The Texas law, also known as\u00a0Senate Bill 8<\/a>, bans abortions\u00a0after a heartbeat is detected, which is usually around six weeks, unless a medical emergency exists.<\/p>\n U.S. District Judge Robert Pitman, an Obama appointee, had\u00a0on Wednesday granted the Biden administration\u2019s petition to\u00a0temporarily suspend the law<\/a>. Pitman at the time also denied Texas\u2019 request to delay the enforcement of the injunction until it files an appeal with a higher court.<\/p>\n Texas\u00a0quickly moved to file an appeal<\/a>.\u00a0Texas Attorney General Ken Paxton, a Republican, said in a statement on Thursday, \u201cWe disagree with the Court\u2019s decision \u2026\u00a0The sanctity of human life is, and will always be, a top priority for me.\u201d<\/p>\n The New Orleans-based Fifth Circuit Appeals Court late on Friday granted the request, setting aside\u00a0Pitman\u2019s order for now. It ordered the Justice Department to respond by Tuesday.<\/strong><\/p>\n Paxton celebrated the news late Friday. \u201cGreat news tonight, The Fifth Circuit has granted an administrative stay on #SB8. I will fight federal overreach at every turn,\u201d he said in a\u00a0statement<\/a>.<\/p>\n Pro-life group Texas Right to Life praised the development, writing on\u00a0Twitter<\/a>, \u201cThe Texas Heartbeat Act is back in full effect! \u2026\u00a0Praise God! The law will continue saving ~100 babies per day!\u201d<\/p>\n The Texas Heartbeat Act was signed into law by Republican Gov. Greg Abbott in May.\u00a0More than 20\u00a0abortion<\/a>\u00a0providers sued state officials and district judges in July, alleging the law was unconstitutional, citing the Supreme Court\u2019s 1973 decision in Roe v. Wade. The legislation\u00a0went into effect on Sept. 1<\/a>\u00a0after the Supreme Court didn\u2019t respond to an emergency motion asking it to block the ban.<\/p>\n The Texas legislation forbids the state government from enforcing it, and instead provides for private citizens\u2014except for the individual who impregnated the woman through rape or incest\u2014to file lawsuits against\u00a0abortion providers. The private citizens are\u00a0entitled to collect at least $10,000 in damages for each abortion if their case is successful.<\/p>\n The law provides for\u00a0retroactive lawsuits if the law is set aside by one court, but later restored by another.<\/p>\n Abortion provider Planned Parenthood previously said that\u00a0about 85 to 90 percent of people who obtain abortions in the Lone Star state are at least six weeks into pregnancy.<\/strong><\/p>\n Prior to Pitman\u2019s injunction, other courts had\u00a0declined to stop the law, including the\u00a0Supreme Court and the Fifth Circuit Appeals Court in September.<\/p>\n
