A federal court has issued a temporary victory in a lawsuit against the Biden administration\u2019s coronavirus vaccine mandate\u00a0issuing a stay on the controversial federal government regulation in Texas<\/strong>.<\/p>\n

“Yesterday, I sued the Biden Admin over its unlawful OSHA vax mandate,”\u00a0<\/strong>Texas\u2019 Republican Attorney General Ken Paxton tweeted Saturday.<\/p>\n

“WE WON. Just this morning,\u00a0citing “grave statutory and constitutional issues,”<\/strong>\u00a0the 5th Circuit stayed the mandate.\u00a0The fight is not over<\/strong>\u00a0and I will never stop resisting this Admin\u2019s unconstitutional overreach!”<\/p><\/blockquote>\n

As Fox News reports<\/a>, earlier in the week, Paxton\u00a0sued<\/u><\/a>\u00a0the Biden administration over the mandate and argued that the move to force workers at companies with over 100 employees to be vaccinated or undergo weekly testing is “flatly unconstitutional.”<\/p>\n

“Biden\u2019s new vaccine mandate on private businesses is a breathtaking abuse of power,”<\/strong><\/em>\u00a0Paxton tweeted Friday.<\/p>\n

“OSHA has only limited power & specific responsibilities.\u00a0This latest move goes way outside those bounds. This \u2018standard\u2019 is flatly unconstitutional. I\u2019m asking the Court to strike it down.<\/strong>“<\/p><\/blockquote>\n

The Wall Street Journal reports\u00a0<\/a>that the New Orleans-based Fifth Circuit said it would quickly consider whether to issue an injunction against\u00a0the vaccine and testing requirements<\/a>, ordering the Biden administration to file initial legal papers by late Monday afternoon.<\/p>\n

The White House remains confident the mandate will stand up to legal challenges.<\/p>\n

“We are very confident that it can,”\u00a0<\/strong>White House Deputy Press Secretary Karine Jean-Pierre said.<\/p>\n

“As for the legal side of this, let me be crystal clear to avoid what appears to be possible misinformation or disinformation around the emergency temporary standard being a vaccine mandate. That would be on its face incorrect as has been explicit for months. It is a standard for safe workplace to either comply with weekly testing or to be vaccinated.”<\/p><\/blockquote>\n

This decision comes as Sen.\u00a0Josh Hawley\u00a0(R-Mo.) said he\u2019s joined an effort spearheaded by fellow Republican Sen.\u00a0Mike Braun (R-Ind.) to block President Joe Biden\u2019s private employer COVID-19\u00a0vaccine mandate\u00a0under the Congressional Review Act, the process for Congress to scrap an executive branch rule.\u00a0The Congressional Republicans, which include both Senate and House lawmakers, are seeking formal nullification of Biden\u2019s mandate.<\/strong><\/p>\n

Hawley said in a\u00a0Nov. 5 press release<\/a>\u00a0that Biden\u2019s mandate threatens to worsen the current labor shortage and supply chain issues, is an \u201cunconstitutional\u00a0infringement on the fundamental rights of American citizens\u201d and \u201cunlawfully bypasses established regulatory procedures.\u201d<\/p>\n

\u201cHe is ignoring this basic principle by forcing employers to require their workers be vaccinated, undergo rigorous testing procedures, or be fired. It\u2019s wrong, will make our nation\u2019s economic challenges worse, and must not be allowed to go into effect,\u201d Hawley said.<\/p><\/blockquote>\n

Following today’s Federal Court of Appeals decision, we presume next stop will be SCOTUS to decide just how authoritarian the US Government can be.<\/p>\n
