e0-vis vaccination mandates appears to extend only to unauthorized aliens, and not U.S. citizens, their actions violate the Equal Protection Clause and should be invalidated,\u201d <a role=\"link\" href=\"https:\/\/legalinsurrection.com\/wp-content\/uploads\/2021\/09\/Vaccine_Equal_Protection_Complaint_FINAL.pdf\">continues Brnovich<\/a>. \u201cAmerican citizens should be entitled to treatment at least as favorable as what Defendants afford to unauthorized aliens. This Court should accordingly declare this preferential treatment unlawful and enjoin actions taken pursuant to it.\u201d<\/p>\n<p>Remember when Biden\u2019s Chief of Staff Ronald Klein retweeted this?<\/p>\n<div id=\"stickypbModal403\">\n<div id=\"div-gpt-ad-1616093885120-0\" data-google-query-id=\"CIS9jaa-g_MCFWCDywEdopMM9Q\">\n<div id=\"google_ads_iframe_\/1011927,22478146730\/LIN_SixthWindow_0__container__\"><iframe loading=\"lazy\" id=\"google_ads_iframe_\/1011927,22478146730\/LIN_SixthWindow_0\" title=\"3rd party ad content\" src=\"https:\/\/52e96a997edb5eff467f601e4299b5de.safeframe.googlesyndication.com\/safeframe\/1-0-38\/html\/container.html\" name=\"\" width=\"300\" height=\"250\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" sandbox=\"allow-forms allow-popups allow-popups-to-escape-sandbox allow-same-origin allow-scripts allow-top-navigation-by-user-activation\" data-is-safeframe=\"true\" data-google-container-id=\"5\" data-load-complete=\"true\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-364640\" src=\"https:\/\/c2.legalinsurrection.com\/wp-content\/uploads\/2021\/09\/Screen-Shot-2021-09-14-at-5.02.31-PM-e1631656987402.png\" alt=\"\" width=\"500\" height=\"455\" \/><\/p>\n<p>Lawyers said the retweet would cause problems for Biden. Well, it has because Brnovich brings it up in the <a role=\"link\" href=\"https:\/\/legalinsurrection.com\/wp-content\/uploads\/2021\/09\/Vaccine_Equal_Protection_Complaint_FINAL.pdf\">complaint<\/a>:<\/p>\n<blockquote><p>13. Recognizing that the Federal Government lacks the authority to directly impose a mandate, even the President\u2019s own Chief of Staff retweeted that what the administration was planning for citizens (but not unauthorized aliens) would be the \u201cultimate work-around.\u201d<\/p>\n<p>14. The inadvertent admission in the preceding paragraph makes all of the administration\u2019s actions constitutionally suspect. These other violations will be the subject of future challenges. Courts will have an opportunity to review and invalidate those forthcoming mandates as to private employers, federal contractors, federal employees, and health care workers.
