Biden threatened to cut federal funding from businesses that refuse to comply. But there is no executive order to back this up. It was just an announcement to the press. Press statements have no legal authority.<\/h3>\n<div class=\"su-note-inner su-u-clearfix su-u-trim\">\n<p>Scientist and author James Lyons- Weiler tweeted about the OSHA final rule: <em><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">\u201c<\/span><\/em><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">Word to the wise: The <\/span><span class=\"css-901oao css-16my406 r-poiln3 r-b88u0q r-bcqeeo r-qvutc0\">OSHA<\/span><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"> Final Rule has not been entered in the Federal Register. If you are an employer and you are enforcing vaccine or test mandates, you\u2019re wide open to lawsuits for damages, lost wages, and psychological distress.<strong> It\u2019s a Guidance,<\/strong> meaning it\u2019s <\/span><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"><strong>non-binding.<\/strong><\/span><em><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"><strong>\u201c<\/strong><\/span><\/em>-GEG<\/p>\n<\/div>\n<\/div>\n<p><iframe loading=\"lazy\" title=\"Biden Announces New Vaccine Mandates For Millions of Americans\" src=\"https:\/\/www.youtube.com\/embed\/N0sVBhQpmLU?feature=oembed\" width=\"678\" height=\"381\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p>Yes, we\u2019ve heard all about Joe Biden\u2019s alleged vaccine mandate for private companies employing 100 or more people. It was all over the news even before he <a href=\"https:\/\/www.youtube.com\/watch?v=CwjV6MDU9E8\">announced it<\/a> on September 9. His announcement has jeopardized the employment of <a href=\"https:\/\/time.com\/6098752\/biden-vaccine-mandate-company-reactions\/\">millions<\/a> of Americans and increased worker shortages in critical domains such as health care.<\/p>\n<p>There\u2019s only one problem. It\u2019s all a mirage. Biden\u2019s so-called vaccine mandate doesn\u2019t exist \u2014 at least, not yet. So far, all we have is his press conference and other such made-for-media huff-puffing. No such rule even claiming to be legally binding has been issued yet.<\/p>\n<p>That\u2019s why nearly two dozen Republican attorneys general who have publicly voiced their opposition to the clearly unconstitutional and illegal mandate haven\u2019t yet filed suit against it, the Office of the Indiana Attorney General confirmed for me. There <em>is<\/em> no mandate to haul into court. And that may be part of the plan.<\/p>\n<p>According to several sources, so far it appears no such mandate has been sent to the White House\u2019s Office of Information and Regulatory Affairs yet for approval. The White House, the Occupational Safety and Health Administration (OSHA), and the Department of Labor haven\u2019t released any official guidance for the alleged mandate. There is no executive order. There\u2019s nothing but press statements.<\/p>\n<p>Despite what you may have been falsely led to believe by the media fantasy projection machine, press statements have exactly zero legal authority.<\/p>\n<p>\u201cThere is nothing there yet that gives employers any mandate,\u201d Stephanie McFarland, spokeswoman for the Indiana Occupational Safety and Health Administration, told me Oct. 6. \u201cThe president made an announcement on this asking OSHA to do it, but we\u2019ve not yet seen anything come from it yet,\u201d she also said. When the state agency gets any further information, she said, they\u2019ll review it.<\/p>\n<p>To impose the public perception of a mandate, the Biden administration is following an unusual rule-making process it also employed earlier this year, called an emergency temporary standard (ETS). The <a href=\"https:\/\/www.osha.gov\/coronavirus\/ets\">spring ETS rule<\/a> took <a href=\"https:\/\/news.bloomberglaw.com\/business-and-practice\/companies-see-manna-from-heaven-with-biden-vaccine-mandate\">nearly six months<\/a> to issue. Meanwhile, companies are telling reporters their vaccine mandates will have at the latest December deadlines. (For those who can\u2019t calendar, that\u2019s <i>four <\/i>months after Biden\u2019s non-existent mandate was proclaimed.
